Subject: -Invitation of E-Tender for “Providing Canteen Services” at ESIC Model Hospital,

Medical Superintendent, ESIC Model Hospital, Laxmi Nagar Sodala, Jaipur, Rajasthan invites E-Tenders

Important Instructions for Bidders
All bidders/contractors are required to procure Class-IIIB Digital Signature Certificate
(DSC) with Both DSC Components i.e. Signing & Encryption to participate in the
E-Tenders.

IMPORTANT INSTRUCTIONS TO THE TENDERERS
1. The amount of earnest money deposit (EMD) shall be Rs. 50,000/- (Rs. Fifty Thousand only) in
the form of DD/Pay Order, drawn in favor of ESIC payable at SBI Jaipur “ESIC Fund A/C no-1”. It
should remain valid for a period of six months from the last date of submission of the tender. No
interest is payable on EMD. The EMD shall be adjusted towards performance security deposit in
case of successful tenderer.
2. Tenderer Should submit hard copy of EMD at ESIC Model Hospital Jaipur before last
date and time of submission of Tender i.e. 13.02.2019, 11.00 Hrs.
3.Tender form shall be complete in all respect. Incomplete or tenders without EMD shall be
treated as invalid.
4.Last date of submission of tender is 13.02.2019.
5.Date and time of opening of tender is -:

6.Each and every page of the tender documents should bear the stamp and signature of the
authorized representative of tenderer in acceptance of the terms and conditions laid down by
ESIC. All Formats shall be filled without exception. The tenderer shall also enclose the latest
Income Tax Clearance Certificate and proof of VAT/works Contract Tax/ GST Registration
where applicable. All entries in the tender form should be legible and filled clearly.
7. The site for the work is available and can be seen on any working day during office hours by
contacting Care taker/Authorized person of , ESIC, Model Hospital, Jaipur, Rajasthan.
8. The Competent Authority of ESIC i.e Medical Superintendent ESIC Model Hospital, Jaipur ,
reserves the right to accept or reject/relax any terms/condition of tender without assigning any
reason.
9. Conditional tenders are liable to be rejected.
10. The tender for the work shall remain open for acceptance for a period of Ninety days (90)
from the date of opening of tender.
11. The EMD of unsuccessful tenderers shall be refunded within one month after the award of
work to the successful tenderer.

12. No tenderer will be allowed to withdraw after submission of the tender within the bid
validity period otherwise the EMD submitted by the tendering firm would stand forfeited.
13. In case of successful tenderer declines the offer of contract, for what so ever
reason/reasons tenderer’s EMD will be forfeited.
14. The tenderers shall quote for all items failing which the bid shall be considered non-
responsive. Tender incomplete in any form will be rejected outright.
15. For finalization of the contract the tenderer whose rates given in the financial bid, are the
lowest in comparison to other tenderers will be considered as the lowest tender.
16. The successful tenderer shall have to deposit performance security deposit (PSD) of Rs.
1.0 Lacs (One Lacs only) within two weeks after award of contract, by way of a draft payable at
Jaipur in favor of “ESIC Fund A/C No. 1” with validity of 2 months beyond the completion of
contract otherwise the contract will be cancelled and EMD will be forfeited.
PSD shall be refundable without interest. Any amount which is payable by the contractor to the
employer on any account of a cause arising out of the contract may be adjusted against P.S.D.
17. Incomplete, conditional, telephonic bids or tender received after due date and time will
not be considered and summarily rejected.
18. Rate quoted shall be firm and fixed and are inclusive of cost of manpower, material,
machinery, tools and plant etc. in the relevant item.
19. Rates quoted by the contractor shall inclusive of all taxes, duties and levies, insurance,
G.S.T. etc .No escalation of whatsoever nature shall be payable. Any increase in
taxes/levies/rates imposed by state or Central Government or local authorities on
components/raw materials or installations as a whole or part after the submission of bid and
during the contract, shall not be paid by the department.

