  • I. WHEN ARE SITE DEVELOPMENT PLANSREQUIRED?

    SiteDevelopmentPlansarerequiredfor theerectionofallbuildingsonervenzonedResidential2,Residential3andwherethesubmissionofasitedevelopmentplanis requiredasaconditionofzoningofaproperty. TheCouncil may, however, at its discretion, require a SiteDevelopment Plan for development of any kind in anyuse zone. Where Residential 2 or Residential 3erven are subdivided into erven smaller than theminimum laid down for Residential 1 erven in thevicinity of the site, a site development plan shall besubmitted simultaneouslywithorprior totheapplicationforsubdivision.

    II. PURPOSEOFASITEDEVELOPMENTPLAN

    Site Development Plans are submitted to obtainapprovaloftheformandlayoutofdevelopmentinordertoavoidunnecessarydelaysandstumblingblockswhenbuildingplansaresubmitted.

    Site Development Plans, where required, shouldtherefore be submitted and approved before architectsanddesignersfinalisedetaileddrawings.

    WhereSiteDevelopmentPlansarerequired,nobuildingplan or subdivision plan, shall be approved unless interms of an approved Site Development Plan. Theerectionofabuildingorcommencementofconstructionworkbefore theapprovalofasitedevelopmentplanorotherwise than in accordance with the approved sitedevelopmentplanshallbeacontraventionoftheTownPlanningScheme.

    The Municipality may consent to the amendment of aSiteDevelopmentPlan.

    III. DOCUMENTSANDPLANSTOBESUBMITTED

    The following documents and plans SHALL BEsubmitted, and no site development plan submissionwill be processed unless accompanied by all therequireddocumentationandplans.

    The submission should compriseANA3 FOLDED OR STAPLED SET OF DOCUMENTS (NOT ROLLED)including:

    A. A signed COVERING LETTER addressed to theExecutiveDirector: Housing&Land containingadeclarationbytheapplicantthat:

    1. Theapplicanthastherequiredauthoritytosubmittheapplicationonbehalfoftheregisteredowneroftheproperty.

    2. Theapplicant has checked theTitleDeedsof thepropertyandthattherearenorestrictiveconditionsprohibitingtheproposalassubmitted.

    3. Decleration thatall infosubmittedarecorrectandtrue(Regnumbertobeindicatedonplans).

    B. A LOCALITY PLAN indicating the application sitein relation to the surrounding neighbourhood androad system, obtainable from the InformationCentre,groundfloorBristerHouse.

    C. A plan,orcopyofanORTHOPHOTO,obtainablefrom the Central Information Centre, groundfloorBristerHouse,onwhichshallbeindicatedthesite,the land uses of adjacent erven as well asapproximate location of buildings and entrancesandegressestoandfromtheadjacenterven.

    D. An INFORMAL TOWN PLANNING ENQUIRYFORM, obtainable from the Central InformationCentre, ground floor Brister House. Such formshall include all Town Planning annexuresapplicable to the property and APPROVALLETTER.

    E. A copy of the SURVEY DIAGRAM, if available,from the Survey counter, 8th Floor, Eric TindaleBuilding.

    F. A SITE DEVELOPMENT PLAN to a scale of notless than 1:200 unless the development isextensiveenough towarrantasmallerscaleplan.Theplan/smustindicateatleastthefollowing:

    1. Thesitinganduseofallbuildings,structuresandparkingareas.

    2. The parking areas & external finishes of allbuildings including the positioning and visualappearance of all air conditioning units and theiroperation to the satisfaction of the Business UnitManager:Environment&Health.

  • 3. Sitecontours.4. Vehicle andpedestriancirculationandparticularly

    all pedestrian walkways in Shopping CentreDevelopments

    5. Thepositionof all services andany servitudes toberegistered.

    6. Proposedstormwaterdisposal.7. Thephasingofconstruction.8. If the site is to be subdivided, the proposed

    subdivisionlines.9. The extent and nature of any open space to be

    provided.10. Where landscaping is envisaged, the nature and

    extent of such landscaping, including documentsoutlining the type of landscaping, the budgetavailableandphasingofthelandscaping.

    11. Refuseareasinresidentialcomplexeswheremorethan6unitsaretobeerected.

    12. The floor plans and elevations of all existingandproposedbuildings.

    13. Details of the proposed and existing treatment ofthe boundaries of the site e.g., walling, fencing,hedges.

    14. Stepstobetakentominimiseanynegativeimpactof the proposed development on adjacentproperties.

    15. Ascheduleoftownplanningcontrolsintheformofa table indicating the permitted and actualdevelopment intermsofthecontrolsapplicabletothesite,suchascoverage,F.S.I.,parking,densityofdwellingunits(i.e.numberofdwellingunitsperhectare), height and the requiredandactualopenspaceprovision,etc.

    IV. PROCEDUREFORPLANAPPROVAL

    Site development plan submissions are to bemadetotheLandUseManagementDivisionoftheHousing & Land Directorate, 10th floor, EricTindaleBuilding.

    TWO(2)COPIESOFTHESITEDEVELOPMENTPLANDRAWINGSaretobesubmittedalongwiththerelevantdocumentation.

    Only if all documents mentioned in III above issubmitted the planswill be registeredand issuedtoaTownPlannertoassessthesubmissionfroma Land Use Management point of view, if

    amendments is required, the applicant will berequested to submit it within 21 working days(unlessontherwiseconsulted), failurewill result inarefusaloftheSDP.

    Where subdivision into smaller erven occur, theHousing&LandDirectoratewillcirculatetheplanswith the proposed subdivision application to thevarious Departments and/or Divisions for theircomment.

    Where no subdivision is to occur, a plan will bereturned to the applicant, with the Land UseManagement comment attached. The applicantwill be responsible for obtaining the commentsofall other relevant Departments and/or Divisions.The Land Use Management Division will providetheapplicantwith therelevantnamesandcontactnumbersoftheofficialsinthevariousDepartmentsand/orDivisions.

    It must be noted that no other Department orDivisionwill accept a plan for comment unless ithas been registered and assessed by the LandUse Management Division or unless priorarrangements by the Land Use ManagementDivision have been made with the applicableDepartmentorDivision.

    The applicant is to contact these Departments and/orDivisionsmentionedaboveandtomakeanappointmentwiththerelevantofficialtoobtaintheirrequirementsandcomments regarding the Site Development Plansubmitted.

    Onceall the relevantofficialshavecommentedonandendorsedtheplan,andallnecessaryrequirementshavebeen complied with by the applicant, 3 COPIES OFTHE PLAN (with amendments if necessary) may bereturnedtotheLandUseManagementDivision.

    The Land UseManagement Divisionwill together withanapproval letter, issueasignedcopyoftheapprovedSiteDevelopmentPlantotheapplicant.

    V. AVOIDINGDELAYS

    Many delays experienced may be avoided if SiteDevelopmentPlansaredealtwitheffectivelyandifthe documentation is clearly legible to thoseofficials who have to comment on the plan. Thecooperation of applicants and officials in allaspectsof theSiteDevelopmentPlanprocesswillensurethatunnecessarydelaysareavoided.

    VI. NOTETheapprovalofaSiteDevelopmentPlaninnoway confers the right for the commencementof any building work whatsoever. Buildingworkmayonlycommenceaftertheapprovalofbuilding plans and subject to the necessaryinspections. The approval of a SiteDevelopment Plan will however speed up theapprovalofbuildingplans.
