MEETING MINUTES

May 13, 1986

The Interagency Coordinating Committee (ICC) held its regularmeeting at 9:30 a.m. on Tuesday, May 13, 1986 in Room 1571 of theLos Angeles Department of Water and Power (LADWP) General OfficeBuilding. Mr. Laurent McReynolds, Chairman of the ICC, conductedthe meeting. The meeting agenda and attendance list are attached(Attachments 1 and 2).

II. APPROVAL OF MINUTES

Minutes of the March 13, 1986 meeting were approved aswritten.

III. PROGRESS REPORT OF SUBCOMMITTEE ACTIVITIES

A. Public Education Program; W. Zeisl (LADWP)

W. Zeisl reported on the successful acceptance of theSan Fernando Valley Groundwater brochure. Out of 50,000 copies,10,000 (20%) have already been distributed to local agenciessuch as the Bureau of Sanitation, the City of Burbank and otherCity of Los Angeles departments.

The LADWP has received numerous requests for talks on waterquality this year and has taken these opportunities to distributethe brochure. It has been well received at these presentations.

The LADWP has developed samples of an ICC letterhead.The samples were passed around at the meeting for committee review.

B. Regulations of Private Disposal Systems; D. Yoest(Los Angeles Department of Public Works Bur/Engr.) for R. Van Ark

The Los Angeles Bureau of Sanitation (Bur/San) has mailedthe initial Notices to Connect, to owners on the Private SewageDisposal System (PSDS) program. Approximately 300 owner inquirieshave been received due to this notice.

A sample of the Notice to Connect letter is included withthe minutes of this meeting (Attachment 3).

C. Regulation of Storage Tanks, Sumps/ and Pipelines;J. Hall (LAFD)

J. Hall reported that the Subcommittee reviewed AssemblyBill Number 2920 authored by Assemblyman Sher. The Subcommitteerecommended that the Bill not be supported.

R. Walls of Los Angeles County Department of Public Works isworking on the formulation of guidelines for Los Angeles Countyfor decontamination of abandoned underground storage tanks.

The Los Angeles Fire Department is seeking clarification onthe division of responsibilities between the City of Los AngelesFire Department, the Los Angeles County Health Department and theRegional Water Quality Control Board on handling unauthorizedreleases of hazardous materials. The need to develop a Memorandumof Understanding (MOU) to direct the actions of the agencies isnow being studied.

It was announced at the meeting that the Regional WaterQuality Control Board (RWQCB) will have a meeting at the StateBuilding, 107 South Broadway, on May 19. Covered will be asummary of an underground storage tanks program for each agency'sprogram in the Basin.

Since W. Le Beck will be retiring from the Fire Departmentthis summer, L. McReynolds nominated J. Hall as the new chairmanfor this Subcommittee. There were no other nominations or volun-teers. J. Hall was selected to be the chairman.

H. Yacoub submitted the RWQCB quarterly staff report onunderground storage tanks (Attachment 4). This report compilestechnical information on the status of local agency undergroundstorage tank programs. H. Yacoub stated that the inclinationof the Regional Board is to give more jurisdiction to the localsin cleaning up leaks or spills that contaminate soil only.

H. Yacoub discussed a case study of the consequences of atank leak at a gas station. This station had an undergroundstorage tank capacity of over 8,000 gallons. Due to an undetectedleak, it was necessary to evacuate a nearby motel before cleanupcould begin. (The report is available upon request).

The RWQCB expects to develop an MOU with Los Angeles Countyin the near future. Local governments will be encouraged toestablish their own guidelines based on Regional Board requirements,

D. Regulation of Landfills, Groundwater Monitoring Program;E. Coufal (LADWP)

Landfill Monitoring

M. Blevins reported that the RWQCB has requested additionalwells to be drilled in the Sheldon-Arleta Landfill for groundwatermonitoring.

