Work Health Safety Laws
The Work Health Safety (WHS) laws require that employers provide a safe working environment. Each employer has a duty of care to ensure that you, the employee, is safe from injury or illness while at work.
Young people are more likely to be injured at work as they are often unfamiliar with workplace hazards and safety procedures. Young workers have one of the highest proportions of work related injury in the State and it is important that both you and your employer understand each others responsibilities to help keep you safe at work.
Injury Risks
The types of risks to which people are exposed in the workplace vary considerably according to the type of job they do and the industry in which they work.
The risks associated with different work environments are reflected in the rates and types of injuries across occupation and industry groups.
Safety requirements include:
a safe work environment
information, instruction and training
supervision
equipment, plant and substances in a safe condition.
Who is responsible?
Under the Occupational Health, Safety and Welfare Act 1986 (the OHSW Act) both employers and employees have responsibility for health and safety in the workplace.

However, the employer has the ultimate responsibility and a duty of care to ensure the health and safety of employees and anyone else who might be affected by work carried out for their employer.
As an employee you are responsible for the things you have control over. This means that you must do everything reasonably practicable to protect your own health and safety and that of others.
All employers must ensure that:
the workplace is safe and there are safe systems of work
machinery, equipment, tools, appliances and substances are kept in a safe condition
ongoing information, supervision and training is provided about workplace tasks
they monitor working conditions and the health, safety and welfare of employees
All employers must also ensure that:
Facilities such as toilets and meal rooms are provided
The hours are reasonable and that there are adequate break times. Must provided first aid equipment and supplies are provided
Records are kept of work related injuries
Health and safety information is provided to all employees
Employees receive proper instructions, information and training before commencing any new work.
Employer Rights
Employers have the right to
expect each employee to follow ALL instructions provided, to wear safety gear and/or uniform as required, to be punctual and to be respectful
expect loyalty from employees
expect compliance with all WHS regulations and procedures and expect reasonable care to be taken by all employees
dismiss workers according to the Commonwealth Workplace Relations Act (1996) or terminate a placement
expect employees to be accountable for money or resources in their care
Employee Responsibilities
As an employee you must:
follow all reasonable instructions
not put other employees or members of the public at risk
use any protective equipment that is provided
ensure you are not affected by alcohol or another drugs
If you are unsure about anything don’t be afraid to ask someone in authority in your workplace, such as your manager or supervisor.
Your Responsibilities
As a MOC student in the community, you must
represent yourself and our school in a positive light at all times
wear safety gear and/or uniform as required
be punctual (notify employer and school of absence)
have good manners
engage with the course WE placement and keep up to date with school assignments
communicate any concerns to the appropriate person
Your rights
You have the right to be and to feel safe
You have the right to adequate training before being required to do a task
You have the right to adequate break times and reasonable working hours
Any situation arising, including harassment (verbal, physical, sexual) NEEDS to be reported to the school as soon as possible.
What do I do if something is seriously wrong, you don’t feel safe
Speak with the trainer or manager about it…. Then you also need to ….

What do you do if you are sick and cannot attend work experience for the
day?
YOU NEED TO DO ALL 3 OF THESE THINGS:
1. Contact your work experience placement contact person - organisation/employer and let them know WHY you will not be there.
2. Contact the school on 8209 1600 and leave a message
3. Email Ms Brett ([email protected]) and your Home Group Teacher
