Last Will
Expresses your desires for the handling of your financial and personal affairs when you die
Describes how you want your assets to be distributed to your heirs upon death
Ensures that your loved ones receive what you want them to receive, not just what the court thinks they should receive

A Last Will allows you to…
Appoint a personal representative (executor) who will be responsible in handling your personal and financial affairs after your death
Choose a guardian to care for and raise your minor children
Leave your property to your spouse in a way different from what the state intestacy law provides
Add beneficiaries who are not legal heirs, such as step-children

Living Trust
Clearly states your wishes of your assets at the time of your death
Makes your assets easier to distribute at your death

A Living Trust allows you to… Provide for someone else to take care of your
estate in the event of your disability or incapacity without the involvement of costly, time-consuming probate court
Provide for beneficiaries with special needs, or delay the inheritance of your estate until the beneficiaries reach a certain age, or have your estate distributed in installments
Avoid many of the risks of liability associated with joint ownership, including protection from any claims of the creditors of your heirs

Health Care Power of Attorney Provides for your medical well-being in the
event of your inability to make decisions concerning your medical treatment or health care due to illness, accident or injury
Leaves specific instructions for the level of care you want to receive
Provides the ability, if desired, to authorize the withholding of life-sustaining treatment if you are in a coma or a “persistent vegetative state”

A Health Care POA allows you to… Name someone to be your “agent,” the
person who can make decisions about your medical treatment and health care in the event you become unable to participate in medical treatment decisions, including: Provide for residential care Have access to your medical records Employ health care personnel Give or withhold consent to treatment Refuse treatment contrary to your wishes Release physicians, etc. from liability Make anatomical gifts upon your death Provide for pain relief therapies

Financial Power of Attorney
Provides for your financial well-being in the event of your inability to manage your financial and business affairs because of disability or incapacity, now or in the future
Can be done in anticipation of a future need, for a special purpose, or for a limited time

A Financial POA allows you to… Name someone as your “agent” giving
them the power to manage your financial affairs, including the ability to: Pay your bills, deposit checks, and deal with
banks on your behalf Sell, manage, or reinvest your property Sign contracts, borrow money, or change
investments on your behalf Pursue insurance claims and legal actions to
enforce your rights File tax returns, obtain insurance coverage, or
apply for government benefits for you Transfer property to your living trust
