AMERICAN CONSERVATIVE UNION FOUNDATION’S 2017 Ratings of Arizona

Dear Fellow Conservative,

The American Conservative Union Foundation is proud to present our ratings of the 2017 meeting of the Arizona State Legislature. Like our Congressional Ratings, which date back 46 years, these ratings are meant to reflect how elected officials view the role of government in an individual’s life. We begin with our philosophy (conservatism is the political philosophy that sovereignty resides in the person) and then apply our understanding of government (its essential role is to defend life, liberty and property).

Because our ratings are designed to educate the public about how consistently their elected officials adhere to conservatism, we carefully examine the entire docket of legislation introduced in each state every year. We select the most meaningful bills and publish the results after the dust has settled. The ACU Foundation is the only organization to score over 8,000 elected officials each year, including lawmakers from all 50 states and Congress.

The 2016 election dramatically impacted the political landscape of not only Washington but state legislative chambers all across the country. Republicans now have control of both legislative chambers in 32 states, more than double the number they controlled in 2010. With these victories comes an ability to implement policies that restore individual liberty and return us to a limited form of government run by and for “We the People.”

It is our hope that these ratings will serve as a guide showing who can be relied on to fight for conservative principles and restore the role of government to what our nation’s founding fathers envisioned.

SELECTING THE VOTES

ACU researched and selected a range of bills before the Arizona State Legislature that determine a member’s adherence to conservative principles. We selected bills that focus on Ronald Reagan’s philosophy of the “three-legged stool”: 1) fiscal and economic: taxes, budgets, regulation, spending, healthcare, and property; 2) social and cultural: 2nd amendment, religion, life, welfare, and education; and 3) government integrity: voting, individual liberty, privacy, and transparency. This wide range of issues are designed to give citizens an accurate assessment that conveys which of Arizona’s elected leaders best defend the principles of a free society: Life, Liberty and Property.

1. SB 1439 Protecting Religious Freedom for Health Care Providers. This bill protects the religious liberties of healthcare providers by preventing the state from taking legal action against providers who refuse to participate in abortion procedures or follow end of life directives that run contrary to their religious views. ACU supports the right of conscience to protect the constitutional right to practice one’s religion and supported this bill. The Senate passed the bill on February 22, 2017 by a vote of 17-13.

2. SB 1437 Reforming Occupational Licensing. This bill allows individuals in various occupations across the state to challenge unfair licensing requirements that limit competition and create unnecessary barriers to work. ACU opposes the proliferation of licensing requirements that are primarily designed to reduce competition rather than protect public safety and supported this bill as a step in the right direction. The Senate passed the bill on February 27, 2017 by a vote of 18-12.

3. SB 1123 Prohibiting Taxpayer-Funded Lobbying. This bill prohibits taxpayer-funded lobbying by codifying a 2016 Executive Order by the governor that prohibits state agencies from contracting out for professional lobbying services. ACU opposes the usage of taxpayer funds for lobbying purposes, which oftentimes results in funds being used to lobby for even more taxpayer funds, and supported this bill. The Senate passed the bill on February 23, 2017 by a vote of 18-12.

4. SB 1344 Expanding the Right to Carry Firearms in Vehicles. This bill clarifies that state and local governments cannot prohibit employees of private contractors from possessing firearms on their privately-owned property or in their vehicles. ACU supports the founder’s belief in the Second Amendment and supported this bill. The Senate passed the bill on February 28, 2017 by a vote of 16-14.

5. SB 1407 Increasing Worker Compensation Care Oversight. This bill protects taxpayers from excessive workers’ compensation costs by providing governmental entities with the same ability that private employers have to select the provider in workers’ compensation cases. ACU supports allowing government to mirror the consumer choice that is enjoyed by the private sector in an effort to control government costs and supported this bill. The Senate passed the bill on March 6, 2017 by a vote of 17-13.

6. HB 2322 Clarifying Franchise Labor Law. This bill combats an Obama Administration’s ruling on labor law by clarifying that franchise owners and their employees are not the employees of a franchisor. ACU supports this pro-growth policy that overcomes a ruling by the Obama Administration’s National Labor Relations Board that overturned decades of precedent on this issue and supported this bill. The Senate passed the bill on March 14, 2017 by a vote of 17-13.

