As a comparison, only around 1% annually of the newly established companies in reality in Bulgaria registers a CTM. Same ratio is valid for 8 more MS in EU. This same share for the leading MS in CTM registration is 10%.

6. For only the period 2011-2014 56% of all Bulgarian CTMs since 1998 have been registered, which means rapidly development of CTM awareness in recent years.

7. Bulgaria climbed from the bottom in 2010 to number 20 in 2013 among EU member states in number of CTMs registered.

The Ministry of Economy and Energy is a government body responsible for the policy in areas such as business environment, SMEs and entrepreneurship, investments, innovations, foreign trade, energy and tourism. One of the aspects – in particular SME Policy - is very important: according to the SME Law of Bulgaria the Minister of Economy and Energy develops the National SME Strategy and the Annual Program for its implementation. Currently the Strategy (2014-2020) is fully adapted to the Small Business Act for Europe and follows its priorities.

THE CHALLENGESTHE CHALLENGESMAIN CHALLENGE

It all started in 2010 when we visited one edition of the national annual festival of the training firms TF FEST in Plovdiv, Bulgaria. Training firms in Bulgaria, which participate in the TF FEST, are part of the system of the Ministry of Education and Science (MES). There’s about 280-350 training firms annually for the last 17 years. They’re guided by the Bulgarian Centre for Training Firms, subordinate to MES, member of EuroPEN International Practice Enterprises Network, Essen, Germany. Pupils in the training firms in Bulgaria are between 16-18 years old – grown up enough to make difference from right and wrong in business practices.What we saw at the festival wasn’t quite right: there were many training firms using brands or elements of brands of worldwide-known enterprises – without any permission – something impossible or even more – prosecuted by the law - out there in the real world.It was clear:

The children from the training firms haven’t received education in intellectual property protection

The children didn’t know the meaning and value of the intellectual property and in particular – the trade mark

They weren’t aware how to build a brand and protect it with a trade mark

SECONDARY CHALLENGE

In the meantime the Community Trade Mark (CTM) – the trade mark protection system allowing one trade mark registration to be valid for the entire Single Market - was not at all popular among the Bulgarian entrepreneurs. Till 2010, counted back from 1998, when the first Bulgarian CTM was registered, there were only 824 Bulgarian CTMs -a fact that was placing Bulgaria at the bottom of the EU Member States by number of registered CTMs per year. Actually there’s a similar situation all around Europe: the ratio between registered CTMs annually and number of new enterprises around EU in 2010 was above 1:10 for MS like Germany, Austria and Belgium and close to 1:100 for 9 MS including Bulgaria. At the same time the ratio between nationally registered trademarks and newly established companies is 1:6 for Bulgaria. Tremendous gap between the two systems and quite a challenge!

THE APPROACHTHE APPROACHThen we decided: why not educating the children from the training firms not only to build their own original brand but also training them to register it as a CTM – with the goal and hope these children, when soon graduating and starting their own business, to know how to create a brand, place it properly and protect it on the entire Single Market with one registration at OHIM – the Office for Harmonization in the Internal Market in Alicante, Spain.

That’s how Brandiko was born in 2011 – a training firms nationwide project for building a brand and protecting it with a CTM.

PHASE 1: Training & Application

The application form for taking part in Brandiko is a simplified real application form for a CTM registration (available for our purposes in Bulgarian, English, German and Romanian languages). So the children while preparing to fill it in, are learning what does it mean a

“figurative mark”, “word mark”, “three-dimensional mark”, “sound mark”, they are learning how to describe the mark or indicate the colours, how to create the list of goods and services by class numbers for which they register the mark and how to create the name, the logo, or even the sound, which is for them the most creative and amusing part of the preparation. The kids also train in making their own catalogues of their goods and services, own adverts, business cards, packaging and other stuff where their brand can be well positioned. Along the process they’re told what a CTM means and why it’s so important to protect the brand by registering it as a trade mark, and especially as a CTM.We included in the process the Bulgarian Centre for Training Firms at MES. They established a virtual Patent Office where the training firms are sending their application forms.PHASE 2: Evaluation

