SUMMARYOn February 6, 1986, the Trust issued Right of Way No. 3088, for a water line, to a private party. The right of way was thenassigned to the Bureau of Land Management ("BLM") Cedar City office on June 6, 1988. 

It was then discovered that the water line was not installed within the right of way. For that reason, the BLM chose to exercise itsreserved right of way in lieu of relying on the assigned right of way. On July 22, 1988, the BLM submitted a Right of Way Noticeto the Trust and confirmed that the reserved right of way was to replace Right of Way No. 3088. The BLM right-of-way number isU-63254, and its term is perpetual. The reserved right of way is approximately 2,493.39 feet long and 24 feet wide, containingapproximately 1.5 acres.

The BLM reserved right of way has now been assigned Easement No. 2164 for record-keeping purposes.

BACKGROUNDSBA 2012 TC ASSETS, LLC is the lessee of this communication tower for cellular and wireless communications. This action isto amend the lease, which would otherwise expire on July 31, 2018.

NARRATIVEThe lessee is the current operator of this communication site and has formally requested that the existing lease for a cellular-wireless communication tower and facility be amended to allow for a longer term. The primary and sole purpose of the leaseshall remain for the lessee’s cellular-wireless communication tower and facility and its subleasing business. The operator hasexpressed the importance of increasing the lease term for future planning and creating business opportunities and potentialsublease tenants, especially since the lease is due to expire on July 31, 2018 without an amendment. The lessee is a successorin interest to the original lessee, and is operating the current site in connection with its federally licensed communicationsbusiness. The lessee and the Trust propose to continue leasing the existing communication site using a proposed amended andrestated lease agreement to replace the current lease agreement.

The existing site is exempt from review by the Resource Development Coordinating Committee ("RDCC") and the localAssociation of Government and County because it is an existing site. The local government is aware and supportive of theexisting site.  Because the site is an existing facility, this is an amended lease only, and there is no planned additional future surfacedisturbance. The site is not an undertaking for cultural resource review and paleontological survey review. The proposed amendment is consistent with Rule 850-30-1000 and Rule 850-2, and it is in the best interest of the Trust toamend the special use lease agreement. The term of the amended lease is 20-years, which is the normal maximum term for telecommunication site leases, as providedfor in R850-30-200(3)(c).

FINANCIAL/REVENUEAgency staff is recommending an amount of $12,000.00 per year as the amended annual base lease rental for the first five-yearperiod, as provided for in the proposed amended and restated lease agreement. This is an increase from $8,650.00 to$12,000.00.  The lessee’s sole business is leasing space to cellular and wireless communication sublessees. It does not haveits own radio communication business. The proposed rental for this type of use in this area is within the range of market value. The Trust is requiring the lessee to amend and restate the lease in its entirety, using a currently approved amended andrestated special use lease form. The amended lease also contains an improved structure for future subleasing opportunities,giving a larger share of any potential sublease revenue (25% of gross sublease revenue received) from co-located sublesseesto the beneficiaries than in the existing lease agreement.

It is nearly certain that the return per acre for the parcel as a communicationsite will greatly exceed the fair-market value rental of the subject property for other surface uses. The current raw land value inthis area is approximately $300.00 per acre. The proposed continued use is still considered the highest and best use of thisproperty, and as far as can be determined, shall not adversely affect the remainder of the trust lands for the remainder of thelease term.

The lessee is a Delaware limited liability company, registered in the State of Utah, and in good standing. The lessee has currentupdated insurance coverage, and has a $5,000.00 surety bond, which is currently in the process of being increased to anamount of $10,000.00.

SUMMARYThe lease is hereby amended with a 20-year term, and with an amended new beginning date of April 1, 2018 and expirationdate of March 31, 2038. There is a beginning annual base rental of $12,000.00 annually, which includes the first co-locatedsublessee; in addition, there is a 25% revenue share agreement of all gross revenue received from each future sublessee, asset forth in the amended and restated lease agreement. The next five-year review is to be completed by April 1, 2023.

WATER RIGHTS AND WELLS:There are no Trust-owned water rights associated with this lease. ENVIRONMENTAL COMPLIANCE:The property was inspected and reviewed for environmental compliance by Jim Davis and Sonja Wallace on March 20, 2018.The lease inspection indicated it would be rated as medium risk. There is no evidence of unauthorized storage or dumping. Thelandfill is well managed. The complete environmental report is in the lease file.

FINANCIAL/REVENUEThe royalty will remain $2.50 per ton for the first 25,000 tons and $3.25 per ton thereafter, with a minimum annual royalty of$50,000.00. The lease agreement provides for periodic increases in the annual base rental amount. Pursuant to the leaseagreement, it is recommended that the annual base rental be increased from $6,090.00 per year to $6,300.00 per year, effectiveMay 1, 2018.

A certified notice was sent informing the lessee of this action. No response has been received.

After a preliminary analysis pursuant to Board policy, the value of comparable, unimproved properties in the area has beenestimated to be approximately $62,000.00 per acre. Any rental increase should be tied to comparable lease rentals, publishedfederal price indices, or other methods as provided for in the lease agreement. The existing lease is currently considered thehighest and best use of a parcel of this type of land.

SUMMARYOn March 14, 2018, an application was received from the Firebirds Motorcycle Club, for a right-of-entry permit for an off-highway motorcycle race on a specified race course. The vast majority of the race area is located on federal land. Only a very small portion of the planned race course is on trustlands scattered within the area. The race area is within rural Juab County in an area where these types of races have beenpreviously held.    The race is being monitored by the Bureau of Land Management ("BLM"), which is the lead agency for thisactivity. The BLM has reviewed and selected the race route which is on existing roads and trails. Appropriate liability insurancewas provided for the event.

This right of entry was approved by the resource specialist on March 26, 2018, based on the terms of the permit and theDelegation of Authority received from the Director.