0000167R. Humphrey passed out five fact sheets (Attachment 5) by

the Bur/San concerning the Sheldon-Arleta Landfill. The Bur/Sanwill soon be hiring a consultant to prepare the Solid WasteAssessment Test (SWAT) Report for Groundwater Quality for theSheldon-Arleta Landfill. Both R. Humphrey and H. Yacoub expressedtheir satisfaction with current LADWP monitoring program of wellsin and around the landfill area.

Forest Lawn has installed and is monitoring a downgradientwell at its landfill.

A.B. 1803

H. Yacoub reported that the Regional Board will receivefunds in the fall to investigate the sources of well contami-nation revealed by the A.B. 1803 program. The Board willinvestigate any potential contamination source within a half-mile radius of a detection site. If leaks are detected, theRegional Board will require cleanup and will do a follow-upinvestigation. The San Fernando and San Gabriel Valley Basinswill be among the first analyzed. The Board expects to add 5-6staff persons to handle the extra work load.

Los Angeles County has begun the second round of A.B. 1803testing which includes small water systems. This will be a3-year contracted program.

All A.B. 1803 data will be input into the state computerdata bank.

E. Aquifer Management and Groundwater Treatment Program;M. Blevins(Watermaster,San Fernando Valley Basin)

Lockheed, Rocketdyne, Centralab and Riker labs arecontinuing with their remedial programs of monitoring forunderground hazardous material contamination on their proper-ties.

E. Coufal reported that thirteen well pumps are now beingpulled as part of the well packer installation project inNorth Hollywood. Seals are being refurbished and packers willbe installed over the next few months.

M. Blevins passed out an amendment guideline (Attachment 6)for the San Fernando Judgement, Case No. 650079 Los AngelesSuperior Court. This document outlines conceptual considerationsfor amending the judgement to allow pumping and discharge ofwaters to deal with pollutant cleanup.

The LADWP is preparing a letter through the office of theWatermaster on the reliability of our underground water supply.The cities of Burbank and Glendale have received similar requestsfrom the Metropolitan Water District and will review the LADWPresponse before formulating their own.

OOQQH67The Watermaster report for 1985 was finalized and approved

on May 2 and is now available.

Public Education Program

L. McReynolds announced that on May 28, a California SafetyCouncil seminar was scheduled to be held at North Hollywood HighSchool from 5:30 to 10:00 p.m. The subject/ "Handling HazardousMaterials"/ was to be directed towards small quantity hazardouswaste generators. The meeting has subsequently been rescheduledfor July 30 in the evening at a Holiday Inn in the North Hollywoodarea.

F. North Hollywood/Burbank Aeration Facility J. Enzmann(LADWP)In March, the State Department of Health Services in Berkeley/

concluded that the LADWP health risks analyses for its North Hollywoodaeration tower emissions are conservative and may even overestimatethe health concerns. (A staff report is available upon request.)The LADWP also provided calculations on the effects of acute exposure.Emission levels were shown to be well below any concentration thatwould cause any significant health risk.

Negative Declaration

A notice of the LADWP Negative Declaration on the proposedaeration facility was published in the Herald Examiner on May 8.(Copies available upon request). The 30-day comment period willcontinue until June 7. No comments have been received thus far.Since there is no requirement for a formal public hearing, theJune 12 meeting of the LADWP Board of Commissioners will addressthis project as an agenda item.

Air Quality Management District (AQMD) Public Hearing

On May 12/ AQMD held a public hearing to receive publicinput and feedback on the proposed LADWtUaeration tower.Los Angeles Council Representatives atzy Bernardi,and WachsT,Glendale Councilwoman Bremberg, and Senator Robbins were inattendance. The AQMD reviewed the permitting process andreceived testimony by 20-25 persons. Attending the hearingwere private citizens, environmentalists and media representatives

IV. STATUS OF SUPERFUND P. Cleary

A. Remedial Investigation/Feasibility Study (RI/FS)

The Environmental Protection Agency (EPA) has received theoperable unit Feasibility Study for the Fast-Track proposal forthe North Hollywood/Burbank Facility. The Regional office ofthe EPA is currently evaluating the report with the help ofconsultants Camp, Dresser and McKee.

