). Who can raise an Industrial Dispute?

"ny person who is a workman employed in an industry can raise an industrial dispute. " workman

includes any person 5including an apprentice6 employed in an industry to do manual, unskilled,skilled, technical, operational, clerical or super+isory work for hire or reward. It e7cludes those

employed in the "rmy, 8a+y, "ir 9orce and in the police ser+ice, in managerial or administrati+e

capacity. Industry means any business, trade, undertaking, manufacture or calling of employers and

includes any calling, ser+ice, employment, handicraft, or industrial occupation or a+ocation of

workmen.

*. ow to raise an Industrial Dispute?

" workman can raise a dispute directly before a %onciliation :fficer in the case of discharge,

dismissal, retrenchment or any form of termination of ser+ice. In all other cases listed at 2 abo+e, thedispute has to be raised by a ;nion < =anagement.

. Who are %onciliation :fficers and what do they do?

he :rgani3ation of the %hief $abour %ommissioner 5%entral6 acts as the primary conciliatory

agency in the %entral >o+ernment for industrial disputes. here are the &egional $abour

%ommissioners 5%entral6 and "ssistant $abour %ommissioners 5%entral6 who on behalf of the %hief$abour %ommissioner 5%entral6 act as %onciliatory :fficers in different parts of the country.

he %onciliation :fficer makes efforts to resol+e the dispute through settlement between theworkmen and the management. he duties of %onciliation :fficers ha+e been laid down under

!ection 12 of the Industrial Disputes "ct.

. What happens if conciliation fails?

In case of failure of conciliation 59:%6 a report is sent to >o+ernment 5I& Desks in =inistry of$abour6. he =inistry of $abour after considering the 9:% &eport e7ercises the powers a+ailable to

it under !ection 14 of the Industrial Disputes "ct and either refers the dispute for ad#udication or

refuses to do so. Details of functions of I& Desks and reasons for declining may be seen abo+e.here are at present 10 %entral >o+ernment Industrial ribunals-cum-$abour %ourts in different

 parts of the country to whom industrial disputes could be referred for ad#udication. hese %>Is

-cum-$abour %ourts are at 8ew Delhi, =umbai 52 %>Is6, /angalore, olkata, "sansol, Dhanbad52 %>Is6, @abalpur, %handigarh, anpur, @aipur, $ucknow, 8agpur, yderabad, %hennai and

/hubaneshwar. :ut of these %>Is, 2 %>Is namely =umbai-I and olkata ha+e been declared as

 8ational Industrial ribunals.

0. What happens when the dispute is referred to $abour %ourt?

"fter the matter is referred to any of the %>I-cum-$abour %ourt, the ad#udication process begins.

"t the end of the proceedings an "ward is gi+en by the Aresiding :fficer.

he =inistry of $abour under !ection 10 of the I.D. "ct publishes the "ward in the :fficial >a3ettewithin a period of )4 days from the date of receipt of the "ward.

12. What compensation will a workman get when laid off?

Whene+er a workman 5other than a badli workman or a casual workman6 whose name is borne on

the muster rolls of an industrial establishment employing 4 or more workmen on an a+erage

working day and who has completed not less than one year of continuous ser+ice under an employer

laid off, whether continuously or intermittently, he is to be paid by the employer for all days during

which he is so laid off, e7cept for such weekly holidays as may inter+ene, compensation which shall

 be eCual to fifty per cent of the total of the basic wages and dearness allowance that would ha+e been

 payable to him had he not been so laid-off.

1). What are the conditions precedent to retrenchment of workmen?

 8o workmen employed in any industry who has been in continuous ser+ice for not less than one year

under an employer can be retrenched by that employer until'5a6 he workman has to be gi+en one months notice in writing indicating the reasons for

retrenchment or the workman has to be paid in lieu of such notice, wages for the period of the notice

5b6 he workman has to be paid, at the time of retrenchment, compensation which is eCui+alent to

fifteen days a+erage pay 5for e+ery completed year of continuous ser+ice6 or any part thereof ine7cess of si7 months( and

5c6 8otice in the prescribed manner is to be ser+ed on the appropriate >o+ernment 5or such authority

as may be specified by the appropriate >o+ernment by notification in the :fficial >a3ette6.

1*. What compensation will the workman get when an undertaking closes down?

Where an undertaking is closed down for any reason whatsoe+er, e+ery workman who has been in

continuous ser+ice for not less than one year in that undertaking immediately before such closure isentitled to notice and compensation in accordance with the pro+isions as if the workman had been

retrenched.

Aro+ided that where the undertaking is closed down on account of una+oidable circumstances

 beyond the control of the employer, the compensation to be paid to the workman is not to e7ceed hisa+erage pay for three months

What is an Industrial Dispute? 

For a dispute to become an industrial dispute, the following parameters have to be met:

1. The dispute must be between:

a. Employers and employers.b. Employers and labor.

c. Labor and labor.

2. t should be in relation to employment, non!employment, terms of employment, with the conditions of labor"e#cept managers and supervisors$, or must pertain to any industrial matter.

Classifications of Disputes:

1. Conflict of Interest:

These conflicts arise due to disagreements in level of income, fringe benefits, ob security, and-or other terms

and conditions of employment. ispute can be resolved on conciliation by compromising.

2. Grievance or Rights Disputes:

/lso &nown as conflict of rights disputes, they occur due to general disagreements li&e: discipline, dismissal,

payment of wages, overtime, time off entitlements, demotion, transfer, etc. ispute can be resolved in laborcourts and tribunals.

3. Disputes involving unfair labor practices:
