    01010 - 1 Summary of Work

    SECTION 01010 SUMMARY OF WORK

    PART 1 GENERAL

    1.01 LOCATION OF WORK

    A. The work of this Contract is located in the Hilliard Fletcher Wastewater Treatment Plant in the City of Tuscaloosa, Alabama. Access to the wastewater treatment plant site shall be over public and/or private streets within the City of Tuscaloosa. The location of the site is further detailed as shown on the Drawings.

    B. Any damage to existing pavement surface and base or other surface improvements outside the contract limits attributable to the Contractor’s activities shall be restored to like-new condition by the Contractor at his own expense.

    1.02 GENERAL

    A. The Contractor shall furnish all labor, materials, equipment, services, permits, insurance, licenses, and incidentals to complete all work required by these Specifications and as shown on the Drawings.

    B. The Contractor shall perform the Work complete, in-place, and ready for continuous service, and shall include repairs, testing, cleanup, replacements, and restoration required as a result of damages caused during this construction.

    C. The Contractor shall comply with all municipal, county, state, federal, and other codes which are applicable to the proposed construction work. The Contractor shall comply with all City of Tuscaloosa, Tuscaloosa Homeowner’s Association (HOA), State, Federal, and other codes which are applicable to the proposed work.

    D. Excavations shall not remain open overnight, without the permission of the Engineer or Owner.

    E. During this contract, construction by other contractors for separate projects may be in progress at the site. Work by these other contractors is referenced as work “by others” in the Contract Documents. The Contractor shall coordinate his work with work “by others” as necessary to allow mutual completion of related work items.

    F. Owner will occupy the project site during performance of the work for the conduct of his normal operations. Coordinate all construction operations that interfere with operations of existing facilities with Owner to minimize conflicts.

    G. Continuous plant and process operations are of the utmost importance. Contractor shall sequence construction such that plant and process operations are not shutdown and negatively impacting operations. Contractor shall

    coordinate all activities with the Owner and Engineer prior to commencement of Work or portions thereof to ensure continuous plant and process operations are not negatively impacted.

    1.03 SCOPE OF WORK

    A. The Contractor shall furnish all labor, materials, equipment, tools, services, supervision, and incidentals required to complete the work as shown on the Drawings and specified herein.

    B. It is the intent of this specification to provide for the Work, including but is not necessarily limited to, the following:

    1. Demolition

    a. Two (2) existing boilers and common boiler stack

    b. Two (2) air/dirt separators

    c. Selective piping, valves, electrical, instrumentation, controls, field panels, and other applicable appurtenances related to the existing boilers.

    2. New Installation

    a. Two (2) boilers

    b. Two (2) boiler stacks

    c. Two (2) air/dirt separators

    d. One (1) biogas conditioning system

    e. One (1) waste gas burner system

    f. Piping, valves, electrical, instrumentation, controls, network and programming, SCADA modifications, field panels, and other necessary appurtenances.

    C. The Owner may or may not choose to include the Work listed as additive alternates in the bid award. The decision to award additive alternates will be determined on whether the bid is less than the project’s approved budget.

    D. Please note the Minority Inclusion Policy in the Contract. The Contractor is required to follow the instructions therein and submit various forms as described in the policy.

    E. The Contractor shall furnish a work schedule to the Owner prior to commencing Work.

    F. The quantities listed in the Bid Proposal are for determining the most qualified bidder and in no way represent the quantities for this Contract. If a Unit Bid Price is considered high by the Owner, the Owner reserves the right to use other forces for the line item for this Contract. This Contract is to enhance the

    Owner’s forces and does not give the Contractor exclusive rights to perform the work listed above. This Contract will not eliminate bidding projects with the included line items.

    G. Any part or item of the work which is reasonably implied or normally required to make each installation satisfactorily and completely operable shall be performed by the Contractor and the expense thereof shall be included in the applicable unit prices or lump sum prices bid for the various items of work. It is the intent of the Contract Documents to provide the Owner with complete operable systems, subsystems, and other items of work. All miscellaneous appurtenances and other items or work that are incidental to meeting the intent of these Contract Documents shall be considered as having been included in the applicable unit prices or lump sum prices bid for the various items of work even though these appurtenances and items may not be specifically called for in the Specifications or shown on the Drawings.

    H. The Contractor shall comply with all City, State, Federal, and other codes which are applicable to the proposed work.

    1.04 PERMITTING

    A. The Contractor shall be responsible for applying for and attaining all permits and licenses required to complete the work.

    1.05 WORK SEQUENCE

    A. Construct work at all times to accommodate the use of the existing plant, processes, and premises during the construction period. The construction schedule and operations shall be coordinated with the Owner and Engineer.

    B. The Contractor is responsible for construction means, methods, and sequencing to complete the intended work with the exception that temporary boilers, piping, and appurtenances shall be procured, installed, and fully operational under normal plant and process operating conditions prior to initiating any demolition work on the existing boilers. Temporary boilers shall, at a minimum, meet the requirements of the proposed boilers. Contractor shall provide submittals to the Engineer for review in accordance with Section 01300 prior to procurement.

    1.06 CONTRACTOR'S USE OF PREMISES

    A. Contractor shall coordinate use of premises under the direction of the Owner.

    B. Contractor shall assume full responsibility for security of all materials and equipment stored on the site under this Contract, including those items salvaged and stored by contractor for later delivery to Owner.

    C. If directed by the Owner, move any stored items, which interfere with operations of Owner.

    D. Obtain and pay for use of additional storage or work areas if needed to perform the Work.

    1.07 DRAWINGS AND SPECIFICATIONS

    A. All work called for in the Specifications applicable to the Contract but not shown on the Drawings in their present form or vice versa shall be of like effect as if shown or mentioned in both. Work not specified in either the Drawings or in the Specifications but involved in carrying out their intent or in the complete and proper execution of the work is required and shall be performed by the Contractor as though it were specifically delineated or described.

    B. The apparent silence of the Specifications as to any detail, or the apparent omission from them of a detailed description concerning any work to be done and materials to be furnished, shall be regarded as meaning that only the best general practice is to prevail and that only material and workmanship of the best quality is to be used, and any interpretation of these Specifications shall be made upon that basis.

    1.08 SUBSTITUTION OF EQUIPMENT AND MATERIALS

    A. Certain equipment and materials identified in the Specifications by manufacturer is to establish the quality expected by the Owner. Material or equipment of equal or better quality may be substituted for those named at the Contractor’s option with the stipulations described below. If this material or equipment is subsequently disapproved, the Contractor shall resubmit until the material or equipment he proposes is approved. The Owner and Owner’s designated representative shall be the final authority on equality.

    B. The Contractor shall identify with his bid any manufacturers intended to be used that are not specifically named in the specification for the particular bi item.

    C. This substitution paragraph does not apply to material or those pieces of equipment identified by a manufacturer followed by the words “to match existing.”

