FIREFIGHTERSRetirement System is a defined
benefit retirement plan under
Utah Retirement Systems (URS)
intended to provide a meaningful
retirement benefit to the employees
who have chosen a career
in public service. It is a qualified
tax-deferred plan under
Internal Revenue Code Section 401(a).
The laws that govern this
retirement system are set forth
in Utah Code Title 49.

Refunds
IfyouterminateallURS-coveredemployment,youmayrequestarefundofyourmembercontributions.Ifyouelecttotakearefund,youforfeit
servicecreditfortheperiodscoveredbyyourmembercontributions.Yourrefundwillbeprocessedafter60days
fromthelastdateofthepayperiodforwhichcontributionswerepaid.
You are not eligible for a refund under the following conditions: lYoutransferfromoneparticipatingemployerunderURStoanother.
lYouterminateyouremploymentwith oneparticipatingemployerandyouaresubsequentlyrehiredbythesameoradifferentparticipatingemployer,eventhoughtheremaybeabreakinservice.

Membership Eligibility
Youqualifyformembershipifyouinitiallybeganfull-timeemploymentpriortoJuly1,2011,andyouremploymentnormallyrequiresanaverageof2,080hoursofregularlyscheduledemploymentperyearinaregularlyconstitutedfiredepartment.Youmustbetrainedinfirefightertechniquesandbeassignedtoapositionofhazardousduty.Ifyouhavenotbeentrainedinfirefighter
techniquesoryouarenotassignedtoapositionofhazardousduty,youwillbeenrolledineitherthePublicEmployeesContributoryorNoncontributoryRetirementSystemaslongasyoumeeteligibilityrequirements.Volunteerfirefightersdonotcontribute
tothesystemandarenoteligibleforserviceretirementbenefits.However,iftheyaredisabledorkilledinthelineofdutyandareontherollsofalegallyorganizedvolunteerfiredepartment,whichprovidesongoingtrainingandservesapoliticalsubdivisionofthestate,theyortheirbeneficiariesareeligibleforbenefitsprovidedforfirefightersenrolledinDivisionA.Benefitsarebaseduponthelowestmonthlysalaryoffirefightersinafirst-classcityinthisstate.
Employees who may exempt from retirement coverage by filing a URS exemption form with our office: Firefighterserviceemployeesservingas
chiefsofanyfiredepartmentordistrictmay beexcludedfromretirementcoverage.Anexemptionformmustbefiledwithourofficebefore the date of exemption.

Reinstating Withdrawn Contributions
Aslongasyouhaveanexistingrecordofeligible,nonforfeited,servicecreditwithouroffice,youoryouremployermayreinstateeligibleserviceyoupreviouslywithdrew.Thecosttoreinstateyouraccountistheamountyouwithdrewplusinterestfromthedateofwithdrawaltothedateofrepayment.Theentireamountofwithdrawncontributions plusinterestmaybepaidinalump-sumor byinstallmentpaymentsthroughpayrolldeduction.Thereinstatementmustbecompletedbeforeyourretirementdate.Also,thereinstatementmustbecreditedtoyouraccountfouryearsbeforequalifyingforanon-line-of-dutydisabilitybenefit.Reinstatingeligibleservicemayqualifyyouforanearlierretirementand/orincreaseyourmonthlybenefit.SeethesectionmarkedPayment

Service Purchase
Ifyouareanactivemember,haveanexistingrecordoffourormoreyearsofeligibleservicecreditwithouroffice,andtheservicecredityouintendtopurchasehasbeenforfeitedunderanyotherretirementsystem orplan,youoryouremployermaypurchasethefollowing:lActivefull-timeUnitedStatesmilitaryserviceifitdoesnototherwisequalifyforservicecreditunderasystemadministeredbyURS.

lYouareonaleaveofabsencefromanypositioncoveredbythissystem.
lYouareofficiallyexemptfromretirementcoverageasafirechief.If you have exempted from retirement coverage,
you may request a direct rollover of member contributions, if applicable, to a qualified defined contribution plan.
A Word of Caution — refundsaresubjectto:—A20%federalincometaxwithholding ontheeligibleportionofyourdistribution,unlessyoumakeadirectrollovertoa401(k)orothereligibleplan.
—Utahstateincometax.—PossibletaxesofthestatewhereyouresideifotherthanUtah.
—A10%earlywithdrawalpenaltyiftakenbeforeage59½.
Ifyouareaqualifiedpublicsafetyemployee whoseparatedfromserviceafterage50,youaren’tsubjecttothe10%earlywithdrawaltaximposedbytheIRS.Aqualified public safety employeeprovidespoliceprotection,firefightingoremergencymedicalserviceswithinthejurisdictionoftheemployingstateorpoliticalsubdivision.
Note: You do not lose service credit if you withdraw your URS Savings Plans (401(k), 457, IRAs) balances. For more information regarding the 401(k) plan, 457 plan, and IRAs please see the section marked URS Savings Plans.

