This matter comes before the Court on the Motion to Withdraw Guilty Plea
Piirsuant to Criminal Rule 32.1, whicli was filed herein May 30, 2014 and
Memorandum Contra, which was filed herein June 3, 2014.
On July 12, 2013, the Defendant withdrew his forn7er plea of not guilty and
entet-eri a plea of guilty to murder, an unclassified felony with a firearm specification.
The Court asked the Defendant in the plea colloquy if he was satisfied with the advice
of his attorney and his representation of him. The Defendant answered in the
affirmative. The Defendant's Court Appointed Counsel filed a Not Guilty by Reason
of lnsanity or1 Jaizuary 29. 2013. The Defer.^dant then retained private counsel. The
Defendant's counsel filed a Motion to Withdraw Plea of Not Guilty by Reason of
Insanity on March 21, 2013. An Entry granting that Motion was filed on March 22,
2013. Counsel for the Defendant did not raise tl-ie issue of the Defendant's
competency to stand trial.
The Defendant was advised of the possible maximum penalty for murder
of an indefinite terrn of 15 vears to life in a state penal institution and a maxin7unl
fjne of up to $15,000.00. Further, the frearm specification carries a n-iandatory
consecutive sentence of three years. The Defendant indicated that he tznderstood the
penalty for the crime for whicli he indicated his desire to plead guilty. Further, the
Defendant failed to file an Appeal regarding his allegation that he had ineffective
assistance of counsel or that he was incompetent to stand trial. "Pursuant to res
ji,r.a'icata, a De:endant caru?ot raise an i.ssue in a petition for post-conviction relief if he
or she could have raised the issue on direct appeal." State v. Reynolds, 79 Ohio St.3d
158, 161, 679 N.E,2d 1131 (1997).
A hearing on the Motion to Withdraw a Guilty Plea is required only if the
facts alleged by the Defendant and accepted as true by the Court would require the
Court to perrrzit the plea to be withdrawn. State v. Nathan, 99 Ohio App.3d 722, 725
(1995). The facts alleged by the Defendant do not warrant a withdrawal of his guilty
plea. A Post-Sentence Motion to Withdraw a Plea should be granted only to correct
i-ilanifest injustice. Stale v. S»rth, 49 Ohio St.2d, 261, 263-266 (1977). The
Defendant has the burden of proving inanifest injustice. The Defendant has failed to
prove nianifest injustice in allowing hirn to withdraw his gu.ilty plea. The
Defendant's Request to Withdraw his Guilty Plea shall be denied. IT IS SO
ORDERED.
