The Risks – How to Mitigate
• EPC Contractors are responsible for management of all aspects of EPC delivery, including Transport subcontractor performance
• Transport risks can potentially sink an EPC project on both schedule and cost (*)
• Whilst an adequate Force Majeure clause is a must, it will not shield an EPC Contractor from Transport Subcontractor sub-performance or negligence.
• Engaging proven Transport carriers, experienced in the specialised field of ‘heavy lift’ transport of major electro-mechanical capital equipment, is the best form of mitigation
(*) - Integrated ‘Cradle to Grave’ Approach ie R&D -> Heavy Load Installation onto foundation
- Interface management of both technical and commercial aspects from a single source

The Risks – How to Mitigate Commercial Risk
• Marine Cargo Insurance - ensure adequate coverage of risk - a poor policy does not necessarily represent ‘value’
• Customs Duties:
• Make sure EPC contract is clear on terms of delivery (Incoterms etc); who is responsible and who pays customs duties; who is importer of note; who organises customs clearance; approach to EPBS.
• Engage experienced consultants to advise on and manage any requirements under EPBS (as appropriate); and understand any possible need for trans-shipment
