EXECUTIVE SUMMARY

This chapterof theDraftEnvironmental ImpactReport (DraftEIR) ispreparedpursuant to theCaliforniaEnvironmental Quality Act (CEQA) for the proposedmixed‐use residential, hotel, and commercial project(Project).InaccordancewithCEQAGuidelinesSection15123,thischapterprovidesabriefdescriptionoftheProject;identifiessignificanteffectsandproposedmitigationmeasuresoralternativesthatwouldreduceoravoid those effects; describes areas of controversy known to the lead agency; and presents issues to beresolved.

A. PROJECT LOCATION

TheProjectSiteisgenerallylocatedat1020S.FigueroaStreet,withintheSouthParkdistrictoftheCentralCityCommunityPlanArea inDowntownLosAngeles. TheProjectSite isservedbyanetworkof regionaltransportationfacilitiesthatprovideaccesstothegreatermetropolitanarea.RegionalaccesstotheProjectSite isprovidedby thePasadena/HarborFreeway (I‐110/SR110), locatedapproximately0.3miles to thewest; the SantaMonica Freeway (I‐10) located approximately 0.5miles to the south; and theHollywoodFreeway(US‐101), locatedapproximately1.5milestothenorth. TheProjectSiteis locatedapproximately0.2 miles north of the Pico Station operated by the Los Angeles County Metropolitan TransportationAuthority (Metro) which serves the Blue Line and the Expo Line. The Project Site is also locatedapproximately0.4miles fromthe7thStreet/MetroCenterStationwhichprovides rail service to theBlue,Expo, Red, and Purple Lines. The Project Site is also served bymultiple bus and shuttle lines, includingmultipleMetrobuslinesandtheDASHDowntownShuttleRoute.

Theapproximately2.7‐acreProjectSiteisboundedbyS.FigueroaStreettothewest,S.FlowerStreettotheeast,W.OlympicBoulevardtothenorth,and11thStreettothesouth.TheProjectSiteislocatedinaregionalcenter which serves as a commercial and entertainment center for Los Angeles and the surroundingcommunities. The Project area is characterized by a mix of entertainment, commercial, restaurant, bar,office,andresidentialuses.AdjacenttotheProjectSiteandtothewestacrossS.FigueroaStreetisLALIVE,anentertainment,hotel,andresidentialcomplex;southofLALIVEandjustsouthwestoftheProjectSiteisthe Staples Center Arena, a multipurpose sports arena; further to the southwest is the Los AngelesConventionCenter,whichregularlyfeaturesconventions,tradeshows,andexhibitions.TothenorthoftheProject Site across W. Olympic Boulevard are several high‐rise mixed‐use residential and commercialbuildings. These include the 28‐story 717 Olympic mixed‐use project; a car wash building that alsoencompasses two restaurants anda ticket agency that isproposed tobedevelopedas amixed‐use tower(OlympicTower);andfurthernorthisthe13‐storyHotelFigueroa.TotheimmediateeastoftheProjectSiteis the 11‐story Petroleum Building, a designated City Cultural‐HistoricMonument (HCMNo. 596), whichincludesofficeabovegroundlevelcommercialusesfrontingW.OlympicBoulevard;asurfaceparkinglotandtheone‐storyElCholorestaurant frontingS.FlowerStreet;andmid‐andhigh‐risemulti‐familyresidentialandmixedusebuildings further east across S. Flower Street. To the southof theProject Site across11thStreet,isOceanwidePlaza,ahighrisemixed‐useresidential,commercial,andhotelprojectthatiscurrentlyunderconstruction; furthersouth isanothermixed‐useproject underconstruction,knownasCirca(1200FigProject);theMetroPicoStation;andnewandrecentlyrehabilitatedhigh‐riseresidentialandmixed‐usebuildings.

B. PROPOSED PROJECT

The Project Site is currently developed with the nine‐story Luxe City Center Hotel (Luxe Hotel) on thenorthwestportionoftheProjectSitewiththeremainderoftheProjectSitedevelopedwithsurfaceparking.The Luxe Hotel includes 178 guest rooms, a main lobby, meeting rooms, an interior restaurant, anindoor/outdoorbarandloungearea,afitnesscenter,andaone‐levelparkingdeckwithparkingbelowandabovethedeck.