7. HB 2212 Providing Transparency Over Federal Funding. This bill requires all state agencies and local governments to prepare an annual report detailing the federal funds they receive and submit that information to the Arizona Department of Administration. The report will include plans to deal with a reduction in federal funds. ACU supports increased transparency in the use of federal funds and supported this bill. The Senate defeated the bill on March 20, 2017 by a vote of 14-15.

8. HB 2337 Reducing Alcoholic Beverage Regulations. This omnibus bill reduces numerous regulations which would make it easier to sell or serve alcoholic beverages. The bill allows breweries, distilleries and farm wineries to share a liquor license and doubles the number of remote tasting rooms and retail premises an entity may have from one to two. Finally, the bill increases the number of special event licenses allowed each year, among other provisions. ACU supports reducing regulations including on alcoholic beverage sales and supported this bill as a step in the right direction. The Senate passed the bill on April 3, 2017 by a vote of 24-6.

9. HB 2477 Reforming Civil Asset Forfeiture. This bill makes some reforms to Arizona’s civil asset forfeiture law by ensuring that that the standard of proof to connect the property to a crime will be “clear and convincing evidence”. In addition, the bill allows property owners rather than the government to recoup legal fees if they prevail, and bans local law enforcement from transferring property to the federal government unless it is valued at more than $75,000, among other provisions. ACU Foundation’s Center for Criminal Justice Reform is a leading voice on this issue, and ACU believes property should not be seized without a criminal conviction and supported this bill as a step in the right direction. The Senate passed the bill on April 3, 2017 by a vote of 30-0.

10. HB 2216 Banning Firearm Tracking Technology. This bill prevents the government from mandating the use of electronic firearm-tracking technology, also known as “smart gun” technology. These systems have been found to place lives at risk by malfunctioning, and also bring up serious questions on privacy due to their tracking and logging systems. ACU supports the founder’s belief in the Second Amendment and supported this bill. The Senate passed the bill on April 4, 2017 by a vote of 17-12.

11. HB 2017 Increasing Government Ballot Transparency. This bill requires that any bond issue on a ballot list the maximum possible tax rate that can be imposed. The bill also requires local governments to inform the voters that a “yes” vote could increase the primary tax rate to pay for the projects funded by the bond. Currently the only information required is an “anticipated” tax rate. ACU supports increased government transparency regarding the cost of programs to taxpayers and supported this bill. The Senate defeated the bill on April 4, 2017 by a vote of 14-15.

12. SB 1431 Expanding School Choice Scholarship Accounts. This bill expands the empowerment Scholarship Account program by phasing in coverage for all K-12 students over four years. This program provides parents with a prepaid bank card containing 90% of the funds the government would otherwise spend on education and allows the funds to be used for tuition, fees, textbooks, tutoring and other related expenses at any school. ACU supports the expansion of school choice and supported this bill. The Senate passed the bill on April 6, 2017 by a vote of 16-13.

13. SB 1406 Reducing Lawsuits Involving Disabilities. This bill allows a business 30 days to correct a minor violation of the Arizona with Disabilities Act before a lawsuit can be filed. ACU supports common-sense tort reform that prevents attorneys from forcing cash settlements on businesses that have a minor violation, such as the height or color of a parking lot sign, and supported this bill. The Senate passed the bill on April 17, 2017 by a vote of 18-11.

14. SB 1042 Increasing Teacher Hiring Flexibility. This bill provides local schools with greater teacher hiring flexibility by allowing individuals with expertise in certain areas to obtain a "Subject Matter Expert Standard Teaching Certificate” to become eligible to teach, thus bypassing the state’s regular requirements. ACU supports any effort to reduce the power and authority of the public school bureaucracy and supports increasing the flexibility of schools to hire the very best teachers and supported this bill. The Senate passed the bill on April 25, 2017 by a vote of 16-12.

15. HB 2096 Reforming the Tort System. This bill establishes a “loser-pay” system by requiring anyone who sues the government to stop a natural resources project to post a bond of $50,000 or 10 percent of the cost of the project and be responsible for legal fees if they do not prevail in court. ACU supports efforts to reduce litigation that is both burdensome to taxpayers and harmful to efforts that prevent wildfires and supported this bill. The Senate passed the bill on April 26, 2017 by a vote of 16-11.

