Bridgeport Chamber of Commerce. Durinq World War 1% he
served as Chafrman of the War Bonds Drive and Lieutenant

as Senatorial Committeeman for four years fn the 23rd
District. He and his wife Agnes have two married
chfldren, a son Willtam and a daughter Venita and five

3002 actùally represents House Bill 2939, which was
to have been a Committee Bill in Counties and Townshfps
but was introduced too late for consideration for that
order of business. That's the rationale for Amendment
//1. to House Bill 3002: sponsored' by Representative
Rfchmoads ft provfdes for a one tiae supp.lemental five
cent tax for public lfbraries subject to' provisions of t e
backdoor referendum. Presently publfc libraries may tax
up to fifteen cents wfthout a referendum and up to forcy
cents wfth a full referendum. Approximately bne half

with 10Z or 1500 voterss whichever is less, requesting th
'action to the Library Board to be submitted to the
voters at the next general election. This Amendment
satisfies the objection raised by the Governor in vetoing
House Bill 605 in the last Sessfon of the General
Assembly. Ihe supplemental five cent tax levy and the
additional levy would be ditficult for the electorate
to understand and follow. The Governor also mentioned
that 50Z of the statels public liabraries would not be
affected by House Bill 605 because their levy was less
than 15 cents. Additionally, public libraries in
Illinois have received less state funding through the
library systems in the past three fiscal years. This
Amendmeat will give a small amount of relief and
additional income to those libraries with the fnnovative
and outstanding programs that have been expanded even
though state poniep have decreased. I urge favorable
support of Amendment //1 of House Bill 3002.11

are going to spend what funds are available: if we are
in fact going to end up cuttfng other budgets fn order
to find money for education, it 'seems to me...it seems
to me totally and completely in error Jn our part to add

out of the Dangerous Drug Commission, when we are cutting
the Commfssfon on Human Relations and when we are cutting

real estate right now. This Legislature in its wisdom

In 1977 it went down further to a 37.5 of that full
50Z reimbursement. In 1978 it dropped to 32.6 of the
full 50Z reimbursement. And the projection for 1979 is
that it will drop to 31.6 of the full 50Z refmbursement.
Thfs means...thfs means fntthe hfgh prforty of 1a* and
order either you don't get funding for your muafcipalities
in terms of their need for police trainingy you have
incompletely trained pblice on the street or you vill
be hit in your personal poeketbook in your community in
terms of this need. Now this is a delayed effect that I
am warning a11 of us here. zlhe delayed effect is this
you will get the repescussions if we donlE put thts on.

of the Amendment is apparently quite hypoeritical over the
means ih which he attacks the budget this year. In a11

and al1 of a sudden we have a one million dollar
addittoa under q ytsnomer because there fs no. mandate
that this be 50Z funded. The statute clearly indfcates
that the mandate is fpr the program but the funding can

this one million dollars thfs year would be highly
fiscatly irresponsible and Iêm surprised that the Members
from that side of the aisle is continually voting to cut
budgets would put money'in this amounty in this.fashion,

fourteen thousand policemen and give them specialized

going on, mouth-to-mouth resuscitation, in case a police
officer comes upon someone who has a heart attack.

I know how the money is spent. Chicago Police Department
is constantly hiring new policemen under Federal Court
Orders. They must hire policemen. They have to take
some of these policemen 'they are hiring and give them!!remedlal reading courses. They have to come in at seven i
o'clock in the morning and take remedial reading courses,
a fifth grade course, so they need thls money. This is
where the money is going: and I urge you to defeatI

Comm4ttee; briefly speaking, this legislation pertains to the
fnsurance industry and, in particular, this would permit the I1-
linois Department of Insurance to have one of the most comprehea-
stve and most streamlined rating Bflls or laws in the nation.!
Currentlys Illfnois is the only state in the United States that
does not have any regulation over the automobile insurance in-
dustry. And this certainly gives the opportunity to tbe Depart-
ment of Insurance to go in to these compaaies and to deLermine
whether rates are fair, that there is not discrilination occurring,
that there are other areas of protection which the individuals E
can'obtain. The Committee of which this Bill came before and I
brought it to your attention in a form of a letter about two weeks
ago that we only recefved three negatfve votes from a nfneteen
person Committee. The Committee, 1 will admit, gave us a fair ;
- . opportunity. T wish there would have been a larger attendance
at tîe meeting and possfbly we may have come closer to passing
tbe Bi11 but the Committee was very fair. Wefve been workfng '
on the subject for over a year. I feel the people of Illinois '
certainly deserve protection in this area and I know that the
Department of Insurance helped draft the Amendment which is the
Bf11 currently. And they fully endorse this proposal. Mr.
Richard Mathias testified in favor of this proposal and you kno.