TheProjectwoulddemolishtheLuxeHotel,surfaceparking,andrelatedimprovementsontheProjectSiteinorder to construct a newmixed‐use residential, hotel, and commercial development. The Project wouldincludeup to1,129,284square feet (sf)of floorarea(approximately9.7:1 floorarearatio [FAR]) in threetowersatopaneightlevelpodium(Podium)withuptofoursubterraneanlevelsandfourlevelsabovegrade.TheProjectwouldincludeatotalofupto300hotelrooms,650residentialcondominiumunits,and80,000sfofrestaurant,retail,andothercommercialusesatthefirsttwolevelsalongallstreetfrontages.Thefirstandsecond levels of the Podiumwould also include commercial uses with the third and fourth levels of thePodiumincludinghotelamenitiesand14work/liveloftunits.TheProjectisdesignedtorespectthecontextandcharacterof theadjacenthistoricPetroleumBuildingbysteppingback fromthecornerofS.FigueroaStreetandW.OlympicBoulevardtoallowviewsofthecornerofthePetroleumBuilding.ThedesignwouldalsonotobstructviewsofthePetroleumBuilding’sarchitecturallydistinguishedfacadesalongW.OlympicBoulevardandFlowerStreet,whichareprimarycharacter‐definingfacadesfeaturingelaboratearchitecturaldetailing originally intended for public view. Parking for vehicles would be providedwithin up to foursubterranean levels beneath the Podium. Bicycle parkingwould be provided on Site in compliancewithLAMCrequirements.

TheProjectwouldincludetworesidentialtowersandonehoteltower.PhaseIoftheProjectwouldincludetheconstructionofthe34‐storyHotelTower,locatedonthecornerof11thStreetandS.FigueroaStreetandthe construction of the 32‐story Residential Tower 1 thatwould include up to 290 residential units andwouldbelocatedatthecornerof11thStreetandS.FlowerStreet.DuringPhase2,the38‐storyResidentialTower2wouldbeconstructedthatwould includeupto360residentialunitsandwouldbe locatedat thecornerofS.FigueroaStreetandW.OlympicBoulevard.

The Project would provide a 5,000 sf outdoor public plaza along S. Figueroa Street that would supportconnectivity between the Project and LA LIVE while also encouraging pedestrian activity and an activestreetfront. Theoutdoorplazawould incorporate landscape features, seating, andpotential forpublicartdisplayareas. Inaddition, theProjectwould includethePodiumGardenTerrace, locatedat thetopof thePodium that would serve each of the three towers for Project residents, guests and hotel patrons. ThePodiumGardenTerracewouldfeatureabaranddiningareaneartheHotelTower,openareasforadultandchildrenrecreationalactivities,pools,strolling/exerciseareasforpets,andquiet/passiveareaswithshadedzones.Thetopleveloftheresidentialtowerswouldincluderooftopamenitydecksforusebyresidents,andthetop/penthouseleveloftheHotelTowerwouldincludearooftopamenitydeckwithapool,bar,lounge,andgreenspaceareasforhotelpatronsandvisitors.

Vehicular access into the Podiumwould be fromW.Olympic Boulevard, S. Flower Street and 11th Street.ParkingaccesstothePodiumforresidencesandcommercialvisitorswouldbefromW.OlympicBoulevard.Forresidents‐only,accesswouldbeprovidedfrom11thStreet. AvehicleentrywaytothePodiumfromS.FlowerStreetwouldbeprovidedforcommercialvisitorsandservicevehicles.Forhotelvisitors,aseparate

hotel‐only motor‐court drop off area would be provided off of 11th Street. Loading for service vehiclesrelatedtohotel,residentialandcommercialuseswouldbeonthegroundlevel, interiortotheProjectSite.PedestrianaccesstotheHotelTowerandlobbywouldbefromahotelmotor‐courton11thStreetandfromthe hotel lobby fronting S. Figueroa Street. Pedestrian access to the two stories of commercial andrestaurant frontage along the periphery of the Podium fronting 11th Street, S. Figueroa Street, S. FlowerStreet,andW.OlympicBoulevardwouldbedirectlyfromthosestreetsatthegroundlevelorviaelevators,stairsorescalators.AccesswouldalsobeprovidedfromtheparkingareaswiththePodium’ssubterraneanlevels.EachresidentialtowerwouldhaveagroundlevellobbythatwouldbeaccessiblefromstreetlevelorviaelevatorsfromtheresidentialparkingareaswithinthePodium.Pedestrianaccesstotheresidentialunitsin the Podium at the street level would be via either the Residential Tower 1 or Residential Tower 2residentiallobbies.