FACILITIES TO BE PROVIDED BY ESIC MODEL HOSPITAL JAIPUR
1. Rent free space including dining hall and kitchen area.
2. Electricity and water at free of cost.
3. Furniture and equipment’s as listed in Table-A.
Note:-
1. Contractor shall use electricity and water judicially. In case of any miss use of water and
electricity noticed by Hospital Authorities, a penalty as per decision of Medical
Superintendent shall be imposed and that shall be binding for contractor.
2. Inventory of furniture and equipment’s shall be handover to Contractor by Hospital
Authorities in working conditions. Contractor shall use all equipment’s and furniture
carefully. Any damage/fault in any equipment/furniture during contract period shall be
responsibility of Contractor. Contractor shall handover all the equipment’s/furniture back
to Hospital Authorities at the end of contract period in working condition. In case failure
in above, Hospital Authorities may recover the cost involved to make functional the
equipment from security deposit that may be equal to the cost of that particular
equipment at the time of end of contract period.
ELIGIBILITY CRITERIA
1. The tenderer should have minimum two years’ experience as on 31.03.2018 in field of
providing canteen Services in a Govt. Hospitals (State Govt/Central Govt /PSU /
Autonomous body) having minimum of 300 beds.
OR
The tenderer should have minimum two years’ experience 31.03.2018 in field of providing
canteen Services in any Govt. Institution like Government Colleges or Government Offices.
2. The Bidder should not be under declaration of ineligibility for corrupt and fraudulent
practices or any other reason whatsoever, or have not been black listed by Govt. of India or
any of its agencies including Public Enterprises and/or by any State Govt. or any of its
Agencies.
3. The Bidder should not have been convicted of any offences under any Labour Laws.

OTHER TERMS AND CONDITIONS
1. The Contractor shall run the canteen for the benefit and use of the employees of ESIC Model
Hospital and the patients and their attendants visiting this Hospital exclusively in the
aforesaid premises.
2. The contractor shall bear all the expenses for running the said Canteen and this hospital shall
not in any manner be liable to reimburse the expenses so incurred.
3. The Contractor shall keep the canteen open and render all the necessary services, sale of
eatables, tea etc., from 8:00 AM to 10:00 PM on all normal working days including Sunday
and other holidays, If so desired by this hospital.
4. The Contractor shall serve the supply for sale of articles as mentioned in the schedule of
items or any other articles which may be decided subsequently by the Medical
Superintendent or the Officer authorized by him at the rates specified by the canteen
committee to the Contractor.
5. Tenderer should submit the signed copy of Tender Document (Technical Bid only, with all
documents desired in technical bid) along with EMD at ESIC Model Hospital Jaipur on
before last date of submission of Tender Document. The documents should be in a sealed
envelope and bear the name “E-Tender for “Providing Canteen Services” at ESIC Model
Hospital and Staff Quarters, Jaipur (Rajasthan)”. The envelop shall be addressed to:-

a. The envelope shall indicate the name and address of the bidders to enable the bid to
be returned unopened in case it is declared ‘late’ or rejected.
b. Tender may be sent by Registered Post/ Speed Post/ Courier or delivered in person.
The responsibility for ensuring that the tenders are delivered in time would rest with
the bidder.
6. The Hospital will provide free water for washing of the utensils, and free electricity for
general illumination, refrigeration and aeration of the kitchen / canteen / store, but no
electricity will be permitted for cooking.
7. The Hospital will provide suitable space for Kitchen & eating within the hospital campus.

