Proposed modification to 115 CSR 7:

6.2. Subject to the provisions of section 6.3 of this rule, the amount payable by the fundto a qualified claimant is the amount of uncollectible economic damages. Indetermining the amount of uncollectible economic damages, payments of availableinsurance in the underlying professional medical liability action are considered tohave been applied first to satisfy any economic damages award.

6.3. The maximum amount payable out of the fund in respect to any one occurrence,inclusive of attorney fees, shall be the lesser of one million dollars or the maximumamount of money that could have been collected for all applicable insurance priorto the creation of the Fund. For purposes of this rule, amounts payablb by anyinsurance guarang funds due to the insolvency of an insurance company aredeemed applicable insurance.

The minutes of the January II, 2005, meeting were approved.

Patrick Campbell, with the West Virginia Department ofEnvironmental- Protection, gave a presentation and distributedhandouts on the cause and status of state fish consumption warningbecause of excess mercury in fish. Mr. campberr responded toquestions from the Committee.

Edward M. Snyder, Ph. D., Envi-ronmental Quality Board Chair,discussed and distribut.ed handouts on the Board proposal regardingthe mercury water quality standard and new manganese standard. Mr.Snyder answered questions from the Committee.

Fish Consumption Advisories Available for 2OO5

The West Virginia Department of Health and Human Resources (DHHR) has updated the West Virginia sport fishconsumption advisory for 2005. West Virginia DHHR, through an interagency agreement, partners with the WestVirginia Department of Environmental Protection and the Division of Natural Resources to develop consumptionadvisories for fish caught in West Virginia. Fish consumption advisories are updated annually and help WestVirginia anglers make educated choices about eating the fish they catch.

While most West Virginia sport fish are of high quality, low levels of chemicals like polychlorinated biphenyls (PCBs),

mercury and dioxin have been found in some fish from certain waters. To ensure the continued good health of WestVirginians, the West Virginia DHHR offers an advisory for how often these fish can be safely eaten' An advisory isadvice, and should not be viewed as law or regulation. It is intended to help anglers and their families makeeducated choices about: where to fish, what types of fish to eat, how to limit the amount and frequency of fisheaten, and how to prepare and cook fish to reduce contaminants.

This advisory covers only sport fish caught in West Virginia waters. Safety regulations and aclvisories for fish in themarket place are the responsibility of the Federal Food and Drug Administration (FDA). For more information you

The following updated advisory recommendation is the result of a recently completed study of spoft fish samplesfrom 56 collection sites across West Virginia and historical data, Data collected from lakes and rivers in WestVirginia show that a general statewide aclvisory of sport-caught fish is appropriate. A review of this informationindicates that mercury, PCBS and dioxin are the most prevalent pollutants of concern. Body weight and meal size are important factors in Fish advisories. Use this chart to find the size of meal thatcorresponds to your body weight. This advisory is designed to keep the amount of chemicals you eat at a safe level.

Find the meal advice for the fish you've caught. "Do Not Eat" means you should not eat those fish because of highercontamination. The other groups ("One Meal a Week", "Two meals a Month", "One Meal a Month", and "Six Meals a

Year") are advice for how often to eat fish.

Women of childbearing age, chilctren and people who regularly eat fish are particularly susceptible to contaminantsthat build up over time. If you fall into one of these categories, you should be especially careful to follow the mealsizes and space fish meals out according to the advisory tables.

Your body can get rid of some contaminants overtime. Spacing the meals out helps prevent the contaminants frombuilding up to harmful levels in the body. For example, if the Fish you eat is in the "One Meal a Month Group", wait a

month before eating another meal of fish from any restricted category. Occasionally eating fish in quantities slightlygreater than the advisories recommend, such as during an annual fishing vacation, should not present a healthhazard.

Follow the advice presented in this advisory, noting the differences between the General Advisories for all WestVirginia waters and the more restrictive Specific Advisories.

The following outline follows the process that led to the proposed changes for mercurystandards sent to the Legislature by the Environrnental Quality Board during the lastTriennial Review. Environmental Quality Board meetings along with EQB action takenare indicated along with public comments.

Novenber 412002 Board MeetingIssues regarding mercury during Triennial Review discussion.Section 8.18. Mercury. The DEP has suggested that the Board clariff the application ofbody burden value for mercury. Ms. Charles informed the Board that she had researchedthe issue and would recommend that the Board change the language in that section toprovide "The total organissl body burden of appropriate aquatic species shall notexceed..." and adopt footnote O from USEPA's National Recommended Water QualityCriteria 2002 which provides " the fish tiszue residue for methylmercury is based on atotal fish consumption rate of 0.0175 kglday."The Board directed staffto incorporate this proposed change into the criteriacomparison table they are creating for the Board's review.

April 16,2003 Board MeetingThe Board members expressed concern regarding removal of the methylmercury valuefrom the Human Health - Category A (Water Supply Public) and determined that it wouldrequire additional information and input from the USEPA and the WYDEP prior tomaking a final determination on the values for this criteria.