    D. Where material is identified by manufacturer, the first name appearing in the Specifications is the name of the manufacturer whose product is of such quality as expected by the Owner. The second name is a manufacturer known to produce a material of equal quality. As described above, the Contractor may choose to install another manufacturer’s material. If the Contractor chooses to install material other than the first named, any modifications or additional components required to provide a complete and satisfactory installation shall be provided by the Contractor at no additional expense to the Owner.

    1.09 CONTRACTOR’S RESPONSIBILITIES

    A. Any conflicts between the Drawings, Specifications, and Addendums shall be brought to the immediate attention of the Engineer for clarification. Any work

    or actions taken by the Contractor before clarification is provided shall be at the Contractor’s own risk and additional cost. Any deviations from the Drawings or Specifications shall be presented to the Engineer for Approval. Approval or Clarification from the Engineer shall be in written form on appropriate construction documents.

    B. The responsibilities of the Contractor shall include, but not be limited to, the following:

    1. Submit shop drawings, product data, and samples. Notify Engineer of any discrepancies or problems anticipated with any material, equipment and incidentals.

    2. Coordinate delivery date for all equipment, materials, and incidentals required for construction. Arrange and pay for delivery of item to site.

    3. Receive and unload items at site. Inspect items used for construction and record any shortages, damaged, or defective items. Assume responsibility for items, including insurance, upon acceptance of items at site. Handle items at site, including uncrating and storage. Protect items from exposure to elements and damage.

    4. Assemble, install, connect and finish products and provide warranty for Contractor-furnished materials and workmanship as specified.

    5. Repair or replace items damaged as a result of Contractor's work at no additional cost to Owner.

    6. Inspect construction on daily basis and record all activity.

    7. Coordinate warranties, bonds, and inspection of all materials and equipment. Arrange for replacement of damaged, defective, or missing items.

    01014 – 1 Construction Sequence

    SECTION 01014 CONSTRUCTION SEQUENCE

    PART 1 GENERAL

    1.01 SITE CONDITIONS

    A. Some areas of construction under this contract must be coordinated with the Owner and accomplished in a logical order to maintain digester biogas flow and to allow construction to be completed within the time allowed by the Contract Documents. Contractor will also coordinate his activities with the other contractors, if any, to allow orderly and timely completion of all the work.

    B. Contractor is required to coordinate his activities in the interface or common areas with these other contractors and the Owner.

    C. The Contractor shall maintain "all-weather" access to site at all times during the construction phase.

    D. Regular working hours are defined as 8 hours per day, Monday through Friday, excluding holidays, between the hours of 7:00 AM and 5:00 PM. Requests to work other than regular working hours shall be submitted to Engineer not less than 48 hours prior to any proposed weekend work or scheduled extended work weeks. Occasional unscheduled overtime on weekdays may be permitted provided two-hour notice is given to Engineer. Emergency work may be accomplished without obtaining prior permission but should be properly documented. Owner and Engineer shall be informed immediately via phone or e-mail of any emergency operations or situations.

    E. Erosion and sediment control measures shall be constructed and maintained throughout the duration of construction. Installation and maintenance of erosion and sediment control measures shall be accounted for in the construction schedule. The Contractor shall stage his work, as much as possible, to minimize disturbance to soils and decrease the potential for sediment runoff.

    1.02 NOTIFICATION REQUIREMENTS

    A. The Contractor shall give a minimum of fourteen (14) days advance notice to the Engineer of each component, existing facility, etc., proposed for shutdown or disruption, all of which shall be subject to Owner approval and limitations. Contractor shall include scheduled dates for shutdown and interruptions to operations in the construction schedule.

    B. During start-up and testing, make available the manpower, equipment, and manufacturer’s representatives required to make any necessary adjustments and training. Owner and Engineer shall be notified a minimum of seven (7) days in advance of any training and start-up testing. Adequate time shall be allocated for manufacturer’s representative to thoroughly cover all aspects of training and start-up testing with the Hilliard Fletcher Wastewater Treatment Plant

    operations and maintenance staff.

    1.03 TIE-IN PREPARATIONS

    A. Where new systems are to be connected to existing systems, which are required to be shutdown to make the connection, the system shall be fully prepared in anticipation of the connection to minimize downtime of the existing system. The new equipment shall be fully tested to the maximum extent possible prior to connection.

    B. Measurements shall be taken to ensure that the new equipment or piping is of the correct size, length, and alignment to complete the connection. The Contractor shall supply a list of all materials and equipment needed to accomplish the connection and shall review the proposed connection with the Owner and Engineer.

    C. Once initiated, work shall continue until the connection is completed. Contractor shall ensure that all materials, labor, and equipment required to complete the work are available at the site of the connection prior to the initiation of work.

    01017 – 1 Requests for Information

    SECTION 01017 REQUESTS FOR INFORMATION

    PART 1 GENERAL

    1.01 DESCRIPTION OF REQUIREMENTS

    A. This Section specifies the general methods and requirements of Requests for Information (RFIs).

    1.02 REQUESTS FOR INFORMATION

    A. When the Contractor believes that additional information or clarification of a contract requirement is needed, it may initiate a Request for Information (RFI) and submit it to the Engineer.

    B. RFIs may relate to technical matters or administrative matters. The RFI process shall be limited to the clarification of technical and/or administrative matters. While the response to an RFI might lead to a change in the contract scope, cost, or time, RFIs are not a substitute to the notification requirements stipulated in the General Conditions.

    C. A response to an RFI may authorize minor changes to the contract consistent with the terms of the contract related to the responsibilities and limitations of authority of the Engineer.

    D. A response to an RFI is not an authorization to perform any additional work that would require that change order or written amendment to the contract. If the Contractor believes the response to an RFI requires a change to the contract, Contractor shall promptly provide written notice to the Owner and Engineer in accordance with the General Conditions.

    E. RFIs are not a substitute for the submittals process specified in Section 01300.

    PART 3 EXECUTION

    3.01 ORIGINATION

    A. The Contactor shall originate RFIs using the form provided by the Engineer.

    1. RFIs shall be numbered consecutively. In the event that an answered RFI results in a follow-up inquiry, the follow-up shall maintain the same number as the original, appended with a suffix.

    2. Include Specification Section(s), Drawing(s), or detail(s) for which information is requested.

    3. Attach drawings, sketches, photographs, or other relevant information.

    4. If the question concerns an interpretation of the Contract Documents, enter the Contractor's interpretation.

    5. Indicate the date by which the Contractor requests a reply.

    6. Sign the upper portion of the form.

    B. RFIs may not be submitted by subcontractors or suppliers. When a subcontractor or supplier generates a request for information or clarification to the Contractor, Contractor shall incorporate such requests into the required format, assign the next number, and sign.

    C. Contractor shall maintain a log of all RFIs including the date originated, date delivered, and date answered.

    3.02 PROCESSING

    A. Contractor shall submit all RFIs to the Engineer for processing.

    B. Technical RFIs will generally be reviewed and answered by the respective discipline engineer or architect.

    C. Administrative RFIs will generally be reviewed and answered by the Engineer in consultation with the Owner.

    D. The Engineer will generally respond to RFIs within seven calendar days of receipt, depending on the complexity of the inquiry.

