F i g h t e r 3 committed a s u i c i d e t r u c k bomb a t t a c k on a p o l i c e

complex i n Mosul, I r a q , i n which a t l e a s t seven i n d i v i d u a l s were

k i l l e d and 17 were i n j u r e d .

e. On o r about A p r i l 10, 2 009, F i g h t e r 4

committed a s u i c i d e t r u c k bomb a t t a c k a t t h e boundary o f t h e

U n i t e d S t a t e s Army's Forward O p e r a t i n g Base Marez i n Mosul, I r a q

i n which f i v e American s o l d i e r s were k i l l e d .

s t a t e d t o one of h i s c o - c o n s p i r a t o r s , i d e n t i f i e d h e r e i n as

g. On o r about May 28, 2010, the defendant

i n s t r u c t e d h i s s i s t e r , who was l i v i n g i n I r a q , t o "Go l e a r n about

weapons and go a t t a c k t h e p o l i c e and Americans. L e t i t be t h a t

you d i e . "

h. On o r about January 21, 2010, t h e defendant

i n s t r u c t e d one o f h i s c o - c o n s p i r a t o r s i n I r a q , i d e n t i f i e d h e r e i n

as F a c i l i t a t o r 3, t o " t e l l t h e one i n charge a t work" t h a t he,

meaning t h e defendant, was "not j u s t 100% b u t 1,000,000% w i t h

you. He i s w i t h you on t h e d o c t r i n e , t h e l o y a l t y and t h e enmity

and e v e r y t h i n g one m i l l i o n p e r c e n t . " He added, "Even i f I can't

1. I have been a C r i m i n a l I n v e s t i g a t o r w i t h t h e U n i t e d

S t a t e s A t t o r n e y ' s O f f i c e f o r t h e E a s t e r n D i s t r i c t o f New York f o r

a p p r o x i m a t e l y 12 y e a r s . P r i o r t o t h a t I was a S p e c i a l Agent w i t h

t h e U n i t e d S t a t e s Department o f Labor, O f f i c e o f Labor

R a c k e t e e r i n g , f o r a p p r o x i m a t e l y e i g h t y e a r s . As a C r i m i n a l

I n v e s t i g a t o r and S p e c i a l Agent, I have p a r t i c i p a t e d i n numerous

i n v e s t i g a t i o n s d u r i n g t h e course o f which I have conducted

p h y s i c a l s u r v e i l l a n c e , executed c o u r t - a u t h o r i z e d search w a r r a n t s

and used o t h e r i n v e s t i g a t i v e t e c h n i q u e s t o secure r e l e v a n t

i n f o r m a t i o n r e g a r d i n g v a r i o u s c r i m e s . My i n f o r m a t i o n about t h i s

i n v e s t i g a t i o n comes from my p e r s o n a l p a r t i c i p a t i o n i n t h i s

i n v e s t i g a t i o n , a r e v i e w o f documents, e - m a i l s , t e l e p h o n e c a l l s

and o t h e r p h y s i c a l and documentary evidence, and i n t e r v i e w s o f

w i t n e s s e s . I have a l s o r e l i e d on i n f o r m a t i o n p r o v i d e d t o me by

2. Since 2009, Canadian, T u n i s i a n and U n i t e d S t a t e s

law enforcement o f f i c i a l s , i n c l u d i n g FBI agents and o t h e r law

enforcement p e r s o n n e l i n t h e New York f i e l d o f f i c e s o f t h e FBI

and t h e JTTF, have been i n v e s t i g a t i n g a T u n i s i a n f o r e i g n - f i g h t e r

f a c i l i t a t i o n network ( t h e " f a c i l i t a t i o n network") t h a t t r a n s p o r t s

j i h a d i s t f i g h t e r s f rom T u n i s i a t o I r a q t o conduct s u i c i d e bomb

a t t a c k s a g a i n s t American and C o a l i t i o n f o r c e s i n I r a q . The

defendant FARUO KHALIL MUHAMMAD ^ ISA, a l s o known as "Faruk K h a l i l

Muhammad ' I s a , " " S a y f i l d i n T a h i r S h a r i f " and " T a h i r S h a r i f

S a y f i l d i n , " i s a member o f t h e f a c i l i t a t i o n network who l i v e s i n

Canada.

3. The f a c i l i t a t i o n network has c a r r i e d o u t a t l e a s t

two s u i c i d e bomb a t t a c k s i n I r a q . On o r about March 31, 2009,

two T u n i s i a n s u i c i d e bombers who had t r a v e l e d t o I r a q w i t h t h e

a s s i s t a n c e o f t h e f a c i l i t a t i o n network committed a s u i c i d e t r u c k

bomb a t t a c k a g a i n s t an I r a q i p o l i c e complex i n Mosul, I r a q ( t h e

"March 31 A t t a c k " ) . At l e a s t seven people were k i l l e d and 17

people were i n j u r e d i n t h a t a t t a c k . On o r about A p r i l 10, 20 09,

a T u n i s i a n s u i c i d e bomber who had t r a v e l e d t o I r a q f rom T u n i s i a

w i t h t h e a s s i s t a n c e o f t h e f a c i l i t a t i o n network committed a

s u i c i d e t r u c k bomb a t t a c k a t t h e boundary o f t h e U n i t e d S t a t e s

(the " A p r i l 10 A t t a c k " ) . F i v e American s o l d i e r s were k i l l e d i n

t h a t a t t a c k and s e v e r a l were i n j u r e d . S e v e r a l I r a q i c i t i z e n s

were a l s o k i l l e d and i n j u r e d .