8. The services of the canteen staff will be at the disposal of the staff of this hospital including
Doctors, other Officers, Nurses, etc. and bona fide visitors. The users of the canteen shall be
paying for the services directly to the Contractor.
9. The contractor selected for canteen service, will be required to maintain highest level of
cleanliness and standard of hygiene with regard to the persons under his employment and
utensils for serving the food.
10. The personnel appointed by the tenderer must have proper and clean uniform for their
identification. The personnel so appointed should have the basic knowledge of personal
hygiene and safe & clean methods of food handling, they should be of good character &
decent behavior.
11. The quality of the raw materials to be used for preparation of food in the staff canteen should
be of highest standard and fresh.
12. The fuel to be used for cooking will only be commercial LPG and shall be arranged by the
Contractor.
13. The Contractor will be responsible for maintaining adequate number of persons engaged in
cooking, distribution of food and disposal of garbage and left over food.
14. The Contractor should keep the staff canteen complex clean. If, at any point the Canteen its
premises are found to be unclean, the Contractor shall be held responsible and action deemed
fit shall be taken by the Competent Authority.
15. The Contractor shall bear all the expenses for running the canteen and the Hospital shall not
in any manner be
a) Liable for any damage caused due to incidents like theft, burn, fire, electric shock
or bear any compensation for damage or injury or injury caused to its workmen while
discharging their duty.
b) The Contractor shall not be entitled to use the accommodation allotted by the
Hospital for any other purpose or business other than canteen.
16. The persons associated with preparation and distribution of food will be required to undergo
periodical medical checkups to rule out the possibilities of communicable disease / infectious
diseases, and anybody found suffering from such has to be kept out of work till he / she is
fully recovered.
17. The list of personnel deployed for food preparation, handling and serving have to be
intimated to the Authority from time to time.

18. There shall be no compromise on the quality of food supplied by the Contractor and if any
such incidence or food adulteration is found, action deemed fit, including black listing the
firm, shall be taken by the Competent Authority and all the rules of Prevention of Food
Adulteration Act (PFA Act) will apply.
19. The agency will be responsible for complying with payment of minimum wages (State or
Central whichever is higher ) and other Social Security benefits including prescribed number
of leave / holidays and prescribed hours of work Schedule as per Labour Laws in force from
time to time to its employees deployed in the hospital, all laws related to Social Security (ESI
& P.F. etc), GST and other taxes wherever applicable & other Labour legislations, pollution
control and such statutory orders from time to time as regards to treatment & disposal of
garbage, and the Contractor will be liable for any consequences resulting from violation of
any such rule / provision.
20. The Contractor will be responsible for such conduct of the persons engaged by him in the
Hospital, which will be conducive for maintaining the harmonious atmosphere in the
Hospital and will be responsible for any act of commission & omission of such persons.
21. The agency while submitting their tender form shall enclose certified Photostat copies of
experience, Trade license essential for carrying out the activities under reference, license
under Contract Labour Act, and any other documents in support of carrying out the activities
under reference from Competent Authority.
22. The successful bidder / tenderer shall obtain a valid license under the Contract Labour (R &
A) Act, 1970 and rules framed there under and shall continue to hold it till completion of the
contract. The contractor should be registered with E.P.F., E.S.I., and Tax authorities if
applicable and shall possess valid Registration Number.
23. All pages of the tender and related papers are to be duly authenticated by Tenderer or
Authorized signatory on behalf of Tenderer.
24. The Hospital Campus is a “NO SMOKING ZONE”, hence sale and use of tobacco is
prohibited.
25. The sale and use of Liquor (alcohol) is also strictly prohibited in canteen area and
Hospital Premises.
26. The Contractor shall display the approved rates prominently in the Canteen Hall.