    3.03 RESPONSES

    A. If the RFI contains sufficient clarity, the Engineer will insert a response in the lower portion of the RFI form, sign and date the response, and return the completed form to the Contractor.

    B. If the RFI does not contain sufficient clarity, the Engineer may request additional information from the Contractor.

    C. Engineer will distribute copies to the Owner and project files.

    D. Engineer will maintain a log of all RFIs including the date received and date returned to Contractor.

    01026 – 1 Schedule of Values

    SECTION 01026 SCHEDULE OF VALUES

    PART 1 GENERAL

    1.01 SCOPE OF WORK

    A. Submit a Schedule of Values to the Engineer for approval within ten calendar days after award of Contract, in accordance with the General Conditions.

    B. Correlate line items in the Schedule of Values with other required administrative schedules and forms, including:

    1. Construction schedule.

    2. Application for payment forms, including continuation sheets.

    3. List of subcontractors.

    4. List of products.

    5. List of principal suppliers and fabricators.

    6. Schedule of submittals

    C. No payment request (including the first) will be approved until the Schedule of Values has been approved by the Engineer.

    1.02 FORMAT AND CONTENT

    A. Use the table of contents of the Specifications as a guide to establish the format for the Schedule of Values. Provide at least one line item for each Specification Section.

    1. Include the following Project identification;

    a. Project name and location.

    b. Name of Owner.

    c. Project number.

    d. Contractor's name and address.

    e. Date of submittal.

    2. Arrange the Schedule of Values in tabular form with columns to indicate the following for each item listed:

    a. Related Specification Section or Division.

    b. Description of Work.

    c. Name of subcontractor.

    3. Provide a breakdown of the Contract Sum in sufficient detail to facilitate evaluation of Applications for Payment. Break subcontract amounts down into several line items if needed. Round amounts to nearest whole dollar; the total shall equal the Contract Sum.

    4. Provide a separate line item for each part of the work where Applications for Payment may include materials or equipment, purchased or fabricated and stored, but not yet installed.

    5. Provide separate line items for initial cost of materials, for each subsequent stage of completion, and for total installed value.

    6. Show line items for indirect costs and margins on costs only when such items are listed individually in Applications for Payment. Each item in the Schedule of Values and Applications for Payment shall be complete. Include the total cost and proportionate share of general overhead and profit margin for each item.

    a. Temporary facilities and items that are not direct cost of work-in-place may be shown as separate line items or distributed as general overhead expense.

    7. Update and resubmit the Schedule of Values when Change Orders or Construction Change Directives change the Contract Sum.

    01027 – 1 Application for Payment

    SECTION 01027 APPLICATION FOR PAYMENT

    PART 1 GENERAL

    1.01 SCOPE OF WORK

    A. Submit applications for payment in accordance with General Conditions, Special Conditions, this Section, and Contract.

    B. The approved Schedule of Values as submitted under Section 01026 shall be used as the basis for Contractor's applications for payment.

    1.02 FORM AND CONTENT

    A. Submit applications typed on forms provided by the Owner or approved by Owner/Engineer, with itemized data typed on 8-1/2-in by 11-in white paper continuation sheets. Application shall include a waiver of mechanics lien from every entity who may file a lien arising from work covered by the payment application.

    B. Application Form:

    1. Fill in required information, including that for Change Orders executed prior to date of submittal of application.

    2. Fill in summary of dollar values to agree with respective totals indicated on continuation sheets.

    3. Execute certification with signature of a responsible officer of Contract firm.

    C. Continuation Sheets:

    1. Fill in total list of all scheduled component items of work, with item number and scheduled dollar value for each item.

    2. Fill in dollar value in each column for each scheduled line item when work has been performed or products stored.

    3. List each Change Order executed prior to date of submission by Change Order Number and description.

    4. To receive approval for payment on component material stored on site, submit copies of the original paid invoices with the application for payment.

    5. The Contractor shall submit an updated monthly Progress Schedule as specified in Section 01311 as a pre-requisite for payment.

    1.03 SUBMITTAL PROCEDURE

    1.06 APPLICATION FOR PAYMENT AT TIME OF FINAL COMPLETION

    A. Administrative actions and submittals that must precede the Application for Payment following issuance of Engineer's "Certificate of Completion" shall include, but not necessarily be limited to, the following:

    1. Warranties, guarantees, maintenance agreements and similar provisions of contract documents.

    SECTION 01030 SPECIAL PROJECT PROCEDURES

    PART 1 GENERAL

    1.01 WORKMANSHIP, MATERIAL AND EQUIPMENT

    A. All equipment, machinery, parts, and assemblies thereof entering into the work shall be tested as specified. Unless waived in writing by the Engineer, all field and operating tests shall be made in the presence of the Engineer or his authorized representative. When such a waiver is issued, sworn statement in duplicate of the tests made and the results thereof shall be furnished to the Engineer by the Contractor or manufacturer. Costs of all tests and trials specified hereto, other than laboratory tests, and with the exception of the Engineer's expenses shall be borne by the Contractor and shall be included in the Contract price.

    B. Special care shall be taken to ensure proper alignment of all equipment with particular reference to the pumps and electric drives. The units shall be carefully aligned on their foundations by qualified millwrights after their sole plates have been shimmed to true alignment at the anchor bolts. The anchor bolts shall be set in place and the nuts tightened against the shims. After the foundation alignments have been approved by the Engineer, the bedplates or wing feet of the equipment shall be securely bolted in place. The alignment of equipment shall be further checked after securing to the foundations, and after conformation of all alignments, the sole plates shall be finally grouted in place. The Contractor shall be responsible for the exact alignment of equipment with associated piping and under no circumstances, will "pipe springing" be allowed.

    C. All wedges, shims, filling pieces, keys, packing, grout, or other materials necessary to properly align, level and secure apparatus in place shall be furnished by the Contractor. All parts intended to be plumb or level must be proven exactly so. Perform all grinding necessary to bring parts to proper bearing after erection.

    D. All workmanship and materials shall be of the highest quality. The equipment shall be the product of manufacturers who are experienced and skilled in the field with an established record of research and development. No equipment will be considered unless the manufacturer has designed and manufactured equipment of comparable type and size for at least ten (10) years.

    E. Contractor must provide his own disposal of excavation that he removes from the site. The Owner may request dirt to be hauled to a site of their choosing. Contractor shall cooperate with Owner.

    1.02 CONNECTIONS TO EXISTING SYSTEMS

    A. The Contractor shall perform all work necessary to locate, excavate, and prepare for connections to the terminus of the existing systems all as shown on the

    Drawings. The cost for this work and for the actual connection to the existing systems shall be included in the bid price for the project and shall not result in any additional cost to the Owner.

    1.03 EXISTING UNDERGROUND PIPING, STRUCTURES, AND UTILITIES

    A. The attention of the Contractor is drawn to the fact that if any excavation is done, the possibility exists of the Contractor encountering various water, wastewater, gas, process, telephone, electrical, or other utility lines not shown on the Drawings. The Contractor shall exercise extreme care before and during excavation to locate and flag these lines so as to avoid damage to the existing lines. Should damage occur to an existing line, the Contractor shall repair the line at no cost to the Owner.