Toqualifyforapurchase,servicecredityouearnedinotherpublicemploymentoutside ofURScoveragemustmeettheminimumqualificationsofthesystemyou’reinatthetimeofpurchase.Underthissystem,aminimumof2,080hoursofworkperyearisrequired.Purchasedservicecreditcannotbeusedto
qualifyforadisabilitybenefit.Fordetailedinformationonthetypes

formakingapurchase.
Payment Options
Youmayreinstateeligibleserviceyoupreviouslywithdreworpurchaseserviceaccordingtooneofthefollowingoptions:1.)Lump-sum paymentmadeanytimebeforeyoureffectivedateofretirementsetwithouroffice.
2.)Payroll deduction(withyouremployer’sapproval)mustbecompletedbeforeyoureffectivedateofretirementandwithin60monthsofyourfirstpayment.
3.)Direct rolloveryouarrangefromyour401(k)orotherqualifiedplan,orfromaneligibleplansuchasa403(b),457,orconduitIRA.
4.)Payment made by your employermustbereceivedbyourofficenolaterthanthedaybeforeyourretirementdate.
Allpaymentsmustbereceivedbeforeyourdateofretirementsetwithouroffice.
lAnyportionofthefollowingqualifiedserviceiftheservicehasbeenforfeitedunderanyotherretirementsystemorplan.Thisincludes:1.)ForfeitedUnitedStatesfederalemployment,
2.)ForfeitedprivateschoolemploymentbasedintheUnitedStates,ifyoureceivedanemployer-paidretirementbenefitfortheemployment,
3.)ForfeitedpublicemploymentinanotherstateorterritoryoftheUnitedStatesthatqualifiedyouformembershipinthepublicplanorsystemcoveringtheemployment,
4.)Forfeitedpublicserviceinthisstate,5.)Full-timepublicemploymentwhileonanapprovedleaveofabsence,
6.)Exemptservice,7.)Worker’scompensation,long-termandshort-termdisabilitybenefitperiodsforwhichyouwerepaidandnobenefitprotectioncontractexisted,
8.)EmploymentcoveredbytheTeachersInsuranceandAnnuityAssociationofAmerica(TIAA)retirementplanifyouforfeitanyretirementbenefitfromthatplanfortheperiodofemploymentto bepurchased,or
9.)ForfeitedUtahCharterSchoolemployment.
Thepurchasemustbecreditedtothesystemunderwhichyouarecurrentlycoveredandbecompletedbeforeyourretirementdatesetwithouroffice.

—Youareage64-65,benefitswillbepayablefor3years.
—Youareage66-68,benefitswillbepayablefor2years.
—Youareage69orolder,benefitswillbepayablefor1year.
Youwillreceivefirefighterservicecreditduringyourperiodofdisability.Aline-of-dutydisabilityretirementisnottaxableuntilyourbenefitisconvertedtoaserviceretirement.Yourdisabilitybenefitwillconverttoaserviceretirementwhenyourdisabilitybenefitterminates.Ifyouareemployedwithanother
participatingemployerduringtheperiodofdisability,youcannotreceiveservicecreditforthatemployment.Ifyouretireondisabilityandaccept
employment,youarerequiredtofileaswornstatementwithourofficeeachyearregardingyourgrossearningsforthefirstfiveyearsofreceivingdisabilitybenefits.Ifyourbenefitandgrossearningscombinedexceed125%ofthefinalaveragesalaryusedtodetermineyourdisabilitybenefit,yourbenefitwillbeoffsetthefollowingyear.Yourdisabilitybenefitwillbesuspendedwhileyouarereceivingworker’scompensationbenefits.EffectiveJan.1,2002,aline-of-duty
disabilityisexemptfromtaxationtotheextentpermittedunderfederallaw.
Exception: If you become disabled, any reinstated service must be credited in this system four years before qualifying for a disability benefit. Forspecificinformationaboutpurchases,

Disability Benefits
Ifyouareanactivememberofthissystemandyouareunabletoperformfirefighterserviceduetoaphysicalormentalconditionthatisclassifiedbyourofficeasaline-of-dutydisability,yourmonthlyretirementbenefitwillbe50%ofyourfinalaveragemonthlysalarywithnominimumageorservicerequirements.Ifyourdisabilityisnotinthelineofduty,
yourbenefitwillbethesameasforaline-of-dutydisabilityifyouhavefiveormoreyearsofservice.Ifyouhavelessthanfiveyears,youmaytakearefundofmembercontributions.Youwillreceiveadisabilitybenefituntilthe
earlierof:lThedateyouarenolongerdisabled;lThedateyouhaveaccumulated20yearsoffirefighterservicecredit,includingyearsearnedwhiledisabled;
OR lYouhavereceiveddisabilitybenefitsfromthissystemandasofthedateofdisability:—Youareunderage60,benefitswillbepayableuntilage65.
—Youareage60-61,benefitswillbepayablefor5years.
—Youareage62-63,benefitswillbepayablefor4years.