27. The Contractor shall keep in a conspicuous place in the Canteen the approved rate list of
items and a Complaint book to record complaints and this book shall be open for inspection
by the persons duly authorized by Medical Superintendent.
28. The Contractor should use AGMARK/F.P.O. or Standard quality food articles and the
Certificate in that regard should be kept in the premises.
29. An Officer authorized by Medical Superintendent can check the quality of food and hygienic
condition. If any shortcoming is noticed/found a fine of Rs. 500/- would be imposed for
every occasion.
30. The Contractor will provide all applicable Licenses for the premises to run the canteen
within 21 days of award of work or commencement of work, whichever is earlier i.e. shop &
establishment, Food License and any other Licenses.
31. A penalty of Rs. 2000/- will be imposed on the Contractor for each day of unauthorized
closing of canteen. If canteen remains closed for a week continuously, this agreement is
liable to be cancelled and the Contractor shall be required to vacate the premises within 48
hours as per directions of Hospital authorities. PSD in such case shall be forfeited by
Hospital Authorities.
32. The Contractor will vacate the canteen and hand over the possession of the premises on the
expiry of this contract. If canteen is closed to any reason under the order of Hospital
administration, then the Contractor will have to vacate the premises within 48 hours after
receiving the notice thereof. If the Contractor fails to vacate the canteen premises on
stipulated date or on direction then damage charges for the overstay at the rate of Rs. 5000/-
per day will be recovered from the Contractor out of the Security money. If Security deposit
is insufficient to recover damage charges then the same will be recovered through the Court
of law.
33. Security Money of the Contractor will be forfeited in case of breach of any condition
stipulated herein.
34. For any dispute regarding quality / service and rates the decision of the Medical
Superintendent shall be final and binding to the Contractor.
35. No child labour shall be deployed.
36. The Successful Tenderer will have to execute an agreement on Rs.500/- (Rs. Five Hundred
Only) Stamp Paper with the ESIC Model Hospital, Laxmi Nagar, Ajmer Road, Jaipur (Raj)

37. The supplier shall possess requisite statutory license for carrying out the business and shall be
responsible for complying with all existing laws pertaining to the services offered as well as
to those pertaining to engagement of persons under him. Compliance against the same will be
the sole responsibility of the Contractor.
38. The supplier should provide non-alcoholic beverages including tea, coffee etc. and provide
refreshments including lunch/dinner to the officers and staff of the Hospital, attendants of
patients admitted in ESIC Model Hospital, Jaipur and those attending OPD services of the
Hospital/College. The supplier may also be required to supply refreshments/meals for
various conferences, meetings and functions that may be held in the Hospital.
39. Clear indication of veg and non-veg items should be mentioned in packed items.
40. Subletting of canteen contract is strictly prohibited and violation would amount to
termination of contract.
41. The Contractor is expected to pass on the benefit of free accommodation, electricity and
water in the form of reduced cost of food items while quoting the rates.
42. The contractor shall keep kitchen, wash area, utensils, serving vessels, plates and toilet clean
and disinfected and shall make arrangements for disposal of garbage and left-over of food.
Housekeeping services will not be extended to the canteen area either for cleaning
purpose or any other work.
43. The contractor shall be responsible for removal/disposal of garbage generated in the canteen.
Any blockage in canteen has to be cleaned by the contractor and in the event of failure
to clear the blockage, it shall be cleaned by the hospital administration and the amount
involved shall be levied upon/deducted from Security deposit without any notice.
44. The agency will be responsible for complying with payment of Central Minimum wages and
other Social Security benefits including prescribed number of leave / holidays and prescribed
hours of work Schedule as per Labour Laws in force from time to time to its employees
deployed in the hospital, all laws related to Social Security (ESI & E.P.F. etc), Service Tax
wherever applicable & other Labour legislations, pollution control and such statutory orders
from time to time as regards to treatment & disposal of garbage, and the Contractor will be
liable for any consequences resulting from violation of any such rule / provision.
45. The persons provided by the contractor shall be the employee of the contractor only and there
is no Master and Servant or Employer and Employee relationship between the persons
provided by the contractor and this Hospital and further the said persons of the contractor
shall not claim any employment, engagement or absorption in this Hospital, in future.