    B. The locations are shown without express or implied representation, assurance, or guarantee that they are complete or correct or that they represent a true picture of underground piping to be encountered.

    C. The existing piping and utilities that interfere with new construction shall be rerouted as shown, specified, as directed by the Engineer, or as necessary to complete the work. Before any piping and utilities not shown on the Drawings are disturbed, the Contractor shall notify the Engineer of the location of the pipeline or utility and shall reroute or relocate the pipeline or utility as directed.

    D. The Contractor shall exercise care in any excavation to locate all existing piping and utilities. All utilities which do not interfere with complete work shall be carefully protected against damage. Any existing utilities damaged in any way by the Contractor shall be restored or replaced by the Contractor at his expense as directed by the Engineer.

    E. It is intended that wherever existing utilities such as water, wastewater, gas, process, telephone, electrical, or other service lines must be crossed, deflection of the pipe within recommended limits and cover shall be used to satisfactorily clear the obstruction unless otherwise indicated on the Drawings. However, when in the opinion of the Owner or Engineer this procedure is not feasible, he may direct the use of fittings for a utility crossing as detailed on the Drawings. The Contractor shall verify utility crossings with test pits prior to construction as required by the Engineer.

    F. The Contractor shall be in compliance with all aspects of Alabama and City of Tuscaloosa law. Call Alabama 811 before beginning any excavation work.

    1.04 OBSTRUCTIONS

    A. It is the responsibility of the Contractor to ensure that all utility or other poles, the stability of which may be endangered by the proximity of excavation, are temporarily stayed in position while work proceeds in the vicinity of the pole and that the utility or other companies concerned be given reasonable advance notice of any such excavation by the Contractor.

    1.05 PROVISIONS FOR CONTROL OF EROSION

    A. Sufficient precautions shall be taken during construction to minimize the run-off of piling substances such as silt, clay, fuels, oils, bitumens, calcium chloride, or other polluting materials harmful to humans, fish, or other life, into the supplies and surface waters of the state. The Contractor shall be responsible for prevention, control, and abatement of erosion, siltation, and water pollution resulting from construction of the Project until final acceptance of the Project.

    B. Control measures must be adequate to assure that turbidity in receiving waters will not be increased more than 10 nephelometric turbidity units (NTU), or as otherwise required by the state or other controlling agency, in water used for public water supply or fishing unless limits have been established for the particular water. In surface water used for other purposes, the turbidity must not exceed 25 NTU unless otherwise required by the state or other controlling agency. Special precautions shall be taken in the use of construction equipment to prevent operations which promote erosion.

    1.06 INCLEMENT WEATHER

    A. In the event of inclement weather, or whenever Engineer shall direct, Contractor and subcontractors shall protect carefully the work and materials against damage or injury from the weather, including sudden rises in sewer flows due to storms outside the immediate construction zone. If, in the opinion of Engineer, any portion of work or materials shall have been damaged or injured by reason of failure on the part of the Contractor or subcontractors to so protect the work, such work and materials shall be removed and replaced at the expense of Contractor and no additional time will be given by the Owner.

    1.07 WATER SUPPLY

    A. There is an existing potable water supply system available for construction purposes. It shall be the Contractor's responsibility to arrange with Owner for use of this source of water, approved by the Engineer, to the site for testing, flushing, and construction purposes. The Contractor shall provide all equipment and labor necessary for temporary water needed for construction, testing, etc. The Contractor may be required to pay for water.

    B. The meter may be installed at fire hydrant near the site by the Owner and at the Contractor's request. The selected hydrant will be agreed to by Contractor and Owner. Contractor shall pay all fees and water usage charges.

    C. Contractor shall purchase water required for pre-operational testing from the Owner in accordance with the provisions herein above.

    1.08 ITEMS SPECIFIED IN DRAWINGS

    A. Items of material, equipment, machinery, and the like may be specified on the Drawings and not in the Specifications. Such items shall be provided by the Contractor in accordance with the specification on the Drawings.

    B. Construction Drawings are provided as a component of this Contract and are bound separately.

    1.09 CONSTRUCTION CONDITIONS, SURFACE AND SUBSURFACE INVESTIGATION

    A. The Contractor shall strictly adhere to the specific requirements of the governmental units or agencies having jurisdiction over the Work. Whenever there is a difference in the requirements of a jurisdictional body and these Specifications, the more stringent shall apply.

    B. All work within streets and highways shall be subject to the regulations and requirements of the appropriate agencies. Streets and highways are under the jurisdiction of the City for this Project. Methods and materials of construction used in restoration within such streets and highways shall conform to the requirements, inspection, and approval of the duly authorized representatives of the appropriate agency having jurisdiction. Restoration work shall include:

    1. Removal and replacement of pavement, sidewalk, curb, and gutter.

    2. Replacement of storm sewerage facilities.

    3. Excavation and backfilling.

    4. Storage of materials and equipment.

    C. The Contractor shall be responsible for having determined to his satisfaction, prior to the submission of his bid, the nature and location of the work, the conformation of the ground, the character and quality of the substrata, the types and quantity of materials to be encountered, the nature of the groundwater conditions, the character of equipment and facilities needed preliminary to and during the prosecution of the work, the general and local conditions, and all other matters which can in any way affect the work under this contract. The prices established for the work to be done will reflect all costs pertaining to the work. Any claims for extras based on substrata, groundwater table, seasonal surface water, and other such conditions will not be allowed.

    1.10 PUBLIC NUISANCE

    A. The Contractor shall not create a public nuisance, including, but not limited to, encroachment on adjacent lands, flooding of adjacent lands, or excessive noise.

    B. Sound levels from Contractor operations shall not exceed 55 dBA 7 A.M. to 7 P.M. or 45 dBA between 7 P.M. to 7 A.M. This sound level to be measured at the exterior of the nearest exterior wall of the nearest residence. Levels at operating equipment shall not exceed 85 dBA at the equipment at any time. Sound levels in excess of these values are sufficient cause to have the work halted until equipment can be quieted to these levels. If requirements of the City Noise Ordinance are more restrictive than the above limits, then the Ordinance shall have precedence over the above requirements. Work stoppage by the Engineer for excessive noise shall not relieve the Contractor of any obligations under the

    contract, including, but not limited to, performance of the work at the contract time and contract price.

    C. No extra payment will be made for time lost due to work stoppage resulting from the creation of a public nuisance.

    D. All equipment to be furnished under this Contract, unless specified otherwise in the technical specifications, shall be designed to insure that the sound pressure level does not exceed 85 decibels over a frequency range of 37.8 to 9600 cycles per second at a distance of three feet from any portion of the equipment, under any load condition, when tested using standard equipment and methods. Noise levels shall include the noise from the motor. Mufflers or external baffles shall not be acceptable for the purpose of reducing noise.