Kelly has been before our Committee and I know he d1d not tell you
that he didn't receive hearings because he did and I appreciate
that fact. This Bill was heard on several occasions. It was

completely a different Bill whea it began and he most clearly told
I you that he... it is now the Bf11 that the Director of Insurance
had fndicated that he would like to have. The Bi11 was fully
heard before the Commlttee and the Commfttee has attehded not only
meetings of the Commn'ttee but many semfnars which has indfcated
to us a surprising thing, at'least so far as I have been concerned.
I came on to that Commlttee and I had personally believed for years
that one of the thfngs that we needed most of al1 in Illinois was
a Ratfng Control Bf11. I have been very, very surprfsed to learn
that Illinois by virtue of our present system where we have com-
petition and only competition that governs the rates in Illinois
has fn comparison with the other states and especially other states
of a comparable nature where we have the rurul-urban mix that we
have, the population groups that we bave and higb concentration
of population fn various areas. Illinoisî rates on àlmost a11 in-
surance areas that would be covered by such a ratfng Bi11 are com-
parable or lower than most of these other states. And in addition,
Illinois has the greatest availability of insurance to its citf-
zens of any of these states and almost any state fn the Union.
This has been very surprising to me. Consequently, I do stand
in opposftion to Representative Kelly's motion, but for any rea-
son he has no rfght to brfng it here. I ask you to listen to him
very carefully and make your own decision upon the facts of the
case and upon the' good of the insurance industry and the consumers
in the State of Illfnoisv Thank you.''

type of an instance, listen to the judgment of that Comml-ttee. I
think I might add that we dtd have a Bill this past week in this
Committee in which an Amendment was offered to do basically the
Isame thiag that Representative Kelly's Bill would have done and
that Amendment and the Bill were rejected. So I think this is
fndicative of the hearfngs that were held aad the evideace pre-
sented and I feel that it would be duplicative and in a way: waste-
ful of the House's time kf we had to take this up al1 over again.

on them aren't worth the paper theyrre written on because they
have hever been certifled. I submit also that there's awple evi-

of the nation. As a matter of fact. when Dlrector Mathias who I
wants tîts Bill and who is sômetimes misguided - that can happen
in a Republican administration - the fact remains that Representa-
tive Mathias admitted that by their own survey, our rates were
lower than comparable states. And when asked why he needed tbis
information or needed this Bi11, hfs response was, 'Well, just fn
case.' In other words, we have machinery thatls workings but we
should have something just in case ft gets broken. Ffnally. I
would sûbmft to you that in the states where thère is regulation,
the price increases are much higher than those in Illinois. Nhen
my colleagues speak of redliningy they are right. When my colleagues
speak of arbltrary ïnsurance practicesy they are right. But whea
they suggest that by giving the authority to the Dikectory there
will be a rate reductiony you are kidding. And 1et me give youo.s''

to one of the last speakers that they always talk about the Direc-
tor of Insurance. But whether weVre talkfng about this Director ,I
or any other Director, we find out that these Directors are a11
born of fnsurance. When they retire from tbe job, they go back
to insurance. And one of the questions we really ought to ask is,
''Who do they serve while they're here on the Job?' I think Mr.
Kelly is directly in point and I thfnk only when we as a group,
we as a Body decide to look into these matters and no longer teave
ft to those Select Commltteesy we are then going to have a little
bit of insurance justice and fair play in the State of Illinois

move that the House discharge Judiciary I Committee and advance
to the Order of Second Reading House Bill 1333- This B11l deals
with the subject of products llability and fts current form as
amended in Committee contains only the statute of repose. Now
the statute of repose fs a form of the statute of limitatfons.
The tBi1l was heard last evening fn the Judiciary I Commfttee and
uafortunately due to the long hearings that were involved fn the
legislation before the Comnittees it fs my opinion that two of
our 'yes' votes were unable to be there at the time that the Roll
Call was heard. The Roll Calt on the do pass motion was ten to
eleven, taking twelve votes to come out of Committee and tgo of
our anticipated 'yes' votes were not present in Commfttee at the
time. If they had been and if the matter had been called earlier,
I think that we would have been able to bring this matter out of
Committee. Basically what 1'm saying by this motion is, llet's
not kill continued dfscussfon in the House on the subject of pro-
duct liability. Let's contfnue to debate it, brfng ft to the 0r-
der of Second Readfng so that we can contfnue our discussions re-
latfng to the statute tof repose.' Now youvre gofng to hear a
1ot of discussion on the question of the statute of repose. Some-
one's going to tell you that the products liability problem is an
fnsurance problem. Someone else is going to tell you that ve
don't need a statute of repose. And someone else is going to tell