The EPA Superfund bill has not been reauthorized. Ifreauthorization does not occur by next month, interim funding maybe made available. Further information will be available at thenext ICC meeting.

B. Community Relations Plan

An update on the community relations plan will be made atthe next ICC meeting.

C. Citizen's Participation Group

More information on the formation of the Citizen'sParticipation group will be available at the next ICC meeting.

V. NEW BUSINESS

L. McReynolds nominated D. Kile for the position of Chairmanof the ICC. This recommendation was accepted without comment.The committee decided unanimously to appoint D. Kile as Chairman.The LADWP will continue to provide support staff. It was alsosuggested that the chairman position be rotated annually amongthe represented cities.

VI. ADJOURNMENT

The meeting adjourned at 11:30 a.m. The next meeting of theICC was set for July 22, 1986 at 9:30 a.m. in Room 1571 of theLos Angeles Department of Water and Power, General Office Building.

1. What is City Ordinance No. 160388? What is its purpose?

It is an ordinance amending the Los Angeles Municipal Code to require the

abandonment of Private Sewage Disposal Systems (PSDS) employed by

Industrial, commercial, and multiple residential units (5 or more) in the

San Fernando Valley. Its purpose is to prevent the contamination of

groundwater located generally in the San Fernando Valley by toxic discharges

coming from PSDS.

2. What is a PSDS?

Private sewage disposal system (PSDS) means any septic tank, cesspool,

seepage pit, leach field, or any receptacle, or any combination thereof,

which receives any wastewater not discharged into a public sewer.

3. What section of the City does this ordinance apply?

San Fernando Valley and certain adjacent areas.

A. What is a "Notice to Connect"?

It means a N.ptice to Connect to a Public Sewer and to Abandon a PSDS.

8. What is the tine for compliance for a Notice to Connect?

The Notice to Connect shall be fully complied with no later than one year

from the date of issuance of the Notice to Connect.

9. Are there any other notices within this one year?

Yes. A Reminder Notice will be issued four months prior to the date of

compliance if full compliance with the requirements has not been achieved.

A Final Notice will be issued one month prior to the date of compliance if

full compliance with the requirements has not been achieved.

10. Who is required to comply with the Notice to Connect and what steps should

he take to comply?

Every owner of a lot upon which a PSDS is located and every person using or

maintaining a PSDS shall comply with the requirements of a Notice to

Connect. The steps he should take are: (a) Obtain a house connection

permit and plumbing permit: (b) Have the work done. (c) Request a City

plumbing inspector to certify that the work has been satisfactorily

completed.

11. Who can apply for a variance from the requirements of the ordinance?

Any person who owns, uses or maintains a PSDS and has received a Notice to

Connect.

12. On what basis can a variance be granted by the Director of the Bureau of

Sanitation? Proof by the owner that:

(a) Connection to the nearest available sewer will result In extreme

hardships; and

(b) The continued use of the subject PSDS will not have any

significant adverse effect upon water quality in the groundwater basin

Notice to Connect.

14. To whom is an application for variance submitted?

To the Director, Bureau of Sanitation.

15. What is the effective period of a variance?

Two years.

16. Can the decision of the Director of the Bureau of Sanitation be appealed?

Yes, it can be appealed to the Board of Public Works in the manner

prescribed by the ordinance. The Board's decision or its failure to act

within 90 days of the filing of an appeal may be appealed to the City

Council in the manner prescribed by the ordinance. There is a $100 fee to

appeal to the Board an an additional $100 fee to appeal the Board's decision

to the Council.

17. If a PSDS owner fails to comply with the Notice to Connect within one year

from the date of its issuance, what enforcement action (s) nay be brought

against him?