    1.11 HAZARDOUS LOCATIONS

    A. Existing wet wells, manholes, digesters, and other related areas are hazardous locations, in that explosive and/or toxic concentrations of sewage gas may be present and may be deficient in oxygen. Checks shall be made by the Contractor whenever personnel are working in these areas to determine if adequate oxygen is available. Contractor shall perform work in accordance with OSHA, state and local safety requirements.

    B. The Contractor shall also instruct and caution his employees and the employees of his subcontractors to avoid smoking while in hazardous areas, especially wet wells, manholes, and around digesters. Suitable prominent "No Smoking" signs shall be placed at locations indicated by the Engineer.

    C. In his operations in hazardous locations, the Contractor shall use spark-proof tools and explosion-proof temporary lighting and shall not use electric power tools, open flame devices, electric welding or any device or methods which might conceivably cause ignition or explosion.

    D. If a working area atmosphere is unsafe, the Contractor shall furnish, install, operate, and later remove such temporary auxiliary ventilating facilities as are necessary to provide a safe atmosphere.

    1.12 SUSPENSION OF WORK DUE TO WEATHER

    A. No work shall be done when the weather is unfit for good and careful work to be performed. Should the severity of the weather continue, the Contractor, upon the direction of the Engineer shall suspend all work indefinitely. Work damaged during periods of suspension due to inclement weather shall be repaired and/or replaced by the Contractor at no cost to the Owner.

    B. The Engineer shall have the authority to suspend work wholly or in part, for such period or periods as he may deem necessary due to unsuitable weather or such other similar conditions considered unfavorable for the suitable prosecution of the work, or for such time as is necessary due to the failure on the part of the Contractor to perform any or all provisions of the Contract. The authority of the

    Engineer to issue such an order shall not be interpreted as a requirement to do so. If it should become necessary to suspend the work for an indefinite period, the Contractor shall at his own cost, take every precaution to prevent damage or deterioration of the work performed and provide suitable temporary structures where necessary.

    1.13 SPECIAL REQUIREMENTS

    A. The following requirements shall govern:

    1. No additional payment will be made for pumping or other difficulties encountered due to groundwater or surface runoff water.

    2. The Contractor shall, prior to interrupting a utility service (water, sewer, etc.) for the purpose of making cut-ins to the existing lines or for any other purposes, contact the Owner and make arrangements for the interruption which will be satisfactory to the Owner.

    3. All equipment and materials delivered to the job site shall be properly protected from dirt, dust, dampness, water, and any other condition detrimental to the life of the equipment from the date of delivery to the time that control of the equipment is assumed by the Owner.

    4. From investigations, including surveys made at the site, physical conditions are approximately as indicated on the Drawings, but the nature of the materials below the surface, the depth to satisfactory foundations, or the stability of beds or banks, are not guaranteed.

    5. Certain information regarding the reputed presence, size, character, and location of existing underground structures, pipes and conduits has been shown on the Contract Drawings. There is no certainty of the accuracy of this information, and the location of underground structures shown may be inaccurate and other obstructions than those shown may be encountered. The Contractor hereby distinctly agrees that:

    a. The Owner is not responsible for the correctness or sufficiency of the information given.

    b. In no event is this information to be considered as a part of the Contract

    c. That he shall have no claim for delay or extra compensation on account of incorrectness of information regarding obstructions either revealed or not revealed by the Drawings.

    d. He shall have no claim for relief from any obligation or responsibility under this Contract in case the location, size, or character of any pipe or other underground structure is not as indicated on the Drawings, or in case any pipe or other underground structure is encountered that is not shown on the Drawings.

    1.14 RESPONSIBILITY OF CONTRACTOR

    A. The Contractor shall be responsible for the entire work determined by the Drawings, Specifications and Contract from the date of the starting of the work until it is accepted as evidence of approval of the Certificate of Completion by the Owner. He shall be responsible for removals, renewals and replacements due to action of the elements, and all other causes except as otherwise provided in the Specifications. The Contractor shall keep the Contract under his own control and it shall be his responsibility to see that the work is properly supervised and carried on faithfully and efficiently. The Contractor shall supervise the work personally or shall have a competent and English-speaking superintendent or representative who shall be on the site of the project at all working hours, and who shall be clothed with full authority by the Contractor to direct the performance of the work and make arrangements for all necessary materials, equipment, and labor without delay.

    B. Renewals or repairs necessitated because of defective materials or workmanship, or due to action of the elements or other natural causes, including fire and flood, prior to the acceptance as determined by the Completion Certificate, shall be done anew in accordance with the Contract and Specifications at the expense of the Contractor.

    1.15 GUARANTEE

    A. The Contractor shall guarantee that all materials, equipment, structures, and work performed are free from defects in workmanship, design, and materials for a period of one (1) year and if any part of the work shall fail within this period, it shall be replaced and the unit restored to operation at no cost to the Owner. The Surety Bond shall cover this guarantee.

    1.16 JURISDICTIONAL DISPUTES

    A. It shall be the responsibility of the Contractor to pay all costs, including insurance and permits, that may be required to perform any of the work shown on the Drawings or specified herein in order to avoid any work stoppages due to jurisdictional disputes.

    1.17 PURCHASE ORDERS

    A. The Contractor shall provide to the Engineer, within 5 days of execution of the purchase order, one priced copy of all purchase orders (for all material and equipment incorporated into the work) and subcontractor agreements.

    1.18 RELOCATIONS

    A. The Contractor shall be responsible for the relocation of structures, including but not limited to light poles, signs, sign poles, fences, piping, conduits, and drains that interfere with the positioning of the work as set out on the Drawings. The cost of all such relocations shall be included in the bid.

    1.19 SALVAGE

    A. No items shall be salvaged by the Owner. All equipment in areas designed for demolition shall become the property of the Contractor and hauled off site at his expense under the demolition work.

    B. Excavated fill material shall be placed and protected in such manner as to minimize run-off. The Owner may elect to use the fill material on other City projects.

    1.20 PERMITS

    A. Upon notice of award, the Contractor shall immediately apply for all applicable permits not previously obtained by the Owner to do the work from the appropriate governmental agency or agencies. No work shall commence until all applicable permits have been obtained and copies delivered to the Engineer.

    1.21 PUMPING

    A. The Contractor with his own equipment shall do all pumping necessary to prevent flotation of any part of the structures during construction operations.

    B. The Contractor shall, for the duration of the contract and with his own equipment, pump out water which may seep or leak into the excavations or structures. Galleries and other operating areas shall be kept dry at all times. The extent of pumping required in the tanks, channels, and other non-operating areas will be determined by the Owner/Engineer.

    1.22 DAILY REPORTS

    A. The Contractor shall submit daily reports of construction activities, including non-workdays. The report shall include:

    1. Manpower, number of men by craft.

    2. Equipment on the project.

    3. Major deliveries with attached delivery tickets.

    4. Activities worked with reference to the CPM schedule activity numbers.

    5. New problems.

    6. Other pertinent information.

    B. A similar report shall be submitted for/by each Subcontractor.

    C. The reports shall be submitted to the Engineer within two days of the respective report date.

    1.23 DEWATERING OF EXISTING PROCESS UNITS AND DISPOSAL OF RESIDUE

    A. The Contractor's attention is directed to Section 01014 of the specifications which defines the construction sequence/constraints for this project.