House. I rlse in opposftion to the motion to discharge House Bill Il1333 from the Judiciary I Commfttee. By way of backgroundy House I
Bill 1333 was fntroduced and referred to a Subcommittee of the Ju-
diciary I Commlttee almost one year ago. That Subcommittee of
whfch T was the Chairman and chfch the other Members were Repre-
sentative Schlickman, Representatfve Lefnenweber, Representative
Hart and Representative Getty, heard voluminous testimony on the
entire subject of products liability over a period of several pub-
1fc hearings held throughout the sumcer and finalized a reports
a copy of whfch has been sent to each Member of the General Assembly.
It was the unanimous finding of the Subcommittee that there was
no evidence which warraated aay substantiat change in the Iltinois
existing tort system. Nowy the Subcommittee recommended three
. Bills. Those Bills are now on Second and Third Reading fn this
House which address themselves to this serious issue of products
lfabilfty fn thfs seate. Those Bllls refer to data cellection
authority and rate review authority in the Department of Insurance
so that we can assist the business community in the State of 11-
llfnofs which has been plagued by sharply increasing premiuos for
thefr product liabillty coverage. Last night in the Judiciary I
Cowmtttee, this Bill was considered by the full Coc>ittee. It
did not fail because Meabers were absent. It failed because there
were eleven negatfve votes. Now the issue was thoroughly debatedy
b0th pro and con. Xhe findings of the Subcopmittee have been af-
firmed, in effect, by the full Commn'ttee. The full Commlttee bas
found House Bi11 1333 wanting. Now I suggest to you that wha: we
are talking about on the sublect of products liability is an ex-
tremely complex sublect. One that does not lend itself to sim-
plfstic : solutlons or to sfmply impassfoned rhetoric which does
not address the issue. This House has attempted through its Com-
mfttee system to address this fssue responsfbly and dfllgently
and has done for a period of the past year. To say on the floor

the issue is to inaccurately assess what the situation fs and what
the work of the Membership of the Judiciary Committee and the Sub-
committee has been. There are three Bills here. There are three
Bflls that we feel based on the evidence presented to us over a
perfod of one year, those three Bills are the reasonable way to
proceed. Now as is proposed in House Bill 1333 which would simply
and arbitrarily cut off the rights of fnjured victfms to bring a
lawsuit for damages for the injury that they have sustained. Now
House Bill 1333 does not guarantee, fn fact, does even... does n'ot
even contafn an assurance that it will provide any benefit what-
ever to the business community of this state as far as its pre-
mium fncreases for this type of insurance. Now, Ladies and Centle-
men'; on balance this motion is ill-founded. I ask you to vote 'no'
on the motion to discharge and to afffrm the work b0th of the Com-
mfttee itself and of tbe Subcommittee of the Judiciary I Committee.

it is to establfsh natfonal standards. What we do in Illinofs is
going to affect Illinois citizens. It's going to take away rights
of the people of Illfnois. Howevery there will be no correspondfng

distributors are actually sold or remalned tn Illfnois. And that
means, Ladies and Gentlemen. that you'd only be affecting at most
tea percent. What this would do was bar actioas after tea years.
That means a very small fraction of a percent of possible premium
reductfon, maybe one percent at best, would be achieved. But: in
fact, the proponents in the insurance industry can't even assure
us that. They will not say and cannot say that any insurance re-
duction would be forthcoming. What fs seriously needed are broad
natfonal standards to set down and possibly a reinsùraace program
by the Federal Government that would be meaningful, that would help
Illinois manufacturers and that would help people and manufacturiag
and industry throughout this country. And I suggest to youy Ladies
and Geatlemea. that tNfs motion is very fll-founded. lt will not
do what it purports to do- You are puttfng the Lefgslature fa the
posture of giving easy answers when : there are not easy answers.

Utilities.on House Bill 2949 and place it on the calendar i

qriticizing the Committee at all. The Bi11 had a fair
hearing, but the full Committee was not present and this is i
a demonstrable emergency and I think a11 of us would want
to be recorded on this Bi11. A brief explanatfon. ThisI
Bf11 would allow tenants in a master-metered apartment
buflding.to take a11 the utilfty payments, fn thefr own
namesy before the utility company terminates their account
for the landlordls nonpayment. The tenants would not be
liable for the amount past due on the landlord's account
and could deduct the utility payments from the rent owed
to the landlord. This Bill would benefit everyone. It
will benefft everyone. lt is not anti-utility. It will
' benefft the utilfty company vho would contlnue to recefve
the revenue from the building. It would benefit the
tenants who would not be forced to move because the
utilities have been terminated. It wfll the landlord who
would not be left with an abandoned building with pipes
bursting and boilers bursting. And 1et me say finally:
that I went with the Insurance Commission and Committee
a11 through the districts up there and I saw abandoned
bufldings wfth windows torn out and doors torn down. And
somebody said if this Bill Passed in the Committee that
a 1ot of Madison Street Bumsv..and so forth. Let me tell you as cold
as it was last winter, nobody could stay in one of these
abaadoned buildings. Everybody loses because...even the
insurance company loses when the buildfng is set on fire
and burned down. I say a11 of us ought to have a chance
