Thank you for your letter of January 25, 1999, requesting agency comments for the preliminary phase of your proposed subdivision, which may involve the coastal zone and the Conservation District. We appreciate the desire for a prompt response at this early phase.
As you note, the captioned property has a well for irrigation, permitted as the Ho'olawa Well, Well No. 5514-01, as of January 1990. The three parcels resulting from subdivision will continue to use this well for irrigation, and potable water will be supplied through rain catchment.
Although the well permit has no specific requirement for periodic reporting (more recent wells withdrawing this amount are required to report monthly usage on an annual basis, to aid the Commission's resource protection function through data-keeping), it is subject to Administrative Rule §13-168-7, requiring that the well be metered and the water use recorded monthly. Attached is a water use report form for your use. If the three separate parcels will require additional amounts, the permit can be amended to reflect that, and record-keeping would be required.
As you point out, the parcel to be subdivided is not adjacent to the stream and the activities there would not be expected to impact the stream. However, we recommend that all land disturbing activities be authorized under the Soil & Water Conservation District or county grading ordinance.

The Office of Environmental Quality Control requested that I consult with your office regarding a three lot family subdivision of the abovereferenced parcel on Maui hereinafter referred to as the Hoolawa Property. A map of the Hoolawa Property is enclosed with this letter.
The Hoolawa Property is adjacent to Property along its most of its western boundary identified as TMK II 2-9-01: 33, which is owned by the State of Hawaii and which is subject to a revocable permit in favor of a business called Hoolawa Farm. TMK II 2-9-01:33 is, in turn, located adjacent to property, TMK II 2-9-01 :32, which is owned by the Kiakona Family and leased out to principles of Hoolawa Farm.TMK II 2-9-01 :32 contains Hoolawa Stream. Along a small portion of the western boundary of the Hoolawa Property, the adjacent properties, TMK II 2-9-01: 20 and 21, are owned by the State of Hawaii. Hoolawa Stream passes through these two state owned parcels where it enters the ocean. No part of Hoolawa stream is contained within the Hoolawa Property. The vast majority of the Hoolawa Property is on top of the ridge adjacent to the valley carved out by Hoolawa Stream.
Hoolawa Stream is best known for the popular swimming location adjacent to the Hana Highway, well above the Hoolawa Property, commonly called "Twin Falls". A comprehensive description of Hoolawa Stream is contained in the Hawaii Stream Assessment: Hawaii's Streams and Their Instream and Riparian Resources: a Conservation Point Of ViewDraft 1990. Stream is not considered to be an outstanding aquatic resource. Its waters are diverted for municipal water supply and by Hawaiian Commercial and Sugar for sugar production. It drains approximately 1.34 square miles of land.
Subsequent to the three lot family subdivision of the Hoolawa Property, there will be the eventual construction of farm dwellings. The only anticipated possible impact on Hoolawa Stream resulting from the subdivision would be erosion and runoff during the construction process. The slope on the subject parcel ranges from 7 to 15 percent. Annual rainfall is 70 to 120 inches. The landowner is proposing to use appropriate erosion control measures during any construction to minimize the remote possibility of any erosion/ runoff that could reach Hoolawa stream through the adjacent properties.
There is a water well on the Hoolawa Property which is used for agricultural purposes. The dwellings will utilize rainfall catchment for potable water. The minor nature of this project, being the creation of a three lot family subdivision of the 24.980 acre parcel with resulting total lot sizes, including both the Agricultural and the Conservation District portions, of 14.831 acres, 5.099 acres and 5.050 acres, and the eventual construction of farm dwellings on the Agricultural District portion of the Hoolawa Property, is not expected to adversely impact the area nor the County/State facilities nor be contrary to Coastal Zone Management Regulations.

In accordance with the Department of Land and Natural Resources Administrative Rules, Section 13-168, entitled "Water Use, Wells, and Stream Diversion Works", your application to construct and test Well No. 5514-01 within Tax Map Key: 2-9-02: 14 for domestic use is approved, subject to the following conditions and recommendations:
1. The Division of Water and Land Development (DOWALD), Geology-Hydrology Section, shall be notified at 548-7543, before any work covered by this permit commences.
2. It is recommended that the total depth of the well be 150 ft. with optional open hole. It is further recommended that an annular space of at least 2 inches all around the casing be provided and that the casing be grouted a minimum of 5 ft. into solid rock.
3. The proposed use shall not adversely affect existing legal uses and appurtenant rights in the area.
4. The following shall be submitted to DOWALD within 30 days after completion of the well:
a. Well Completion Report form.
b. Elevation (referenced to mean sea level) survey by a Hawaii-licensed surveyor.
c. As-built sectional drawing of the well.
d. Plot plan and map showing the exact location of the well.

Thank you for the opportunity to comment on the well drilling permit for the proposed well. We offer the following comments:
1. The permit application indicates that the well will be for domestic use. If this well is to serve 25 or more individuals at least 60 days per year or will have a minimum of 15 service connections, then the applicant will be required to comply with the Department's Administrative Rules, Title 11, Chapter 20, "Potable Water Systems".
2. Section 11-20-29 of Chapter 20 requires that a new source of potable water serving a public water system be approved by the Director of Health prior to its use. Such an approval is based primarily upon the submission of a satisfactory engineering report which addresses the requirements stated in Section 11-20-29.
3. The proposed well lies below the UIC line. Land areas above the UIC line are considered to contain underground sources of drinking water.
4. We would recommend extending the proposed grouting depth of 20 feet because the method of wastewater disposal at the site is not known.

Gentle People,
Kindly find enclosed application for well drilling permit for a new parcel of land we acquired on Maui. I believe and hope the enclosed permit application has been correctly prepared, and in conjunction thereto, also enclosed is our check in the amount of $25.00 to defray the required processing costs.
With regard to map requirements in processing our permit, I have enclosed two maps for your files. The first map is a permiter boundary map as prepared by one of our engineers, using the metes and bounds legal description from our deed. The second map, an enlarged USGS topographical map provides an accurate boundary in that the information from map #1 was transposed onto the topo map. The mean sea level elevations are depicted on the topo map.
In regard to any questions that you may have, or upon issuing the actaul permit, you may contact me or Mt Lou Blazic at David Picots office, on Maui. His phone number is"S79 2094. Also, if you would be so kind to provide Mr Blazic with a copy of our permit, for his files, I woyld be grateful. His address is on the application form.