    B. The Contractor shall notify the Owner fourteen (14) days prior to beginning work

    on any existing process units which are in operation. When the Owner has turned the process unit over to the Contractor for modifications, the Contractor, at his own expense, shall remove the contents, as directed by the Engineer, and dispose of it off-site.

    1.24 REMOVAL OF WATER

    A. Before commencing any excavation at the site of the work, the Contractor shall submit to the Engineer for review, the methods, equipment, and arrangement of facilities proposed for the removal and disposal of water at the site and of all water entering any excavation or other part of the work from any source whatsoever. Adequate standby facilities shall be provided to ensure that the excavation will be kept dry in the event of power failure or mechanical breakdown. Facilities for the removal and disposal of water shall be of sufficient capacity to keep the excavation dry under all circumstances with one-half of the facilities out of service. If well points are used, provision shall be made for removing and resetting individual well points without taking the system of which they are a part out of service. The cost of removal of water shall be included in the unit quantity for each appropriate item bid.

    B. The Contractor shall implement all appropriate turbidity management practices at the point of discharge into a storm sewer, gutter, or other conveyance to ensure that state water quality standards are not violated at the point where the storm drain, gutter, or other conveyance discharges into a surface water.

    PART 1 GENERAL

    1.01 SCOPE OF WORK

    A. The Contractor shall furnish all equipment and labor materials required to provide comprehensive digital photographs and videos of the construction project.

    B. Photo and video files shall become the property of the Owner and none of the videos or photographs shall be published without express permission of the Owner.

    1.02 PRE AND POST CONSTRUCTION VIDEOS AND PHOTOGRAPHS

    A. Prior to the beginning of any work, the Contractor shall take videos and photographs of the project site, adjacent streets, roadways, parkways, driveways, curbs, sidewalks, landscaping, adjacent utilities and adjacent structures to record existing conditions.

    B. Following completion of the work, another set of videos and photographs shall be made showing the same areas and features as in the pre-construction videos and photographs.

    C. All conditions which might later be subject to disagreement shall be shown in sufficient detail to provide a basis for decisions.

    1.03 FILE FORMAT, MEDIA AND SUBMITTALS

    A. Photographs shall be in “jpg” format.

    B. Videos shall be in a format viewable by Microsoft Windows Media Player or Apple QuickTime Player. Audio narration is desirable.

    C. Files shall be named such that what is being viewed is self-evident.

    D. Files shall be submitted on an external hard drive, compact disk (CD) or a digital video disk (DVD). If submitted on DVD, disk shall be recorded in “Minus R” format.

    E. The pre-construction videos and photographs shall be submitted to the Engineer within 25 calendar days after the date of receipt by the Contractor of Notice to Proceed. Post construction videos and photographs shall be provided prior to final acceptance of the Project.

    A. This Section covers the cutting, coring, and rough and finished patching of holes and openings. Holes and openings may be in existing construction, or in parts of new construction. Procedures for cutting and patching will be the same for either condition.

    B. All cutting, coring, and rough patching shall be performed by the Contractor or specialty subcontractor. Finish patching shall be the responsibility of the Contractor and shall be performed by the trade associated with the application of the particular finish.

    C. Provide all cutting, fitting, and patching, including attendant excavation and backfill, required to complete the work or to:

    1. Make its several parts fit together properly.

    2. Uncover portions of the work to provide for installation of ill-timed work.

    3. Remove and replace defective work.

    4. Remove and replace work not conforming to requirements of Contract Documents.

    5. Remove samples of installed work as specified for testing.

    6. Provide routine penetrations of non-structural surfaces for installation of piping and electrical conduit.

    D. Patch, repair, and refinish existing items to remain to the specified condition for each material, with a workmanlike transition to adjacent new items of construction.

    1.02 SUBMITTALS

    A. Submit a written request to the Engineer well in advance of executing any cutting or alteration which affects:

    1. Work of the Owner or any separate contractor.

    2. Structural value or integrity of any element of the project.

    3. Integrity or effectiveness of weather-exposed or moisture-resistant elements or systems.

    4. Efficiency operational life, maintenance or safety of operational elements.

    5. Visual qualities of sight-exposed elements.

    B. Request shall include:

    1. Identification of the project.

    a. Scope of cutting, patching, alteration, or excavation

    b. Trades who will execute the work.

    c. Products proposed to be used.

    d. Extent of refinishing to be done.

    6. Alternatives to cutting and patching.

    7. Cost proposal, when applicable.

    8. Written permission of any separate contractor whose work will be affected.

    C. Submit written notice to the Engineer designating the date and the time the work will be uncovered.

    PART 2 PRODUCTS

    2.01 MATERIALS

    A. Comply with specifications and standards for each specific product involved. Where there is no equivalent specification, the Contractor shall notify the Engineer who will provide a specification for the materials to be used.

    B. Concrete and grout for rough patching shall be as specified in Division 03.

    C. Materials for finish patching shall be equal to those of adjacent construction. Where existing materials are no longer available, use materials with equivalent properties and that will provide the same appearance. The materials are to be approved by the Engineer prior to their use.

    PART 3 EXECUTION

    3.01 INSPECTION

    A. Inspect existing conditions of project, including elements subject to damage or to movement during cutting and patching.

    B. After uncovering work, inspect conditions affecting installation of products or performance of work.

    C. Report unsatisfactory or questionable conditions to the Engineer in writing. Do

    3.02 PREPARATION

    A. Provide adequate temporary support as necessary to assure structural value or integrity of affected portion of Work.

    B. Provide devices and methods to protect other portions of project from damage.

    C. Provide protection from elements for that portion of the project which may be exposed by cutting and patching work and maintain excavations free from water.

    3.03 PERFORMANCE

    A. Execute cutting and demolition by methods which will prevent damage to other work and will provide proper surfaces to receive installation of repairs.

    B. Execute excavating and backfilling by methods which will prevent settlement or damage to other work.

    C. Employ original Installer or fabricator to perform cutting and patching for:

    1. Weather-exposed or moisture-resistant elements.

    2. Sight-exposed finished surfaces.

    D. Execute fitting and adjustment of products to provide a finished installation to comply with specified products, functions, tolerances, and finishes.

    E. Restore work which has been cut or removed. Install new products to provide completed work in accord with requirements of Contract Documents.

    F. Fit work gastight to pipes, sleeves, ducts, conduit and other penetrations through surfaces.

    G. Refinish entire surfaces as necessary to provide an even finish to match adjacent finishes:

    1. For continuous surfaces, refinish to nearest intersection

    2. For an assembly, refinish entire unit.

    SECTION 01047 CONTROL OF WORK

    PART 1 GENERAL

    1.01 CONTRACTOR’S CAPABILITIES

    A. The Contractor shall furnish personnel and equipment which will be efficient, appropriate and large enough to secure a satisfactory quality of work and a rate of progress which will ensure the completion of the work within the time stipulated in the Agreement. If at any time such personnel appears to the Engineer to be inefficient, inappropriate or insufficient for securing the quality of work required or for producing the rate of progress aforesaid, Engineer may order the Contractor to increase the efficiency, change the character or increase the plant equipment and the Contractor shall conform to such order. Failure of the Engineer to give such order shall in no way relieve the Contractor of his obligations to secure the quality of the work and rate of progress required.