The Director of the Bureau of Sanitation shall do all of the following:

(1)' Issue a Notice of Violation;

(2) Refer the matter to the City Attorney for appropriate criminal and/or

civil action;

(3) Provide the Department of Water and Power (DWP) with a copy of.the

Notice of'Violation. The Director of the Bureau of Sanitation may

request DWP to discontinue water service at the affected property.

(A) Provide the Superintendent of Building a copy of the Notice of

Violation. The Director may request the Superintendent of Building to

SUBJECT: Local Agency Suitunary Reports - Underground Tank Program

DISCUSSION:

As part of the Agenda for the April 28, 1986, meeting of the LosAngeles Regional Water Quality Control Board, a quarterly reporton the status of the Board's Underground Tank (UGT) Program waspresented as an information item. In that report, it was statedthat a followup report on the status of the local agency UGTPrograms would be prepared for today's meeting. The informationthat follows was submitted to the Board by the six cities in thisregion that currently administer their own programs. Inaddition, a very short review of the Los Angeles County andVentura County UGT programs is included.

City of Long Beach

The response from the Long Beach Fire Department, which wasreceived on May 5, 1986, indicates that there are 439 sites inthe City with permits; the total number of permitted tanks is1,496. The response also indicates that 262 sites have been"monitored" by City staff.

Attached to the Fire Department's letter was a six-page table ofaddresses in the City of Long Beach where "leaking systems" havebeen found. Because facility names were not included, no attemptwas made by Board staff to determine how many sites on the city'slist are currently being handled by the Board. All that is knownfrom the table of cases is that there are 109 sites in the Cityof Long Beach where an unauthorized release has occurred. Ofthose 109 cases, nine have "remediation" completed or not needed.

City of Los Angeles

In a letter dated April 29, 1986, the Los Angeles city FireDepartment submitted (1) a list of the cases they have referredto the Board, (2) a list of leak cases currently being handled bythe Fire Department, (3) a summary of permit-related activities,and (4) a proposed organization chart for the City's UGT program.

According to the Fire Department, most of the time spent by Citystaff has gone toward the processing of tank abandonment permits,

as can be seen in the following breakdown of permits issued bythe Fire Department:

1. New tanks installed (since January 1984) 902

2. Old tanks abandoned 1,932

3. Tanks with in-place "monitoring" 234

In comparing the list of cases which the City says were referredto the Board by their staff with the Board's computer-generatedlist of UGT cases, the following observations have been made:

1. Twenty five of the cases on the city's referral list weredirectly reported to us by the facility owner and not theFire Department;

2. Thirty four of the cases on the Board's UGT list shown as aFire Department referral are not on the City's list.

3. Several cases shown as "turned over to the CaliforniaRegional Water Quality Control Board by the Los Angeles cityFire Department" are sites where Board staff directed thetank owners to conduct leak detection work as part of theRegional Board's UGT program that began in 1983 (i.e., priorto adoption of the City's program).

In a related matter, the Los Angeles Department of Water andPower has stated that the number of tanks in use by LADWP hasbeen reduced by 1/3 to 1/2. The Fire Department has commendedthe LADWP for this action.

City of San Buenaventura

The information from the Ventura City Fire Department wasreceived on April 17, 1986. According to their records, thefollowing permit-related activity has been tabulated.

1. Facilities with permits or with filed applications - 94

2. Facilites notified to remove or abandon tanks - 30

3. Facilites with all tanks removed -'40

4. Facilities without permits or applications - 76

Within the City limits, it appears that only one case has had areported leak - and in this case the cleanup operations arereportedly finished. Therefore, the City currently has no activeprojects where an unauthorized release has occurred. However,the Board's UGT case list shows that one more site was cleaned upseveral years ago under the direction of the Ventura City FireDepartment.

The response from the City of Santa Monica is dated March 31,1986. According to the City's report, the following permit-related activity has taken place since March 1985.