Division B (Without Social Security coverage)
Non-Retired Member (Active) Ifyoudieinthelineofdutyandyouhave
lessthan20yearsoffirefighterservicecredit,yourspouse,atthetimeofdeath,willreceive alump-sumpaymentof$1,500plusamonthlybenefitof37.5%ofyourfinalaveragemonthlysalary.Eachunmarriedchildunderage21ordependentunmarriedchildwhoismentally orphysicallydisabledwillreceive$75permonth,ifyouhavefiveormoreyearsoffirefighterservicecredit.Totalmonthly benefitstoyourbeneficiariescannotexceed75%ofyourfinalaveragemonthlysalary.Ifyourdeathisclassifiedaslineofdutyand
youhave20ormoreyearsoffirefighterservicecredit,youwillbeconsideredretiredandyourspouse,atthetimeofdeath,willreceivethedeathbenefitpayableasaretiredmember.Ifyourdeathisnotinthelineofdutyand
youhadlessthanfiveyearsoffirefighterservice,yourspouse,atthetimeofdeath,willreceivearefundofmembercontributionsplus50%ofyourmostrecent12months’salary. Ifyouhavefiveormoreyearsoffirefighterservicecredit,thebenefitisthesameasfordeathinthelineofduty.
Both Divisions
Non-Retired Member (Active) Ifyoudieandleavenospouseorminor
children,yourbeneficiary(ies)willbepaida100%refundofmembercontributionsor$500,whicheverisgreater.
Death Benefits
Division A (With Social Security coverage)
Non-Retired Member (Active) Ifyoudieinthelineofdutyandyouhave
lessthan20yearsoffirefighterservicecredit,yourspouse,atthetimeofdeath,willreceive alump-sumpaymentof$1,500plusamonthlybenefitof30%ofyourfinalaveragemonthlysalary.Ifyouhave20ormoreyearsoffirefighterservicecredit,youwillbeconsideredretiredandyourspouse,atthetimeofdeath,willreceivethedeathbenefitpayableasaretiredmember.Ifyourdeathisnotinthelineofduty
andyouhavelessthan10yearsoffirefighterservicecredit,yourbeneficiary(ies)willreceivea$1,000lump-sumpaymentorarefundofmembercontributions,whicheverisgreater. Ifyouhave10ormoreyearsoffirefighterservicecredit,yourspouse,atthetimeofdeath,willreceivea$500lump-sumpaymentplusamonthlybenefitof2%ofyourfinalaveragemonthlysalaryforeachyearofserviceupto30%ofyourfinalaveragemonthlysalary.

Note: In order for your spouse’s benefit to be effective the first day of the month following the month of your death (the benefit effective date), your spouse must file an application with our office within 90 days of your death. If the application is received 90 days after your death, the benefit effective date will be the first day of the month following the month in which the application is received.
After your death, any money in your URS Savings Plans (401(k), 457, IRAs) will be payable to your beneficiary(ies).

Setting a Retirement Date Youmaysetyourretirementdateforthe
firstorthe16thdayofthemonthfollowingyourlastactualworkingday.Youmustactuallyterminateemployment,fromallparticipatingemployerscoveredbyURSonorbeforeyourretirementdate.
When You’ll Receive Payment Yourretirementbenefitispaidmonthly.
Retirementchecksforthemonthofpaymentaremailedthelastworkingdayofeachmonth.Althoughyourfirstcheckmaybedelayeduptothreemonthsfollowingyoureffectiveretirementdate,theamountofyourcheckisretroactivetothedateyourretirementbegan.Thisdelayisdueinparttothetimerequiredtoreceiveandpostsalaryinformationfromyouremployerandtoreceiveverificationofyourterminationandyourservicecrediteligibility.
Filing Your Application Whenyoufileyourretirementapplication,
youneedtoprovideanoriginalorlegiblephotocopyofyourmarriagecertificateas wellasbirthcertificatesorotherproof-of-agedocumentsforyourselfandyourspouse.You may cancel or change your application anytime up to the date of your retirement.