New lightingwould includesignage,commercialaccent lighting,wayfinding,balcony lighting,andsecuritymarkings.Projectsignagewouldincludeonandoff‐sitesignageinvariousforms,includingwallsigns,digitaldisplays and streaming signage, supergraphic signs, open panel roof signs, hotel building identification,residentialbuildingidentification,retailandrestaurantbuildingidentification,parkingentryidentification,loadingdockentry identification,andwayfindingsignage. Nobillboardsignage isproposed.Thegraphicsandsignageprogramwouldsupportanactivestreetfrontexperienceonallsides,butparticularlyalongtheFigueroa corridor that would mix art and signage graphic components. Pursuant to the provisions ofChapterI,Article3,Section13.11oftheMunicipalCode,theProjectwouldestablishasigndistrict,(Figand11th SignDistrict) thatwould encompass theProject Site. TheFig and11th SignDistrictwould establishregulationsandprovisionsregardingsignagearea, illumination levels,hoursofoperation, typeofsignage,locationofsignage,compatibilityofsignage,amongotherspecificregulations.

Discretionary entitlements, reviews, and approvals required for implementation of the Project wouldinclude,butwouldnotnecessarilybelimitedto,thefollowing:

C. PUBLIC REVIEW PROCESS

As furtherdescribed inChapter1, Introduction, theCitycirculatedaNoticeofPreparation (NOP) toState,regional,andlocalagencies,andmembersofthepublicfora31‐dayreviewperiod,commencingFebruary3,2016andendingMarch4,2016.TheNOPwasbasedonanInitialStudywhichdeterminedthattheProjecthadthepotentialtoresultinsignificantimpactstotheenvironment.TheNOPandInitialStudyareprovidedinAppendicesA‐1andA‐2ofthisDraftEIR.

Inaddition,apublicscopingmeetingwasheldonFebruary18,2016attheLUXECityCenterHotelwithintheProjectSite, locatedat1020S.FigueroaStreet,LosAngeles,CA90015. Themeetingwasheld inanopenhouseorworkshopformatandprovidedinterestedindividuals,groups,andpublicagenciestheopportunitytoviewmaterials,askquestions,andprovideoralandwrittencommentstotheCityregardingthescopeandfocus of the Draft. The presentation materials and other documentation from the Scoping Meeting areprovidedinAppendixA‐3,ScopingMeetingMaterials,ofthisDraftEIR.Nowrittencommentswerereceivedatthepublicscopingmeeting.LettersandcommentsreceivedduringtheNOPcommentperiodareincludedinAppendixA‐4,NOPComments, of thisDraftEIR. ThisDraftEIRwillbe released foraminimum45‐daypublic commentperiod. Following thepublic commentperiod, aFinalEIRwillbeprepared that includesresponsestocommentsreceivedontheDraftEIR,alongwithanynecessarycorrectionsandadditionstothedocument.

D. AREAS OF CONTROVERSY/ISSUES TO BE RESOLVED

E. SIGNIFICANT AND UNAVOIDABLE ENVIRONMENTAL IMPACTS

SignificantunavoidableimpactscouldoccurasaresultofProjectimpacts,andcumulativeimpacts.Basedontheanalysis contained inChapter4,Environmental ImpactAnalysis, theProjectwould result in significantand unavoidable Project construction impacts related to noise and vibration, cumulative constructionimpactsrelatedtonoiseandtraffic,andProjecttrafficimpactsatthreeintersections.

F. ALTERNATIVES

The State CEQA Guidelines, Section 15126.6(a) require an EIR to “describe the range of reasonablealternatives to theproject, or to the locationof theproject,whichwould feasibly attainmostof thebasicobjectivesoftheprojectbutwillavoidorsubstantiallylessenanyofthesignificanteffectsoftheproject,andevaluatethecomparativemeritsofthealternatives.”TheStateCEQAGuidelinesemphasizethattheselectionofprojectalternativesbebasedprimarilyontheabilitytoreducesignificantimpactsrelativetotheproposedproject,“evenifthesealternativeswouldimpedetosomedegreetheattainmentoftheprojectobjectives,orwouldbemorecostly.”1TheStateCEQAGuidelinesfurtherdirectthattherangeofalternativesbeguidedbya“rule of reason,” such that only those alternatives necessary to permit a reasoned choice are analyzed.2Basedonananalysisofthesealternatives,anenvironmentallysuperioralternativeisidentified.