    1.02 PRIVATE LAND

    A. The Contractor shall not enter or occupy private land outside of easements, except by written permission of the Owner.

    B. When necessary to notify the property owner or tenant of any impact of construction activity, entry onto the land shall only be made by a Foreman, or more senior person, of the Contractor. All Foreman, and those ranking above Foreman, shall carry laminated photo identification cards bearing their name, position, Contractor name, and local day time and after hours phone number of the Contractor. This identification shall be produced, whether or not requested, anytime a Foreman or more senior person enters private land to communicate with the property owner or tenant.

    1.03 UTILITY LOCATIONS

    A. Utility locations were not determined during the design of this project. It is the responsibility of the Contractor to coordinate with utility companies to avoid conflicts with the existing utilities.

    1.04 OPEN EXCAVATIONS

    A. All open excavations shall be adequately safeguarded by providing temporary barricades, caution signs, lights, and other means to prevent accidents to persons and damage to property. The Contractor shall, at his own expense, provide suitable and safe bridges and other crossings for accommodating travel by pedestrians and workmen. Bridges provided for access to private property during construction shall be removed when no longer required. The length of open trench will be controlled by the particular surrounding conditions but shall always be confined to the limits prescribed by the Engineer. If the excavation becomes a hazard, or if it excessively restricts traffic at any point, the Engineer may require special construction procedures such as limiting the length of the

    open trench.

    B. The Contractor shall take precautions to prevent injury to the public due to open trenches. All trenches, excavated material, equipment, or other obstacles which could be dangerous to the public shall be well-lighted at night where such obstacles are readily accessible to the public.

    1.05 CARE AND PROTECTION OF PROPERTY

    A. The Contractor shall be responsible for the preservation of all public and private property and shall use every precaution necessary to prevent damage thereto. If any direct or indirect damage is done to public or private property by or on account of any act, omission, neglect, or misconduct in the execution of the work on the part of the Contractor, such property shall be restored by the Contractor, at his expense, to a condition similar or equal to that existing before the damage was done, or he shall make good the damage in other manner acceptable to the Engineer.

    B. All sidewalks which are disturbed by the Contractor's operations shall be restored to their original condition by the use of similar or comparable materials. All curbing shall be restored by the Contractor in a condition equal to the original construction and in accordance with the best modern practice. Full lengths of curbing shall be replaced. If concrete is not cut at a joint, it shall be replaced to the next full joint.

    C. Along the location of this work, all fences, walks, and other physical features including trees, bushes, and shrubbery, shall be protected and restored in a thoroughly workmanlike manner by the Contractor. Fences and other features removed by the Contractor shall be replaced in the location indicated by the Engineer as soon as conditions permit. All grass areas beyond the limits of construction which have been damaged by the Contractor shall be regarded and restored to their original condition.

    D. The protection, removal, and replacement of existing physical features along the line of work shall be a part of the work under the Contract, and all costs in connection therewith shall be included in the unit and/or lump sum prices established under the items in the Schedule of Prices.

    1.06 PROTECTION AND RELOCATION OF EXISTING STRUCTURES AND UTILITIES

    A. The Contractor shall assume full responsibility for the protection of all buildings, structures, and utilities, public or private, including poles, signs, services to buildings, utilities in the street, gas pipes, water pipes, hydrants, sewers, drains, process lines, electric and telephone cables, fiber, and data cables whether or not they are shown on the Drawings. The Contractor shall carefully support and protect all such structures and utilities from injury of any kind. Any damage resulting from the Contractor's operations shall be repaired by him at his expense.

    B. Protection and temporary removal and replacement of existing utilities and structures as described in this section shall be a part of the work under the Contract and all costs in connection therewith shall be included at no additional cost to the Owner.

    C. If, in the opinion of the Engineer, permanent relocation of a utility owned by the City is required and the relocation is not already noted on the Drawings, he may direct the Contractor in writing, to perform the work. Work so ordered will be paid for at the Contract unit prices, if applicable, or as extra work under the General Conditions. If relocation of a privately owned utility is required, the City will notify the utility to perform the work as expeditiously as possible. The Contractor shall fully cooperate with the City and utility and shall have no claim for delay due to such relocation. The Contractor shall notify public utility companies in writing at least 48 hours (excluding Saturdays, Sundays, and legal holidays) before excavating in any public way.

    1.07 MAINTENANCE OF FLOW

    A. The Contractor shall at his own cost, provide for the flow of all solids, liquids, gases, drains, water courses, etc., interrupted during the progress of the work, and shall immediately cart away and remove all offensive matter. The entire procedure of maintaining existing flow shall be fully discussed with the Engineer well in advance of the interruption of any flow.

    1.08 COOPERATION WITHIN THIS CONTRACT

    A. All firms or persons authorized to perform any work under this Contract shall cooperate with Contractor and subcontractors or trades and assist in incorporating the work of other trades where necessary or required.

    1.09 CLEANUP

    A. During the course of the work, the Contractor shall keep the site of his operations in as clean and neat a condition as is possible. He shall:

    1. Dispose of all residues resulting from the construction work and at the conclusion of the work.

    2. Remove and haul away any surplus excavation, broken pavement, lumber, equipment, temporary structures, and any other refuse remaining from the construction operation.

    3. Shall leave the entire site of the work in a neat and orderly condition.

    1.10 CONTRACTOR'S RESPONSIBILITY TO SUPPLY MATERIALS AND PERFORM WORK AT HIS EXPENSE

    A. An attempt has been made while writing this Specification to state the Contractor's responsibilities for supplying materials and performing work under this Contract.     SECTION 01050 FIELD ENGINEERING

    PART 1 GENERAL

    1.01 SCOPE OF WORK

    A. Provide and pay for field engineering services required for project.

    1. Civil, structural, or other professional engineering services specified or required to execute Contractor's construction methods.

    B. Retain the services of a registered land surveyor licensed in the State of Alabama:

    1. Identify existing control points and property line corner stakes indicated on the Drawings, as required.

    2. Verify all existing structure locations and all proposed building corner locations, tank locations, and equipment locations.

    3. Construction stakeout.

    4. Maintain an accurate location of all buried piping.

    1.02 SUBMITTALS

    A. Submit, in accordance with Section 01300, name and address of registered land surveyor or professional engineer.

    B. On request of the Engineer, submit documentation to verify accuracy of field engineering work.

    C. Submit certificate signed by registered engineer or land surveyor certifying that elevations and locations of improvements are in conformance, or non-conformance, with Contract Documents.