Service in Other Utah Retirement Systems
IfyouwereemployedinmorethanoneUtahRetirementSystemorURSRetirementPlanandyourserviceisnotconcurrent,youmaycombineyourservicecreditstodetermineyoureligibilitytoretirefromthesystemyouareinatthetimeofyourretirement.Theserviceyourenderinanyoneyearcannotcountformorethanoneyearofservicecredit.Yourbenefitiscomputedusingtheservicefromthesysteminwhichyoucurrentlyparticipateplusthetransferredservicethatisincreasedordecreasedtoreflectthevalueoftheassetstransferred.
Note: If your service is coming from a Public Employees’ Retirement System, and if you have less than a total of 30 years of service, and you are under age 65, an early age reduction applies.
Steps to Retirement
Get an Estimate Beforemakingthedecisiontoretire,you
cancomputeanestimateofyourpotentialbenefitbygoingtowww.urs.organdusingtheRetirementBenefitEstimateCalculator.ContactourofficeforaURS-generatedestimateifyou’replanningtoretireinthenext12months.
Once You Decide to Retire Whenyoudecidetoretire,makean
appointmentwitharetirementadvisororrequestanapplicationbymail.Yourapplicationsettingyourretirementdatemustbefiledwithourofficenotmorethan90daysbeforeorafteryourretirementdate.Yoursignatureontheapplicationmustbenotarized.

Things to Know
Federallawrequiresyou,ifyouarenolongerworking,tobeginreceivingbenefitsonorbeforeApril1,followingtheyearyouturnage70½.Ifyouarestillworkingafterage70½youmustbeginreceivingbenefitsonorbeforeApril1,followingtheyearyouterminateemployment.Ifyoufailtomeetthisrequired minimum distribution (RMD),youmaybesubjecttoasubstantialfederalexcisetax.
An additional 3%maybeaddedto yourmonthlyretirementbenefitifyouhadretirementserviceinyouraccounton January 1, 1989.Ifyourefundandsubsequentlyreinstatewithdrawncontributions,youforfeitthe3%.
Federal and Utah state income taxes canbewithheldfromyourretirementcheck.Federalincometaxwillbewithheldbeginningwithyourfirstretirementcheckunlessyoutellusotherwise.Ifyou’reanonresident,checkyourstate’staxlawsforthestatusofyourUtahretirementbenefits.Youmaychangeyourwithholdingstatusatanytime.Formsareavailablefromourofficeandatwww.urs.org.Ifyouhadcontributionswithheldfrom
yourpaycheck,youmayexcludeapercentageofyourmonthlybenefitfromtaxation. Thisinformationwillarrivewithyourfirstretirementcheckunderseparatecover.EveryJanuaryyouwillreceivea1099-Rshowingthegrossandtaxableamountsofbenefitspaidtoyouthepreviousyearandthetaxeswithheld.Consultataxprofessionalregardingyour ownsituation.
Social Security benefitsarefederallysponsored.Forinformation,contactyourlocalSocialSecurityoffice.
Partial Lump-Sum Option (PLSO) at Retirement
Atretirement,youhavetheoptiontoreceivealump-sumpaymentequalto12monthsor24monthsofyourlifetimemonthlyretirementbenefit.Byelectingtoreceivealump-sumpayment,youacceptapermanentlyreducedlifetimemonthlyretirementbenefit.ThePLSOisnotavailableforfirefighters
onadisabilityretirement.Thisoptionismadeavailableoncedisabilitybenefitsterminateandthedisabilityretirementisconvertedtoaserviceretirement.
URS Savings Plans
URSoffersfourretirementsavingsplans:401(k),457,traditionalIRA,andRothIRA. Youand/oryouremployerhavetheoptionofcontributingtoa401(k)and/or457plan,if youremployerparticipates,andyou have the optionofcontributingtoatraditionaland/orRothIRA.Eachplanhasbeenestablishedunder
separatesectionsoftheInternalRevenue Code.Therefore,aseparatesetoflawsandregulationsgovernseachplan.Asaresult,therearesomedifferencesamongtheplans.Informationaboutthesavingsplansis

Administrative Information
Nonassignability of Benefits or PaymentsRetirementbenefitsorpaymentsarenot
subjecttoalienationorassignmentbythememberandarenotsubjecttoattachment,execution,garnishment,oranyotherlegal orequitableprocessexceptforadomesticrelationsorder(DRO)andIRStaxlevies. IfthereisavalidDROonyourURSDefinedBenefitRetirement(pension)accountoryourURSSavingsPlans(401(k),457,traditionalorRothIRA),partofyourbenefitswillbepaidtoyouralternatepayee(ex-spouse),asspecifiedintheDRO.Ourofficecannotbeginpaymentofyourdefinedbenefitretirement(pension)