Threealternatives,aswellasanenvironmentallysuperioralternative,areanalyzedChapter5,Alternatives,of thisDraftEIRandsummarizedbelow. Thethreealternativesselectedforevaluation includethe1)NoProject/No Build Alternative; 2) Reduced Density Alternative; and 3) Residential with Ground LevelCommercialAlternative.

1. Alternative 1: No Project/No Build Alternative

TheNoProject/NoBuildAlternativeconsistsofthecircumstanceunderwhichtheprojectdoesnotproceed,pursuant to Section 15126.6(e)(3)(B) of the State CEQA Guidelines. Under the No Project/No BuildAlternative, no new development would occur within the Project Site. This Alternative consists of thecircumstanceunderwhichtheProjectdoesnotproceed.ThepropertywouldmaintaintheLuxeHotel,whichisa112,748sf,ninestorybuilding,thatincludes178guestrooms,amainlobby,meetingspacearea,interiorrestaurant,anindoor/outdoorbarandloungearea,fitnesscenter,andaone‐levelparkingdeckwithparkingbelowandabovethedeck.TheLuxeHotelissurroundedbysurfaceparking.Thenorthlot,onthecornerofW.OlympicBoulevardandS.FigueroaStreetisusedforhotelguestparkingandspecialeventparking;thesouth lot, located south of the Luxe Hotel on S. Figueroa Street, is used for overflow parking, limousinestaging, and construction/maintenance vehicle parking; the southeastern lot, located on 11th StreetextendingfromS.FigueroaStreettoS.FlowerStreetisleasedforpublicparking.

2. Alternative 2: Reduced Density Alternative

TheReducedDensityAlternativewouldprovidethesameusesastheProject;butatareduceddensitythatwouldcomplywiththeprovisionsoftheLAMCwithoutaTFAR.ThetotalFARwouldbelimitedto6:1withafloorareaof699,960sf,whichisapproximately62percentofthefloorareaoftheProject(9.7:1FAR).

The Reduced Density Alternative would include a hotel with 186 guest rooms with meeting rooms,restaurant,andspafacilities(175,000sf, including10,000sfmeetingroomsand10,000sfamenities);403residentialunits (475,360sf);and49,600sfofcommercial/retail/restaurantspaceon the first two levels.The residential development would include similar amenities to those of the Project, although scaledcommensuratewiththereductioninresidentialunits.Thedensityofthehotel,residential,andcommercialuses would be reduced approximately 38 percent, commensurate with the 38 percent reduction in FAR,while including the 75 percent retail frontage on the ground level. Parking would be provided in asubterraneanstructuresimilartothatoftheProject,althoughrequiringlesssubterraneanparkingthanthatoftheProject.TheReducedDensityAlternativewouldincludetwotowers:a353,508sfhotelandresidentialtowerwith a commercial podium on the Phase 1 portion of the Project Site and a 346,462 sf residentialtowerwithcommercialpodiumonthePhase2portion.

3. Alternative 3: Residential with Ground Level Commercial Alternative

The Residential with Ground Level Commercial Alternative would utilize the entire site for a residentialdevelopmentwith50,000sfofgroundlevelcommercial(retail/restaurant)usewithintheprovisionofthezoningcode. ThisAlternativewould include669,960sfresultinginanFARof6.0:1. TheResidentialwithGroundLevelAlternativewould include520residentialdwellingunitsofsimilarsizeandconfiguration tothe Project. The residential developmentwould be provided in two residential towerswith 15,000 sf ofresidentialamenities.ThisAlternativewouldincludeparkinginasubterraneanstructure.

4. Environmentally Superior Alternative

Section15126.6(e)(2)of theStateCEQAGuidelines indicates thatananalysisofalternatives toaproposedprojectshallidentifyanenvironmentallysuperioralternativeamongthealternativesevaluatedinanEIRandthatifthe“noproject”alternativeistheenvironmentallysuperioralternative,theEIRshallidentifyanotherenvironmentallysuperioralternativeamongtheremainingalternatives.