16. HB 2440 Reducing Government Motor Vehicle Fleets. This bill sets up a demonstration project to compare the cost of utilizing private vehicles for hire, rental car companies, and fleet management companies with government-owned state motor vehicle fleet. ACU supports efforts to utilize private enterprise for government services and find ways to reduce the size of government and supported this bill. The Senate passed the bill on May 4, 2017 by a vote of 16-14.

17. HB 2528 Cutting Personal Income Taxes. This bill raises the personal income tax exemption by $100 over two years and then indexes that exemption to inflation. The bill also repeals numerous tax credits for various uses of “renewable energy” products and other credits that are almost never used. ACU supports indexing tax laws to inflation as sound tax policy, believes government should not support one form of energy over another and supported this bill. The Senate passed the bill on May 4, 2017 by a vote of 19-11.

18. HB 2410 Ensuring Proper Worker’s Compensation Eligibility. This bill reduces the integrity of the state’s worker compensation system by including heart-related and pulmonary injuries in the list of health conditions and cancers fire-fighters that are “presumed” to have occurred on the job. ACU believes that worker’s compensation should be reserved for injuries that can be proven to have occurred on the job and opposed this bill. The Senate passed the bill on May 4, 2017 by a vote of 28-2.

19. HB 2169 Eliminating State Employees Retirement Requirements. This bill eliminates the requirement that state employees be on the job for 27 weeks before joining the state employee retirement system and becoming eligible for long term disability benefits. ACU supports reasonable requirements for gaining these taxpayer-funded benefits and opposed this bill. The Senate passed the bill on May 8, 2017 by a vote of 16-12.

20. HB 2369 Reducing the Size of Government. This bill eliminates 7 government boards and commissions. ACU supports eliminating duplicative and unneeded government boards, such as the board that recommends best management practices for animal grazing that can be easily found online, and supported this bill. The Senate passed the bill on May 9, 2017 by a vote of 16-12.

21. HB 2014 Legalizing Gold and Silver Currency. This bill eliminates the state’s capital gains tax on gold and silver specie (coins with special metal content), and redefines gold and silver as legal currency. ACU supports the free competition of currency, especially at a time when the Federal Reserve is engaging in dangerous and unprecedented monetary policy and supported this bill. The Senate passed the bill on May 10, 2017 by a vote of 16-13.

The House passed the bill on February 1, 2017 by a vote of 31-29.

2. HB 2169 Eliminating State Employees Retirement Requirements. This bill eliminates the requirement that state employees be on the job for 27 weeks before joining the state employee retirement system and becoming eligible for long term disability benefits. ACU supports reasonable requirements for gaining these taxpayer-funded benefits and opposed this bill. The House passed the bill on February 9, 2017 by a vote of 41-17.

3. HB 2014 Legalizing Gold and Silver Currency. This bill eliminates the state’s capital gains tax on gold and silver specie (coins with special metal content), and redefines gold and silver as legal currency. ACU supports the free competition of currency, especially at a time when the Federal Reserve is engaging in dangerous and unprecedented monetary policy and supported this bill. The House passed the bill on February 13, 2017 by a vote of 35-24.

4. HB 2322 Clarifying Franchise Labor Law. This bill combats an Obama Administration’s ruling on labor law by clarifying that franchise owners and their employees are not the employees of a franchisor. ACU supports this pro-growth policy that overcomes a ruling by the Obama Administration’s National Labor Relations Board that overturned decades of precedent on this issue and supported this bill. The House passed the bill on February 16, 2017 by a vote of 34-24.

5. HB 2410 Ensuring Proper Worker’s Compensation Eligibility. This bill reduces the integrity of the state’s worker compensation system by including heart-related and pulmonary injuries in the list of health conditions and cancers fire-fighters that are “presumed” to have occurred on the job. ACU believes that worker’s compensation should be reserved for injuries that can be proven to have occurred on the job and opposed this bill. The House passed the bill on February 21, 2017 by a vote of 55-3.

