Description
June through August 2013, Getty Images sent Thrasher Termite & Pest Control sent letters regarding alleged unauthorized use of a Getty Images photograph of a cat flea. These letters were demands for payment and threatened legal action. These letters also fraudulently claimed that Getty Images is the exclusive licensor of the cat flea photograph. This is false. DK Images also licenses this image to this day and are the original copyright holder On September 16, 2013 we informed Getty Images License Compliance that the image (upon which they asserted copyright infringement), was in fact, obtained from DK Images and DK Images was paid the appropriate royalty fee. We stated that further demands for payment would be considered harassment.
On Feb 3, 2014 we received a demand letter from Getty attorney Timothy McCormack. The letter demands payment of $1,400 and removal of the image from our website as THE ONLY remedy. Getty Images has completely ignored the fact that we are not infringing on their copyright. We consider this demand to be harassment and fraud.
Please help stop this harassment of our small business. We desire a letter from Getty Images and/or their attorney that states they have withdrawn their claim of copyright infringement in case #1386560.