    D. At the end of the project, and prior to final payment, submit certified drawings signed and sealed by the registered land surveyor of the items listed below. All surveys shall be tied to State Plane Coordinates. Vertical Control shall conform to project benchmark. These drawings shall be included with, and made a part of, the project record documents.

    1. Certified site survey at 1-in = 20-ft scale or larger but not greater than 1-in = 20-ft scale, on reproducible mylar 24-in by 36-in, indicating the building corners, sidewalks, paved areas and location of all above ground structures within the project site.

    2. Certified drawing showing the location, lines and grades in Plan and Profile views of all lines buried and exterior to buildings and other buried facilities (e.g. valves, tanks, vaults, etc) installed as a result of the work. This shall be at the same scale as the Engineer's yard piping drawing and submitted on

    3. Certified survey at the same scale as the Engineer's line drawings (e.g. sewer, force main, water transmission, etc) indicating lines, grades, elevations and stationing at 100-ft increments. Provide elevations of structure bottom, pipe invert(s) and rim elevations on all manholes.

    E. Topographical surveys shall meet the following criteria:

    1. 1-in = 100-ft scale reproducible plot, 2 foot contours.

    2. Produced on national map accuracy standards for 1-in = 100-ft scale maps with 2 foot contour intervals

    3. Contractor shall submit computer generated drawing files in AutoCAD Release format on CDs. All entries shall be place on layers meeting the requirements of the Owner and Engineer. All elevation information in the AutoCAD file shall be in an appropriate three dimensional format. A digital terrain model (DTM) AutoCAD file containing adequate three dimensional points and break lines to accurately model the surface shall be submitted. The DTM file shall be compatible for use Land Desktop.

    F. Survey shall include all the requirements as outlined in Paragraph 1.06 below.

    1.03 QUALIFICATIONS OF SURVEYOR OR ENGINEER

    A. Registered professional engineer or land surveyor of the discipline required for the specific service on the project, currently licensed in the State.

    1.04 SURVEY REFERENCE POINTS

    A. Existing basic horizontal and vertical control points for the project are those designated on Drawings.

    B. Locate and protect control points prior to starting site work and preserve all permanent reference points during construction.

    1. Make no changes or relocations without prior written notice to the Engineer.

    2. Report to the Engineer when any reference point is lost or destroyed or requires relocation because of necessary changes in grades or locations.

    3. Require surveyor to correctly replace project control points which may be lost or destroyed.

    a. Establish replacements based on original survey control.

    1.05 PROJECT SURVEY REQUIREMENTS

    A. Establish a minimum of two permanent benchmarks on site, referenced to data established by survey control points.

    01110 – 1 Environmental Protection Requirements

    SECTION 01110 ENVIRONMENTAL PROTECTION REQUIREMENTS

    PART 1 GENERAL

    1.01 SCOPE OF WORK

    A. The work covered by this Section consists of furnishing all labor, materials and equipment and performing all work required for the prevention of environmental pollution in conformance with applicable laws and regulations, during and as the result of construction operations under this Contract. For the purpose of this Specification, environmental pollution is defined as the presence of chemical, physical, or biological elements or agents which adversely affect human health or welfare; unfavorably alter ecological balances of importance to human life; affect other species of importance to man; or degrade the utility of the environment for aesthetic and/or recreational purposes.

    B. The control of environmental pollution requires consideration of air, water and land, and involves management of noise and solid waste, as well as other pollutants.

    C. Schedule and conduct all work in a manner that will minimize the erosion of soils in the area of the work. Provide erosion control measures as necessary. All erosion control measures shall be in place in an area prior to any construction activity in that area. Specific requirements for erosion and sedimentation controls are specified in Section 02270 and the Drawings.

    D. The Contractor will not be allowed to use any of the City's permitted outfalls at the wastewater treatment plan for disposal of his/her wastes.

    1.02 APPLICABLE REGULATIONS

    A. Comply with all applicable Federal, State and local laws and regulations concerning environmental pollution control and abatement.

    B. Comply with all permit requirements provided in Section 01010.

    1.03 NOTIFICATIONS

    A. The Engineer will notify the Contractor in writing of any non-compliance with the foregoing provisions or of any environmentally objectionable acts and corrective action to be taken. State or local agencies responsible for verification of certain aspects of the environmental protection requirements shall notify the Contractor in writing, through the Engineer, of any non-compliance with State or local requirements. The Contractor shall, after receipt of such notice from the Engineer or from the regulatory agency through the Engineer, immediately take corrective action. Such notice, when delivered to the Contractor or his/her authorized representative at the site of the work, shall be deemed sufficient for the purpose. If the Contractor fails or refuses to comply promptly, the Owner

    may issue an order stopping all or part of the work until satisfactory corrective action has been taken.     1.04 IMPLEMENTATION

    A. Prior to commencement of the work, meet with the Engineer and Owner to develop mutual understandings relative to compliance with these provisions and administration of the environmental pollution control program.

    B. Remove temporary environmental control features, when approved by the Engineer and incorporate permanent control features into the project at the earliest practicable time.

    PART 3 EXECUTION

    3.01 PROTECTION OF STREAMS AND SURFACE WATERS

    A. Care shall be taken to prevent, or reduce to a minimum, any damage to any stream from pollution by debris, sediment or other material, or from the manipulation of equipment and/or materials in or near such streams.

    B. All preventative measures shall be taken to avoid spillage of petroleum products and other pollutants. In the event of any spillage, prompt remedial action shall be taken in accordance with a contingency action approved by the Alabama Department of Environmental Management. Contractor shall submit two copies of approved contingency plans to the Engineer.

    C. Water used in hydrostatic or performance testing shall be disposed of in a manner approved by the Alabama Department of Environmental Management and all other applicable regulatory agencies.

    3.02 PROTECTION OF AIR QUALITY

    A. Burning - The use of burning at the project site for the disposal of refuse and debris will not be permitted.

    B. Dust Control - The Contractor will be required to maintain all excavations, embankment, stockpiles, access roads, plant sites, waste areas, borrow areas and all other work areas within or without the project boundaries free from dust which could cause the standards for air pollution to be exceeded and which would cause a hazard or nuisance to others.

    C. An approved method of stabilization consisting of sprinkling or other similar methods will be permitted to control dust. The use of petroleum products is

    prohibited.

    D. Sprinkling, to be approved, must be repeated at such intervals as to keep all parts of the disturbed area at least damp at all times, and the Contractor shall have sufficient competent equipment on the job to accomplish this if sprinkling is used. Dust control shall be performed as the work proceeds and whenever a dust nuisance or hazard occurs, as determined by the Engineer.

    3.03 MAINTENANCE OF POLLUTION CONTROL FACILITIES DURING CONSTRUCTION

    A. During the life of this Contract, maintain all facilities constructed for pollution control as long as the operations creating the particular pollutant are being carried out or until the material concerned has become stabilized to the extent that pollution is no longer being created.

    3.04 NOISE CONTROL

    A. The Contractor shall make every effort to minimize noises caused by the construction operations. Equipment shall be equipped with silencers or mufflers designed to operate with the least possible noise in compliance with Local, State and Federal regulations.