The application forms for CTM registration are reviewed by a jury with members from us – the Ministry of Economy and Energy (MEE) and including also representatives from the Bulgarian Patent Office, the Union of the Inventors of Bulgaria and APRA Porter Novelli – partners with experience in both directions of intellectual property: building it and protecting it. After that the jury members have to evaluate the marketing aspect of the brand. They are doing that at the TF FEST taking place annually in April at the premises of the Plovdiv International Fair. The jury’s having the chance to communicate directly with the children and see the brand placement on the products and services of the training firms directly at their stands at the fair.The training company which performs in the best way is announced by the Minister of Economy and Energy as Brandiko holder with 2 runner=ups. In 2013 and 2014 foreign training companies took part in the competition and they received a special prize for international participants – that’s how Brandiko became an international competition.For four years Brandiko significantly increased the awareness among pupils from 10th to 12th grade on the importance of the trade mark protection of an original name and logo – something that back in 2010 seemed to be a major challenge and a gap in the education of future entrepreneurs.CURRENT STATUS AND FUTURE

In 2014 Junior Achievement Bulgaria became a partner of MEE in a project for the high schools of arts – their debut in the field of entrepreneurial education. That’s how ten more training companies from the creative industries – very important sector for Bulgaria – made their debut in Brandiko. Their training included a special mentorship in CTM protection – an aspect of their work we considered to be extremely important because of the specific activities of the creative sector. In 2015 Brandiko continues with all high schools, schools of arts and also we are involving for the first time the schools of sports and we’re expanding our international influence by attracting more foreign training companies to protect a brand with CTM.

Brandiko 2011: 26 training companies from 14 cities.

Winner: Chetiri Sezona (Four Seasons) from Plovdiv

Brandiko 2012: 35 training companies from 12 cities.

Winner: Green Rest from Shabla

Brandiko 2013: 40 training companies from 10 cities.

Winner: Royal Invest Bank from SofiaRoyal Invest Bank was the first company to register CTM for a separate product with the name Royal Future

Brandiko 2014: 39 training companies from 9 cities.

Winner: Junior Design from Sofia Junior Design comes from the debuting schools of arts in 2014

During the 4 years 140 training companies and 1,700 pupils took part in Brandiko. They were coming from 25 cities, including 2 foreign cities: Pitesti, Romania and Chisinau, Moldova.

Pupils trained (including those who did not take part in Brandiko) in building a brand and protecting it on the Single Market with a Community Trade Mark: 2,100.

2. Very low number of “stolen” intellectual property

Of all 140 brands competing so far in Brandiko, there were only 15 cases of partially “stolen” elements in logos which is a very significant decrease in intellectual property infringement compared to the brand presence at the training companies fair before the introduction of Brandiko, where every 3rd brand was “borrowed” from somewhere else.

3. Training in CTM outperforms reality, securing CTM growth in the future

On average about 12-13% annually (share is gradually growing during the years) of all training firms and students in training firms in the country are taking part in Brandiko and are trained in intellectual property protection, brand management and skills in Community Trade Mark registration. Every year the training companies start from scratch so all of them can be considered as newly established.

In reality only 1 in 100 new companies (valid for Bulgaria and 8 more MS in EU) registers a brand as a CTM. On training level the ratio 1:100 changes to 1:7.7 – the latter ratio is better than the one in best performing MS where it is 1:10 in reality.

This means in near future the knowledge of acting entrepreneurs will be large enough for a significant increase in number of registered CTMs from Bulgaria which helps for wide open doors for trade on the Single Market.

CHALLENGE 2: OUTCOME

4. CTMs registration significantly increases since 2010:

In the real world first registered Bulgarian CTM dates back from 1998, like in the rest of the MS. From 1998 to 2010 Bulgarian CTMs registered are 824. And from 2011 – the start of Brandiko - till this very April of 2014, they are 1049. So 56% of all Bulgarian CTMs have been registered only for the last 3 years and 4 months, of all the 17 years of the CTM system’s existence. Bulgaria climbed from the bottom of EU member states in 2010 to number 20 in 2013 in number of registered CTMs per year. We cannot plead that Brandiko has contributed significantly to this fact but for sure the talk and noise around Brandiko has something to do with it and Brandiko will contribute this trend to continue.