46. The persons provided by the contractor shall not claim any benefit / compensation/
absorption/regularization of service from/in this hospital under the provision of Industrial
Disputes Act, 1947 or Contract Labour (Regulation & Abolition) Act 1970. Undertakings
from the persons to this effect shall be required to be submitted by the contractor to this
hospital.
47. The Contractor shall bear all the expenses for running the canteen and the ESIC Hospital
shall not in any manner be
a. Liable for any damage caused due to incidents like theft, burn, fire, electric shock or
bear any compensation for damage or injury or injury caused to its workmen while
discharging their duty.
b. The Contractor shall not be entitled to use the accommodation allotted by the ESIC
Hospital for any other purpose or business other than running the canteen.
48. The contract will be terminated on either side with, one month Notice.
49. The Medical Superintendent shall have the right to terminate the agreement with the
Contractor by giving one month’s notice without assigning any reason. Refund of the
unutilized portion of Security Deposit paid by the contractor will be at the discretion of the
Medical Superintendent.
50. In case of gross breach of any terms and conditions attached to the contract, the
Performance Security Deposit of the Contractor will be liable to be forfeited by The Medical
Superintendent ESIC Hospital besides annulment of the contract and also
blacklisting of the contractor.
Evaluation of Bids
Technical Bid:- Bids received and found valid will be evaluated by the ESIC to ascertain the best
evaluated bid for the complete work/ services under the specification and documents. The
tenderer should take care to submit all the information sought by ESIC in prescribed formats.
Incomplete, conditional, telephonic bids or tender received after due date and time will not be
considered and summarily rejected. Following will be checked:
a. Firm’s relevant experience and strength – Profile of contractor, registration details, like
GST registration, Clearance of Income Tax & Contractor’s Registration, P.F., Sales
Tax, Labor Act & ESI, experience of similar works, annual turnover.
b. Qualification/Related experience.

Financial Bid: The financial bid of the tenderers, whose technical bid is found to be suitable,
will be opened in the presence of the tenderers, who choose to attend the opening of financial bid.
Award of work
I. The selection of the contractor will be at the sole discretion of the ESIC who
reserves its right to accept or reject any or all the proposals without
assigning any reason.
II. The Contract for the “Providing Canteen Services” shall be awarded to the best qualified
responsive tenderer.
III. After evaluation of tenders the notification on award of contract will be intimated
to the successful tenderer.
Tenders received late after closing hours for whatever the reason will summarily
be rejected.
Fraud and Corruption
The bidders, Suppliers, Contractors and consultants, observe the highest standard of ethics during
the procurement and execution of such contracts.
In pursuit of this:-
I. Defines for the purposes of this provision, the terms set forth below as follows
a. “Corrupt practice “means the offering, giving, receiving or soliciting, directly or in
directly of anything of value to influence the action of a public official in the
procurement process or in contract execution.
b. “Fraudulent practice” means a misrepresentation or omission of facts in order to
influence a procurement process or execution of contract.
c. “Collusive practice” means a scheme or arrangement between two or more bidders, with
or without knowledge of borrower, designed to establish bid prices at artificial, no
competitive levels.
d. “Coercive practice” means harming or threatening to harm directly or indirectly person
or their property to influence their participation in the procurement/tender process to
affect execution of a contract.

The award of work will be rejected if it determines that the bidder recommended or aware
has directly or through a contractor, engaged in corrupt, fraudulent, coercive or collusive
practice in competing for the contract in question.
Contract Period
A. The contract will be valid initially for one years from the date of engagement of the
agency subject to annual review of the performance of the agency.
B. After the completion of the assigned responsibilities across the tenure of the contract,
client at his sole discretion and mutual consent, may extend the contract up to two year on
the same terms and condition of the agreement. In such case date of expiry of PSD shall
be extended by the contractor beyond the 60 days of revised completion of work.
C. In exceptionally deserving case client, at his sole discretion and mutual consent, may
consider further extension of the period of contact for which independent assessment of
performance could be sought.

tender conditions of ESIC tender documents in its entirety for the above work. It is certified

rejected and ESIC shall without prejudice to any other right or remedy be at liberty to forfeit
