•On August 3, 2008, 49-year-old investment banker Robert Post died in a motorboat accident on the Metedeconk River that also injured two passengers. Post’s boat was struck at 1 a.m.by a 27-foot Imperial speedboat driven by Anthony DiGilio, a 33-year-old construction worker. DiGilio, who was charged with vehicular homicide and two counts of assault by a vessel, faced up to 10 years in prison if convicted. In his defense testimony, he said that he believed he had hit a log or a buoy - not another vessel - and did not remain at the scene or immediately report the incident.

•The trial lasted three weeks, and the jury only took two hours to return a not-guilty verdict. Prosecutors were unable to prove that DiGilio acted recklessly on the water and how fast the boat was traveling, which were both crucial elements for their case. The state was also unable to provide details about what the defendant did after the crash, which also convinced the jury to side with the defense.