1. Facilities with all tanks removed - 33

2. Facilities with registered tanks - 104

3. Facilities with unregistered tanks - 12

The actual number of facilities with Interim or Operating Permitshas not been reported. The City also did not indicate the numberof tanks installed or replaced.

In regard to the number of leak cases, the City reports that 10sites have been found where the tanks/piping have resulted in anunauthorized release. Of those cases, one case is listed on ourUGT list as a Regional Board case, and two cases are listed bythe City as "complete," leaving a total of seven active casesactually under the jurisdiction of the city's Department ofGeneral Services. The Board's UGT list has one additional caseshown as a City referral, for a total of two Regional Board casesin. Santa Monica.

City of Torrance

On April 21, 1986, the Board received a "report" from the City ofTorrance consisting simply of one table showing 11 cases. Of the11 cases listed, two are actually being handled by the Board; theother nine apparently have been under the jurisdiction of theFire Department (seven cases are listed as active). If thesenumbers were correct, it would mean that the City has been ableto close two leak cases. However, one of the cases listed by theFire Department as "cleaned up" is still shown on the Board's UGTlist as an active case. Our list also shows five cases in theCity of Torrance not listed by the Fire Department, which bringsour caseload up to eight active cases. Board staff is workingwith the City to resolve these discrepancies.

No other information was provided by the Fire Departmentregarding the status of permits or tank removal/replacement.

City of Vernon

In a letter dated April 9, 1986, the Vernon Health Departmentsubmitted the following information concerning the status ofpermits in the City.

1. Facilities with Operating Permits 63 (total tanks - 197)

2. Facilities with Interim Permits 108 (total tanks - 369)

In regard to the number of leak cases, the City reports that onlyfour sites have been found where the tanks/piping have resultedin an unauthorized release. Of those cases, three are listed onour UGT list as Regional Board cases; the remaining case islisted as closed. It would appear, therefore, that the City ofVernon currently has no active projects under its jurisdictionwhere an unauthorized release has occurred. It should be notedthat the Board's UGT list has three more cases in the city ofVernon that were referred to us by either the facility owner orhis representative, for a total of six active Board cases inVernon.

County of Los Angeles

Attached is a summary prepared by the Los Angeles CountyDepartment of Public Works that was presented to the Board at itsmeeting in January 1986. The summary details the progress madeby the County in the San Gabriel Basin, an area where effortshave been concentrated. As reported previously, the County hasan estimated 22,000 tanks under its jurisdiction.

County of Ventura

Attached is a summary prepared by the Ventura CountyEnvironmental Health Department that also was presented to theBoard at its meeting in January. The summary shows that theCounty has been handling a significant number of leak cases inaddition to issuing permits for operating, installing, orabandoning underground tanks. There are approximately 4,000tanks in the County.

SUMMARY:

The information presented above is basically everything that wassubmitted to the Board by the local agencies. At the request ofBoard staff, representatives from all of the cities and bothcounties are present to answer questions from Board members.

On September 17, 1985, City Ordinance No. 160388 wasapproved amending the Los Angeles Municipal Code torequire the phasing-out of Private Sewage DisposalSystems -(PSDS) - employed by industrial, commercial,and multiple residences in the San Fernando Valley. Thepurpose of this ordinance is to protect and preserve thewater quality of the groundwater basins locatedgenerally in the San Fernando Valley and certainadjacent areas. The continued use of PSDS is declaredto be a threat to the quality of the groundwater and tothe public health. Therefore, the City is providing asystematic method of requiring both the connection topublic sewers and permanent abandonment of PSDS.

Analyses run on water samples taken during February and March, 1986, revealthe presence of contaminants in the ground water that are also present inthe landfill gas and gas-condensate discharged into this landfill.

