AN ORDINANCE OF THE CITYOF GOODLAND, KANSAS,AUTHORIZING AND PROVID-ING FOR THE CONSTRUC-TION OF STORMWATERDRAINAGE IMPROVEMENTSIN THE CITY; AND AUTHORIZ-ING THE ISSUANCE OF GEN-ERAL OBLIGATION BONDSOF THE CITY TO PAY THECOSTS THEREOF.WHEREAS, K.S.A. 12-631r(a)et seq. (the “Act”) provides, inpart, that whenever the govern-ing body of any city determinesit is necessary to construct stormsewers, channels, retention ba-sins or drains for the purpose ofmanaging the storm drainageareas of all or any portion of suchcity and in the unincorporatedareas outside of but within threemiles of the corporate limits ofsuch city, the governing bodymay authorize the constructionof such storm sewers, channels,retention basins or drains, suchconstruction shall be authorizedby ordinance; such ordinanceshall designate where suchstorm sewers, channels, reten-tion basins or drains shall be lo-cated; and construction of suchimprovements located outsidethe corporate limits of a city shallnot commence unless such con-struction is approved by a reso-lution adopted by the board ofcounty commissioners of thecounty in which such improve-ments are to be located; andWHEREAS, the governing bodyof the City of Goodland, Kansas(the “City”) hereby finds and de-termines that it is necessary toconstruct storm sewer improve-ments within the corporate lim-its of the City described as fol-lows:Curbs and gutters at 16th andSherman, on 16th betweenMontana and Kansas, on 16thbetween Texas and Colorado,on 14th between Cherry andWalnut, on 11th betweenCaldwell and Cherry, on 13thbetween Sherman and Grandand Montana and Kansas, onMontana between14th and13th, on Cattletrail between 15thand 16th, on 7th between Grand

and Sherman, on Clark between7th and 8th and on 5th betweenBroadway and Main (collec-tively, the “Project”); andWHEREAS, the governing bodyof the City hereby further findsand determines that general ob-ligation bonds of the City shouldbe issued under the authority ofthe Act to pay the costs of theProject and related financingcosts.THEREFORE, BE IT OR-DAINED BY THE GOVERNINGBODY OF THE CITY OFGOODLAND, KANSAS:Section 1. Findings. It is herebyfound and determined that theProject be constructed in accor-dance with the plans and speci-fications therefor which are to beprepared by or approved by theCity Engineer, and which will beplaced on file for public inspec-tion. The estimated construc-tion, engineering and financingcosts of the Project are $25,000.

Section 2. Financing. Thecosts of the Project and associ-ated financing costs shall be pay-able from the proceeds of generalobligation bonds of the City is-sued under authority of the Act(the “Bonds”).

Section 3. Reimbursement.Any Bonds issued under the au-thority of this Ordinance may beused to reimburse expendituresmade on or after the date that is60 days before the date of pas-sage of this Ordinance pursuantto U.S. Treasury Regulation§1.150-2.

Section 4. Effective Date.This Ordinance shall be in forceand take effect from and after itspassage, approval and publica-tion once in the official Citynewspaper.
