A type of Intellectual Property

Granted for an invention for product or process

Patents are granted under the law of the land – There is nothing as Global or World-wide Patent currently

Offers monopoly rights to produce, market and prohibit others from doing the same (for patented invention)

20 years protection period from the date of filing of patent application

Patents are granted by patent offices after publication and

substantial examination of the applications

In India provisions exist for pre-grant and post grant

opposition by others

Patents are valid within the territorial limits India

Foreigners can also apply for patents

Until recently (March 2013), US had ‘First-to-Invent’ clause for patent, now as per common practice, moved to

PCT – Patent co-operation Treaty (Under WIPO)

PCT was done in 1970 in Washington

PCT application can be filed in 148 countries

Filing application in various countries through PCT

1 millionth application filed in 2004, next 1millionth in 2011

Only decline in Patent applications through PCT was in 2009 (Global slow down)!

Chapter 2 Sec 3. a an invention, that is frivolous or that claims anything obviously contrary to well established natural laws Machine giving more than 100% performance Perpetual motion machine Newton’s laws of gravitation

Chapter 2 Sec 3.b a machine whose primary or intended use or commercial exploitation of which could be contrary to Public order or morality or which causes serious prejudice to human, animal or plant life or health or to the environment device for house-breaking Biological warfare material or device

Chapter 2 Sec 3.c mere Discovery of a Scientific Principle or Formulation of an Abstract Theory or discovery of any living thing or non–living substance occurring in nature

Discovery – disclosing/finding something, not seen before

Archimedes Principle Not patentable

Invention – an action resulting in a new product or new process

Using Archimedes Principle and making a Ship – can be patented

What is not patentable?

Chapter 2 Sec 3.d the mere discovery of a new form of a known substance which does not result in the enhancement of the known efficacy of that substance OR the mere discovery of any new property or new use for a known substance OR of the mere use of a known process, machine or apparatus, unless such known process results in a new product or employs at least one new reactant For the purposes of this clause salt, esters, ethers, polymorphs,

metabolites, pure form, particle size, isomers, mixtures of isomers, complexes, combination and other derivatives of known substance shall be considered to be the same substance, unless they differ significantly in properties with regard to efficacy

Chapter 2 Sec 3.e a substance obtained by mere admixture resulting only in the aggregation of the properties of the components thereof or a process for producing such substance

Adding Salt and sugar and making a paste which taste sugary and salty taste (admixture) without any additional property

Used in Ever-greening of patent, not allowed in India

a mixture resulting in synergistic properties of mixture of ingredients e.g. lubricant

Chapter 2 Sec 3.j plants and animals in whole or any part thereof other than micro- organisms, but including seeds, varieties and species and essentially biological process for production or propagation of plants & animals Clones and new varieties of plants: A process for production of plants or animals if it consists entirely of natural
