4. Bidders having criminal record will not be allowed to participate in Bid process.5. A person registered with any State Bar Council will not be eligible to participate in the Bid.6. Contractors who interalia fulfill the following requirements shall be eligible to apply, Joint

ventures are not allowed.(a) Should be registered with U.P.Jal Nigam! Construction & Design Services U.P. Jal Nigam

in Category B (Building) or Central Public Works Deptt. (CPWD) I V.P. Public WorksDeptt. (U.P.P.W.D.) in Class B or S.S. Class in Military Engineering Services or any U.P.State Govt, Public Sector undertaking & Development Authorities of U.P., in appropriatecategory of work, in Class B, as specified in Regulations for Classification and Enlistmentof Contractors.

(b) Should have satisfactorily completed the works as mentioned below during the last Tenyears ending pervious day of last date of submission of tenders.i) Three similar works each costing not less than (40%) or two similar works each

costing not less than (50%) or one similar work costing not less than (80% oftendered cost).Above work should have been executed with some Central/State Government

Departmentl Central Autonomous Bodyl State Autonomous Body/Central PublicSector Undertaking/ State Public Sector Undertaking/ City Development AuthoritylMunicipal Corporation of City Formed under an act by central/ State Governmentand published in Centrali State Gazette.Similar work shall mean works of "Construction Of Framed Structure/MultiStorey Building as described in Instructions to Bidder."Should have average annual financial turn over during the last 3 consecutive yearsending 31st March of Previous financial year equal to at least (30% of the estimatedcost of work) &turn over in any one year should be at least ?Q% of the estimatedcost of work. Year in which no turnover is shown would also be considered forworking out the average.

(c) Should not have incurred any loss in more than two years during the last five balance sheetsof consecutive years ending 31 st March, 2016.At the time of submission of bid, contractorhas to upload Affidavit/Certificate from CA mentioning Financial Turnover on constructionwork of last 5 years, Further details if required may be asked from the contractor afteropening oftechnical bids.

(d) Should have a solvency of (40% of estimated cost).For this purpose a valid HaisiyatCertificate in Form No. "l-E"- issued by District Magistrate will be acceptable. In addition asolvency certificate issued by a Bank should also be submitted in Form-"II-B".

(e) The value of executed works shall be brought to current costing level by enhancing theactual value ofwork at a rate given below calculated from the date of completion to last dateof submission of tenders.

7. Information and Instruction for bidders posted on website shall form part ofbid document.8. The bid document consisting of Technical (eligibility)bid &financial bids including

specifications, the schedule of quantities of various types of items to be executed and the set ofterms and conditions of the contract to be complied with and other necessary document areavailable on "https://e-tender.up.nic.in".

9. The technical bid shall be opened first on due date and time as mentioned above. The time anddate of opening of financial bid of contractors, qualifying the technical bid shal! becommunicated to them at a later date.

10. The department reserves the right to reject any prospective application without assigning anyreason.

II. The bidder who wishes to download tender document may download them free of cost frornwww.etender.up.nic.in, however in order to participate in bid process he wil! have to depositRs. 5,600.00 (tender cost Rs. 5,000+GST(12%) in shape of Bank Draft in favour oL'Director,Unit-02, C&DS, U P Jal Nigam" payable at Rudrapur

12. Earnest Money should at, the Bidder's option, be in the form of pledged FDR /CDR /TDR of aNationalised Bank (Co-operative Banks not allowed), NSC, Post office Savings Bank dulyissued & pledged in favour of "Director, C&DS, U PlaI Nigam,Lucknow". TheFDRlCDR/TDR shall be valid for six months or more after the last date ofreceipt ofbids.

13. The bidder wil! in addition to other documents, upload scanned and digitally signed copies ofproof of cost of bid document, earnest money as described above and Standard Affidavit inprescribed form 'I-C'. Further he shal! deposit original copies of proof of cost of bid document,earnest money as described above and Standard Affidavit in the office of undersigned on orbefore 25/09/2017 at. 03 :OOpm

14. The above originals may be submitted either in person or through Speed-Post.15. AII the documents as specified in the technical bid/eligibility bid document should be uploaded

within the period ofbid submission.16. The bid submission shal! become invalid if:

(i) The bidder is found ineligible.(ii) The bidder does not submit/upload ali the documents as stipulated in the bid document.(iii) lf any discrepancy is noticed in hard copies as submitted physically by the bidder in

the office ofbid opening authority.(iv) The bidder does not deposit valid original EMD, tender fee and Aftidavit in the

oftice of undersigned before stipulated date.17. The Bidder shall have to submit additional security/performance security with acceptance of

Bid in compliance to GO. No. 622/23-12-20J 2-2 Audit/08 TG-2 dated 08.06.2012, if thefinancial bid is found to be below norms as specified-

a. For upto 10% below BOQ amount @ 0.50% for every 1% below rates.b. For> J 0% below BOQ amount @l% for every 1% below rates.

18. lntending Bidders are advised to inspect and examine the site and its surroundings and satisfythemselves before submitting their bids as to the nature of the ground and sub-soil (so far as ispracticable), the form and nature of the site, the means of access ta the site, the accommodationthey may require and in general shall themselves obtain al! necessary information as to risks,contingencies and other circumstance which may influence or affect their bid. A bidders shall bedeemed to have full knowledge of the site whether he inspect it or not and no extra chargeconsequent on any misunderstanding or otherwise shall be allowed. The bidders shall beresponsible for arranging and maintaining at his own cost all materials, tools & plans, water,

electricity access, faculties for workers and ali others services required for executing the workunless otherwise specifically provided for in the contract documents. Submission of a bid by abidders implies that he has read this notice and ali other contract documents and has madehimself aware of the scope and specifications of the work to be done and local conditions andother factors having a bearing on the execution ofthe work.

19. Canvassing whether directly or indirectly, in connection with bidders is strictly prohibited andthe bids submitted by the contractors who resort to canvassing will be liable for rejection &willbe debarred from tu ture tender in C&DS, U P Jal Nigam.

20. The contractor shall not be permitted to bid for works under supervisory control of GeneralManager and Project Manager concerned who is responsible for award and execution ofcontracts, in which his near relative is posted. He shall also intimate the names of persons whoare working with him in any capacity or are subsequently employed by him and who are nearrelatives to any officer in the C&DS. Any breach of this condition by the contractor wouldrender him liable to be removed from the approved list of contractors of C&DS and make himliable for black listing.

21. No Engineer or other Gazetted Officer employed in Engineering or Administrative duties in anEngineering Department of the STATE GOVERNMENT/State department Undertaking isallowed to work as a contractor for a period of two year after his retirement from Governmentservice, without the prior permission of the Government of U.P. in writing. This contract isliable to be cancelled if either the contractor or any of his employees is found any time to besuch a person who had not obtained the permission of the Government of U.P. as aforesaidbefore submission ofthe bid or engagement in the contractor's service.