A comparative summary of the environmental impacts anticipated under each Alternative to theenvironmental impacts associated with the Project is provided in Table 5‐7, Comparison of ImpactsAssociatedwiththeAlternativesandtheProject, inChapter5,Alternatives,ofthisDraftEIR. Chapter5alsoprovidesamoredetailedevaluationofthepotentialimpactsassociatedwitheachAlternative.Asindicatedin Table 5‐7, the No Project/No Build Alternative would have less impact than the Project or otheralternatives as itwouldhaveno impacts on the environment. Further, itwould avoid theProject’s shorttermsignificantandunavoidableconstructionimpactsassociatedwithnoise,vibration,andtrafficaswellastrafficoperations.Therefore,theNoProject/NoBuildAlternativeisconsideredtheoverallenvironmentallysuperiorAlternative. However,theNoProject/NoBuildAlternativewouldnotmeetanyProjectobjectivesandwouldnotprovidethebenefitsassociatedwiththeProject.Itwouldnotresultinthedevelopmentofamixedusedevelopmentprovidingconventioncenterhotelrooms,Downtownresidentialdevelopment,andtransitorienteddevelopment.



In accordance with the State CEQA Guidelines requirement to identify an environmentally superiorAlternative other than the No Project/No Build Alternative, a comparative evaluation of the remainingAlternatives indicates that the Residential with Ground Level Commercial Alternative, would be theenvironmentally superior Alternative due to the reductions in traffic when evaluated with LOS trafficcriteria. TheResidentialwithGroundLevelCommercialAlternativewouldgenerate fewer traffic impactsthantheReducedDensityAlternative,reducingtheamountoftripgenerationandeliminatingasignificantintersection impact at one location. However, both the Residential with Ground Level CommercialAlternative and theReducedDensityAlternative,while reducing impacts from thoseof theProjectwouldcontinue to result in significant traffic impactsdue to operations and continue to have a significant noiseimpactduetoconstructionaswellasasignificantcumulativeimpactontraffic.

TheResidentialwithGroundLevelCommercialAlternativewouldalsoresultinlessimpactforsomeotherenvironmental topics than the Reduced Density Alternative. The Ground Level Commercial Alternativewouldresultinfewerimpactsthataretrafficrelatedincludingairemissionandnoiseimpactsduetotraffic.ThisAlternativewouldalsoresultislessimpactonwaterandwastewaterutilityservices.Relatedtothesetopics,theGroundLevelCommercialAlternative3wouldalsoresultinalowerlevelofenergyconsumption.

TheResidentialwithGroundLevelCommercialAlternativewouldonlypartiallymeettheProjectObjectives.Itwouldmeet theProject’sObjective’s regarding theoveralldesignof theProject. However, itwouldnotmeet Project Objectives regarding the contribution of hotel rooms to serve the Los Angeles ConventionCenter,orthecomplementarymixofusesanticipatedwiththeProject.ItwouldmeettheProjectObjectivesregardingtheprovisionofhousingunitsandtheProject’seconomicobjectives,butnottothesameextentasthe Project. Further, it would not so fully fulfill the Project Objectives regarding the implementation oftransitorienteddevelopment.

G. SUMMARY OF ENVIRONMENTAL IMPACTS

This section provides a summary of impacts, Project Design Features, mitigation measures, and level ofsignificanceafterimplementationofmitigationmeasuresassociatedwithProject.ThesummaryisprovidedbyenvironmentalissueareabelowinTableES‐1,SummaryofProjectImpacts,ProjectDesignFeatures,andMitigationMeasures.

ImpactStatementAES‐2:TheProjectwouldreplacetheexistingLuxeHotelandparkinglotswithamoderndevelopmentthatincludesthreetowers,aPodium,publicplaza,andstreetscapeimprovements.TheProjectarchitectureanddesignwouldrespondtoandbecompatiblewithsurroundingdevelopment,includingtheadjacentPetroleumBuilding.ComparedtoexistingconditionswiththeLUXEHotelbuilding,surfaceparkinglots,andlimitedlandscaping,theProjectwouldimprovevisualconditions,particularlyduetosignificantupgradestothestreetscapeandpedestrianenvironment.Therefore,theProjectwouldhavealessthansignificant

Impact Statement TRAF‐6: Pursuantto SB 743 (CEQA Statute Section21099(d)(1)), parking impacts of amixed‐useresidentialproject inaninfilltransit priority area are not consideredsignificant.
