    Despite having no alcohol ordrugs inhissystem, attorneyRobert Gonos was placedunder arrest forsuspicion of driving under the influencethemorningof June 10whenhis car broke down at aSouth Main Street intersec-tion.

    Police alleged he slurredhiswords, couldnt stand andacted belligerently.

    Without administering

    any field sobriety tests, citypolice slapped handcuffs onthe 60-year-old veteran attor-ney as passersby beepedandshot catcalls. He was trans-ported to the hospital forblood testing and then led topolice headquarters for fin-gerprints and a mugshot.Officers told him chargeswere pending the results of theblood tests.

    Ten days later, the test

    resultsarrived.No alcoholordrugs were found in his sys-tem. Police couldnt bringany charges and closed thecase. Butfor Gonos, thedam-age wasalready done. Policeissued a press release aboutGonos arrest that was pub-lished in a local newspaper.He said his reputation hasbeentarnished by theunlaw-ful arrest and is contemplat-ing legal action.

    My business is based onreputation, Gonos, the sonof a long-time city policedetective, said Wednesday athis South Franklin Streetoffice. This was an incredi-bleviolation of my rights.

    Gonos said he displayedno signs of intoxicationwhen confronted by policearound8:40a.m.

    Wilkes-Barre police tell adifferent story and stand by

    thearrest.Thepolice incidentreport,filed by arresting OfficerKevin Steve and releasedWednesday, says a callerreportedthat a malewhohadbeen driving erraticallyappeared to be passed outbehind the wheel of a whiteSaabat a greenlight atSouthMain and Parrish streets.The report says Gonos haddifficulty standing, hadslurred speech, and shouted

    obscenities at officers. Policesaid that when asked foridentification, Gonosinitial-ly gave them a credit card.When asked if hewas underthe influenceof anymedica-tions,Gonos toldthem dont(expletive)worry about whatI take the reportsays.

    Those series of eventsraised enough suspicions to

    arrest Gonos and take himfor blood testing, Wilkes-Barre police Deputy Chief Donald Crane said Wednes-day.

    As to why he was actinglike that, we may neverknow, Crane said.

    Gonos stronglyrefutedthecontents of the incidentreport andcalled it defama-tory.

    It didnt happen that way.

    Every statement that theyattributed to me was abso-lutely false, Gonos said.They used words that Iwouldnt use.

    Gonos saidhis vehiclewasmalfunctioning froman elec-trical problem as he tried todrive it to a repair shop onWoodStreet. He said thecityfire department wasthe firstto respond and planned tohelp him push his vehicle

    outof theintersection.When

    police arrived, the pulled infront of the vehicle and anofficer immediately accusedhim of being intoxicated,Gonos said.

    There was absolutelyzero nothing wrong withme, Gonos said.

    Barry Dyller, an attorneywho shares the same build-ing as Gonos and will repre-

    sent him if he pursues civilaction, has sued Steve andthe Wilkes-Barre PoliceDepartment on behalf of another client before. Thathistory, Gonos said, mayhave contributed to hisarrest.

    I think theres a connec-tion, Gonos said, noting heasked to call Dyller minutesafter police started question-inghim atthe scene.

    Dyller said Wednesdaythathe representeda womanarrested for public drunken-ness. Steve, she claimed,lured her from her home to justify the arrest. Dyller saidthey settled the matter pri-vately.

    Askedabout what heplansfor the Gonos case, Dyllersaid, Its not over.