April L7, z}O3Board MeetingSection 8.18. Mercury.The Board retained section 8.18 in Appendix E which contains the human health totalbody burden value for mercury of 0.5. Also in section 8.18.1 the Board retained the in-strdam total mercury value of 0.15 for human health Category 6C" and a humanhealth Category o'At' mercury value of 0.14, but deleted the acute aquatic life valueof 2.4 from that section, the motion canied sianimsusly 5 to 0.

The Board adopted dissolved mercury values for Aquatic Life of Acute 1.4 ugll andAquatic Life Chronic of 0.77 ugllwith the appropriate conversion factor, but deletedthe methylmercury parameter in section 8.8.2 from Appendix E of the rule.

Board Response. [n our review of this parameter, the Board considered of USEPA'srecently developed body burden value for mercury. We were concerned, however,because the agency's implementation guidance for the new body burden value has notbeen completed. Moving to a body burden value, without in sheam values, norimplementation guidance would provide little assistance to the WVDEP ia imFlementingthe new criteria- We determined that retaining our current human health values untilUSEPA's implementation guidance is finalized is the appropriate route to take forthisparameter. I have placed the Legislative Rule focused on Mercury from August l, 2003 (the finalrule that went to the Legislature from the EQB) and the Legislative Rule focused onMercury from May 7 ,2004 (the final rule passed by the Legislature) together on theprevious page for comparison.

The standards in the Legislative Rule have not been revised, and remain those in placeprior to the triennial revision proposed to the Legislature. I hope this provides someinsight on the EQB's position as it relates to the ongoing debate on this maffer. As a background to the issue of manganese, and as you are aware, the Environmental

Quality Board conducted a review of the Water Quahty Standards rule and submittedamendments to it that were considered by the Legislature in the 2004 session. On July 23,

2002,the Board solicited public comments regarding issues that the Board should address

during its upcoming triennial review. The EQB did not receive comments on themanganese 5-mile rule language, and did not therefore propose revisions to it. t\rring the

legislative session, the manganese 5-mile rule revision was advanced by the regulatedcommunity and adopted as an amendment to the rule in House Bill 4193. After passage

of the bill, the Coal Association contacted our staff, and followed up with a lettersuggesting that the EQB provide appropriate justification of the manganese revision-

The EQB reviewed that letter at its May 2004 meetrng and agreed to write the House and

Senate Judiciary Committee chairmen to request any supporting documentation that itconsidered when revising the rule. (The letter was carbon copied to the Legislative RuleMaking and Review Committss). The EQB atso agreed at the May meeting that if noinformation was forthcoming from the committees, thatthe rule would be forwarded tothe EPA with an explanation of the situation and of the EQB's ef[ort to get supportingdocumentation.

The EQB received responses from Senator Kessler, and from Senator Ross and Delegate\dahan, indicating that no supporting data was available. ln early June those letters wereforwarded to USEPA along with the rule package, in accordance with the Clean WaterAct requirements for submission of WQS revisions to the agency for review and

approval.

OnJune 8th the EQB received documents from the Coal Association which included a

rationale in support of the revised manganese S-mile rule language. The EQB addressed

the Coal Associations submission at its June l lth meeting and agreed to forward thatinforrration, without recommendation, to the USEPA. Furttrer, we agreed to provide an

opportunity for the public to submit infonnation in response to the manganese revision byJuly Zod, which mJeqn would also forward to the USEPA. A number of additionalcomments were received and forwarded to the agency on July 6th" also withoutrecommendation from the EQB. All these comments were forwarded to the Committeein a letter dated July l5th, 2004.

There was a statement made before this committee in June of 2004 by Chris Hamilton ofthe West Virginia Coal Association that the EQB was unwilling to cooperate inaddressing the revision to the "manganese 5-mile rule", that the EQB had not been

willing to forward information from the coal association to the USEPA, and further thatthe EQB had "lost the information or sornething". No document was lost or retainedinappropriately by theEQB during the process. Further, the EQB has historically been

receptive to comments by the Coal Association and prioritized mining issues includingremining permits.

The Coal Association has also expressed concern that they have sent a great deal ofinfonnation to the EQB over the years regarding impacts of manganese pollution, and has

criticized the EQB for not forwarding the historic information in support on themanganese 5-mile rule. I agree that we have received manganese information over theyeaxs, but all that information addressed the toxicity of manganese to aquatic life. TheEQB removed aquatic life limits for manganese a number of years ago.

The manganese 5-mile rule being discussed today addresses the human health protectionvalue. It is my opinion that sending the "historic data" addressing aquatic life matters forwhich the standards have been removed from the rule would have been irrelevant inevaluating the change of the human health criterion.

To put it simply, the data needed to support the human health criteria is different from thedata needed to make the prior change in the aquatic life criteria The EQB does not havestudies or scienffic information to address the human health criterion change.

By letter received on December27,2004,EPA informed the EQB that it is defeningaction on the "Manganese Five Mile Rule" change while it evaluates and collectsadditional information sufficient to finalize a decision. As EPA moves to collect theinformation and to evaluate it, we are willing to assist EPA in its efforl