Wa feel that at this time a water quality monitoring program should bedeveloped for Sheldon-Arleta landfill in order to identify and abate anysource of pollution and protect the local ground water supply. You aretherefore requested to develop and initiate a verification ground watermonitoring progran as prescribed in Section 2557 of the CaliforniaAdministrative Code, Title 23, Chapter 3, Subchapter 15.

In order to be able to monitor for the seepage of water through theclay-wall barrier and determine the mounding of the ground water into thelandfill during and after spreading in the neighboring Tujunga spreadinggrounds, you are requested to design and construct the three wells depictedon the attached location map. Wells 11 and f 2 should be constructed innatural ground outside of the clay-wall barrier, perforated from about 760feet elevation to the bottom of the well, and have permanent water levelrecorder installed. Well 13 should be drilled through the deepest point oflandfill rubbish into about 30 feet of underlying earth material. Oheperforations should be placed below the landfill in order to monitor forrising ground water into the landfill. During drilling, samples of rubbishshould be taken at 25 foot intervals and its moisture content determined.

Dcisting well 4897A (Wicks Well) should be sampled quarterly with thedetermination of volitale organics compounds (VOC) and general minerals.Of special interest is the quantification of Acetone, Methyl Ethyl Ketone andVinyl Chloride. In addition, a upgradient ground water monitoring welllocated above the spreading grounds, should be selected for backgroundcontrol. VDC and general minerals should be run of this well also, and onsamples of the water being spread.

Monitoring reports shall be submitted quarterly by the first day of thesecond month following the end of the quarter. A copy of the laboratoryreporting fbnn shall be inclided. ttie high and low depths to water in newveils II and 12 for each month shall be reported. Also the presence orabsence of liquid in the new well 13 shall be reported, as above. The dailyquantity of water spread in the active Tujunga spreading grounds shall alsobe included in each quarterly report.

You are requested to provide a report to the Board by May 30/ 1986,detailing your plan for accomplishing this ground water verificationmonitoring. It vould be advantageous if this monitoring program is alsodesigned so as to meet the monitoring obligations under the Calderon Bill.Please include design plans and specifications for the construction of thewells.

WATER RIGHTS CONSIDERATIONS IN POLLUTANT CLEANUP

The following are conceptual considerations in amendingthe San Fernando Judgment in dealing with pollutant cleanup:

1. A certain volume of water pumped for sampling andtesting should be permitted free of water rights considerations.This can be justified on a broad basis as being beneficial to thebasin and to all the parties.Suggested amount - 25 acre-feet per investigation area.

2. Water pumped and treated should be put tobeneficial use whenever possible.

3. All water pumped, treated, and put to beneficialuse or wasted must be charged to the pumping right of a party.The physical solution provisions in the judgment can be used asa guide to payments for this water.

4. Any non-party, pumping and treating to mitigate itsown plume of pollutants, has the choice of returning the treatedwater to the underground or delivering the treated water to aparty, against whose right the delivered water will be charged.A non-party, pumping and treating water to mitigate its own plumeof pollutants, may not use such water beneficially or deliverwater to another non-party for beneficial use, unless specificarrangements can be made with a party under the physical solutionprovisions of the judgment.

5. Any party, pumping and treating water from a plumefor which it is not responsible, should be encouraged to put suchtreated water to beneficial use. All such water pumping shall becharged against the party's pumping right. Any excess of pumpingover the annual pumping right shall be arranged for under thephysical solution provisions of the judgment. Any water pumpedin excess of these rights, whether beneficially used, wasted, ordelivered to a non-party shall be considered a violation of thejudgment.

6. Any water pumped from a plume must be treated andmeet state drinking water standards before being reinjected.

After the ULARA Administrative Committee Meeting ofApril 22, 1986, a draft legal document will be prepared entailingthe above considerations. Eventually a Stipulation and Orderwill be finalized (through legal counsel) for submission to theCourt. Judge Vernon Foster will have the final decision in thismatter. Judge Foster understands the need for these amendmentsto the Judgment and appears willing to sign such a document.