5. Double growth rate of CTMs registered by short term future entrepreneurs

In reality only 1 in 10 people (age 18-65) starts a company in Bulgaria. If same ratio is valid, then from all these 1,700 students who took part in Brandiko, about 170 will become entrepreneurs. All of them are expected to register at least one brand each as a Community Trade Mark. 170 CTMs for 4 years is equal to 13.5% of the Bulgarian CTMs registered at OHIM for the last 4 years (2010-2013). This could be measured, ceteris paribus, as about 12% growth of CTMs registered from Bulgaria, or double growth, compared to the current growth of 6% in reality (2013 compared to 2010)

6. Better export readiness and preparation for the challenges of the Single Market

According to SME Performance Review of the European Commission the average share of SMEs exporting on the Single Market in EU is 8.40% in 2012. As it was shown above, many MS obviously trade on the Single Market without the protection of a CTM. Perhaps they use other systems of trade mark protection or are not at all protected. The 13% share of training companies with CTMs outperforms the average share in EU and Bulgaria in both directions: share of SMEs exporting to the Single Market and share of registered CTMs as % of newly registered companies.

Pupils establish training companies and are mentored how to build their own brand – create a logo for example, pick up the right colours, the most catchy words, etc., place the brand properly on their products and services, packaging, business cards and other advertising materials from marketing point of view and learn to use the brand to increase sales.

2. Increasing the awareness in intellectual property protection and in particular – trade mark protection, especially protecting the brand as a Community Trade Mark.

Pupils learn the importance and value of the intellectual property, they are trained why it’s so crucial to protect it and how to do it and then they are guided how to register their brand as a Community Trade Mark – a system still not very popular among entrepreneurs in reality but vital for better placement on the Single Market.

Results:

140 training companies with 1,700 (2,100 trained) from 25 cities and 3 countries took part in Brandiko for the period 2011-2014. The intellectual property infringement by copying elements of registered trademarks has decreased 3 times among training companies since Brandiko’s introduction. CTM registration rate in training companies of 13% is higher than the 10% rate of the leading MS of EU in the real world.

For only the period 2011-2014 56% of all Bulgarian CTMs since 1998 have been registered, which means rapidly development of CTM awareness in recent years.

Правила за участиеПравила за участие

С участие в националната селекция, Вие се съгласявате, че в случай на номиниране на Вашата кандидатура, ще приемете да представлявате своята държава в Европейските награди за насърчаване на предприемачеството.

Конкурсът е отворен за публичните органи в ЕС, асоциирани страни в Рамковата програма за конкурентоспособност и иновации (CIP), Исландия, Норвегия, Сърбия и Турция.

Допустимите структури включват национални организации, големи и малки области и общини, както и публично-частни партньорства между публичните органи от една страна и предприемачите, образователни програми и бизнес организации, университети, фондации и т.н. от друга страна.

Трансгранични инициативи ще бъдат приемани, ако са номинирани съвместно от всички участващи страни.

Крайният срок за участниците в националната селекция е 14 април 2014 година.

Трябва да бъде спазена максималната дължина на заявлението, посочена във формуляра за кандидатстване.

Няма да се допускат твърди копия на материали – и при това само до пет линка ще бъдат приемани в рамките на електронния формуляр за участие.

Заявките за участие на европейско ниво могат да бъдат изпращани на всеки един от официалните езици на ЕС.

Кандидатурите ще бъдат оценявани по следните критерии:

1. Оригиналност и приложимост : защо проектът е успешен? Какви са новаторските му аспекти?

2. Въздействие върху местната икономика : предоставяне на статистика в подкрепа на твърденията за успех

3. Подобряване на отношенията с регионалните партньори : била ли е облагодетелствана повече от една заинтересована страна от прилагането на тази инициатива? Защо е била включена и какво е било равнището й на участие?

4. Приложимост : може ли този подход да бъде повторно приложен в региона, както и другаде в Европа?