6. HB 2212 Providing Transparency Over Federal Funding. This bill requires all state agencies and local governments to prepare an annual report detailing the federal funds they receive and submit that information to the Arizona Department of Administration. The report would include plans to deal with a reduction in federal funds. ACU supports increased transparency in the use of federal funds and supported this bill. The House passed the bill on February 22, 2017 by a vote of 31-28.

7. HB 2525 Prohibiting Photo Traffic Enforcement. This bill prohibits local government from using traffic cameras to enforce speed laws and traffic signals or stop signs. ACU opposes the use of traffic cameras that are primarily designed to produce revenue rather than improve traffic safety and can be used to track people’s movements and supported this bill. The House passed the bill on February 23, 2017 by a vote of 32-28.

8. HB 2096 Reforming the Tort System. This bill requires anyone who sues the government to stop a natural resources project to post a bond of $50,000 or 10 percent of the cost of the project and be responsible for legal fees if they do not prevail in court. ACU supports efforts to reduce litigation that is both burdensome to taxpayers and harmful to efforts that prevent wildfires and supported this bill. The House passed the bill on February 23, 2017 by a vote of 35-25.

9. SB 1439 Protecting Religious Freedom for Health Care Providers. This bill protects the religious liberties of healthcare providers by preventing the state from taking legal action against providers who refuse to participate in abortion procedures or follow end of life directives that run contrary to their religious views. ACU supports the right of conscience to protect the constitutional right to practice one’s religion and supported this bill. The House passed the bill on March 21, 2017 by a vote 32-24.

10. SB 1367 Establishing “Born Alive” Abortion Regulations. This bill requires physicians to report on whether a fetus or embryo was delivered alive after an abortion procedure and what efforts were taken to preserve the baby’s life. ACU believes abortion is a human tragedy, supports restrictions on the practice and supported this bill. The House passed the bill on March 29, 2017 by a vote of 34-22.

11. SB 1437 Reforming Occupational Licensing. This bill allows individuals in various occupations across the state to challenge unfair licensing requirements that limit competition and create unnecessary barriers to work. ACU opposes the proliferation of licensing requirements that are primarily designed to reduce competition rather than protect public safety and supported this bill as a step in the right direction. The House passed the bill on March 30, 2017 by a vote of 34-20.

12. SB 1344 Expanding the Right to Carry Firearms in Vehicles. This bill clarifies that state and local governments cannot prohibit employees of private contractors from possessing firearms on their privately-owned property or in their vehicles. ACU supports the founder’s belief in the Second Amendment and supported this bill. The House passed the bill on April 5, 2017 by a vote of 33-24.

13. SB 1123 Prohibiting Taxpayer-Funded Lobbying. This bill prohibits taxpayer-funded lobbying by codifying a 2016 Executive Order by the governor that prohibits state agencies from contracting out for professional lobbying services. ACU opposes the usage of taxpayer funds for lobbying purposes, which oftentimes results in funds being used to lobby for even more taxpayer funds, and supported this bill. The House passed the bill on April 5, 2017 by a vote of 35-23.

14. SB 1431 Expanding School Choice Scholarship Accounts. This bill expands the empowerment Scholarship Account program by phasing in coverage for all K-12 students over four years. This program provides parents with a prepaid bank card containing 90% of the funds the government would otherwise spend on education and allows the funds to be used for tuition, fees, textbooks, tutoring and other related expenses at any school. The House passed the bill on April 6, 2017 by a vote of 31-28 but will have to be approved by the voters in a ballot initiative in November, 2018.

15. HB 2477 Reforming Civil Asset Forfeiture. This bill makes some reforms to Arizona’s civil asset forfeiture law by ensuring that that the standard of proof to connect the property to a crime will be “clear and convincing evidence”. In addition, the bill allows property owners rather than the government to recoup legal fees if they prevail, and bans local law enforcement from transferring property to the federal government unless it is valued at more than $75,000, among other provisions. ACU Foundation’s Center for Criminal Justice Reform is a leading voice on this issue, and ACU believes property should not be seized without a criminal conviction and supported this bill as a step in the right direction. The House passed the bill on April 10, 2017 by a vote of 55-1.
