Dear Mr. Halioua:
1 July 2010
I have taken the opportunity to review the April 20th letter provided by Bill Knetge of TerraMar Architectural, Inc. requesting addition "Verification of Building Rights" pursuant to Chapter 102, Article 23 of the City of Marathon Land Development Regulations.
I have broken my review into those areas that, 1) we have previously addressed and 2) those that are new to this review.
1. Items of previous agreement in Mr. Knetge's analysisa. We agree that the Halioua property has residential entitlements to 4 existing units, two (2)
apartments each above Lee Ann's Coffee Shop and two (2) apartments above TLC Nursery.(See Knetge Items A & B)
b. We agree that the Halioua property contains two commercial structures Lee Ann's Coffee House(approximately 2,080 square feet under roof line) and TLC Nursery (approximately 1,320 squarefeet) totally approximately 3,400 square feet in commercial floor area. (Knetge items Pl, P2, &Al)
c. We agree that the Nursery property contains an existing shade structure whose area amounts toapproximately 1,216 square feet in commercial floor area. (See K.netge Item 10 under AccessoryStructures)
d. We agree that the Nursery property is entitled to approximately 2,998 square feet in commercialfloor area resulting from the demolition of two structures within the nursery grounds (PermitsP2004-1319 and P2004-1511 ). +
These items are reflected in the City's review of your project site dated March 15, 2010 (attached). Mr. Knetge has added additional commercial floor area components which reflect a non-traditional view of the definition of floor area. However, as quoted immediately below, the City of Marathon has taken a very broad view of what commercial floor area constitutes. Chapter 110, Article 3, Land Development Regulations provides the following:
"Commercial Floor Area" as quoted immediately below (Chapter 110, Article 3, Land Development Regulati ns):

"Commercial Floor Area: Means the two-dimensional measurement of all climate-controlled areas, including common, private areas; and nonclimate-controlled covered and uncovered areas for commercial uses, unless otherwise excluded.
Floor area excludes the following:
A. Where the floor areas are uncovered and do not generate activities that will intensify thedevelopment except for open areas that are used for commercial purposes such as eating areas, gas stationislands, or drive-ins.B. Where the floor areas are required by the LDR, i.e., covered pedestrian walkway or civic areas.C. Where the floor areas have a limited height clearance (six (6) feet or less).D. Covered or uncovered area used for vehicular circulation and car parking. This includes the areafor car park ticketing machine placed at the gantry of car park.E. Covered main entrance canopy or main entrance.F. Loading docks.G. Elevators or their shafts.H. Stairways or their landings.I. Areas reserved for mechanical and electrical building-related machinery."
It is the City's determination that the "Nursery storage areas" that Mr. Knetge describes in his letter on your behalf (dated April 20, 2010) do fit the City's definition of Commercial Floor Area. Specifically, the nursery storage areas are "nonclimate controlled .... uncovered areas" that "are used for commercial purposes" as described in the definition. These areas were routinely utilized for nursery sales.
Thus, in addition to the residential units and commercial areas described in items l a. through d., the property is deemed to contain an additional approximately l 7,014 square feet of commercial floor area because of the existing nursery storage area described in Mr. Knetge's letter.

The total area of the property is approximately 70,231 square feet or 1.61 acres. The effective current use of the property is 28,626 square feet in consideration of the City's Code, Tables 103.15.2 and 103.15.3 and the existence of the restaurant, nursery space, and two apartments. Thus, 41,607 square feet of the property remain unutilized and available for development (70,231 sq ft - 28,626 sq ft = 41,607). If you eliminate the Nursery use (1,320 sq ft) then the effective area remaining available for residential development would be 42,927 square feet. Within the MU zoning district, 6 market rate residential units per acre are allowed. With the remaining un-developed area you would be allowed to develop up to 6 (six) additional residential units or (42,927 sq ft/ 43,560 sq ft/acre X 6 Market Rate units/ acre = 5.91). The City would allow up to six (6) residential units on the property. You should however be aware that the development of over five (5) residential units requires review by the Planning Commission completed through a Site Plan Review process.

It is the City's det rmination that the "Nursery storage areas" that Mr. Knetge describes in bis letter on your behalf (dated April 20, 2010 do fit the City s definition of Commercial Floor Area. Specifically, the nur ery storage areas are "nonclimate controlled . ... uncovered areas" that "are used for commercial purposes" as described in the definition. These areas were routinely utilized for nursery sales.
Thus, in addition to the residential units and commercial areas described in items I a. through d., the property is deemed to contain an additional approximately 17,014 square feet of commercial floor area because of the existing nursery storage area de cribed in Mr. Knetge' s letter.

Mixed Use (MU) Zoning District: The MU zoning district is designed to accommodate a wide variety of commercial and retail activities that will result in the most efficient and attractive use of the City's historic business district and the US 1 corridor, in an effort to recognize the role of US1 as the City of Marathon’s “Main Street”.