4. As p a r t o f t h e i n v e s t i g a t i o n , Canadian law

enforcement o b t a i n e d and executed a c o u r t - a u t h o r i z e d w i r e t a p and

search w a r r a n t s on t h e defendant's t e l e p h o n e , computer, and

i n t e r n e t and e m a i l accounts. Unless o t h e r w i s e i n d i c a t e d , a l l o f

t h e defendant's e l e c t r o n i c communications d i s c u s s e d h e r e i n were

l a w f u l l y i n t e r c e p t e d and r e c o v e r e d p u r s u a n t t o t h e Canadian

c o u r t - a u t h o r i z e d w i r e t a p and a Canadian c o u r t - a u t h o r i z e d search

o f t h e defendant's computer.

j i h a d i s t f i g h t e r s who had been r e c r u i t e d by t h e f a c i l i t a t i o n

network, F i g h t e r 1, F i g h t e r 2, F i g h t e r 3 and F i g h t e r 4, t r a v e l e d

from T u n i s i a t o L i b y a en r o u t e t o I r a q . T u n i s i a n t r a v e l r e c o r d s

i n d i c a t e t h a t a l l f o u r men c r o s s e d t h e T u n i s i a / L i b y a b o r d e r on

October 17, 2008 and e n t e r e d Ras e l - J a d i r , L i b y a . F i g h t e r s 1, 2,

3 and 4 t r a v e l e d v i a S y r i a t o I r a q , r e a c h i n g I r a q i n

a p p r o x i m a t e l y March 2009. Two members o f t h e f a c i l i t a t i o n

network, i d e n t i f i e d h e r e i n as F a c i l i t a t o r 1 and F a c i l i t a t o r 2,

h e l p e d c o o r d i n a t e t h e f i g h t e r s ' t r a v e l t h r o u g h S y r i a t o I r a q .

6. On o r about March 20, 2 009, a p p r o x i m a t e l y two days

a f t e r F i g h t e r s 1, 2, 3 and 4 had e n t e r e d I r a q f rom S y r i a , t h e

defendant FARUQ KHALIL MUHAMMAD 'ISA communicated over t h e

i n t e r n e t w i t h F i g h t e r 5. The defendant asked: "And how are t h e

b r o t h e r s t h e r e i n our place? A n y t h i n g new about them?" F i g h t e r

5 r e p l i e d : "They are f i n e , p r a i s e God. They c a l l e d y e s t e r d a y .

No my b r o t h e r . There i s n o t h i n g new so f a r . " The defendant

asked i f F i g h t e r 5 had spoken t o them by phone, and F i g h t e r 5

r e p l i e d , "They c o n t a c t e d t he b r o t h e r s i n S y r i a . "

7. A c c o r d i n g t o t h e f a t h e r o f F i g h t e r 2, F i g h t e r 2

l e f t T u n i s i a f o r L i b y a on o r about October 17, 2008. F i g h t e r 2

and h i s f a t h e r spoke a p p r o x i m a t e l y once a week f o r t h e n e x t

s e v e r a l months, and F i g h t e r 2 always c l a i m e d t o be i n L i b y a . The

l a s t t i m e F i g h t e r 2's f a t h e r spoke t o F i g h t e r 2 was i n e a r l y

March 2009.

8. A c c o r d i n g t o t h e b r o t h e r o f F i g h t e r 2, w i t h i n one

o r two days o f t h e March 31 A t t a c k , he r e c e i v e d a phone c a l l from

an unknown number. The c a l l e r asked him, u s i n g F i g h t e r 2's r e a l

name, i f he was t h e b r o t h e r o f F i g h t e r 2. When F i g h t e r 2's

b r o t h e r c o n f i r m e d h i s i d e n t i t y , t h e c a l l e r s t a t e d , a g a i n u s i n g

F i g h t e r 2's r e a l name, t h a t F i g h t e r 2 had "been m a r t y r e d two days

ago i n combat w i t h t h e Americans i n Mosul." The c a l l e r r e p e a t e d

t h i s s t a t e m e n t t h r e e t i m e s , t h e n s a i d , "May God w i t n e s s what I

say. God i s g r e a t . You w i l l n o t be r e c e i v i n g any more c a l l s . "

9. A c c o r d i n g t o t h e u n c l e o f F i g h t e r 2, he was

p r e s e n t when F i g h t e r 2's b r o t h e r r e c e i v e d t h e phone c a l l

r e f e r e n c e d i n paragraph 8, spoke b r i e f l y t o t h e c a l l e r , and t h e n

c o l l a p s e d i n t e a r s . When F i g h t e r 2's u n c l e p i c k e d up t h e phone,

a man speaking i n an I r a q i accent t o l d him t h a t F i g h t e r 2 had

been m a r t y r e d i n combat w i t h U.S. f o r c e s i n Mosul. The c a l l e r

r e p e a t e d t h i s message t w i c e and t h e n hung up.

10. A c c o r d i n g t o American m i l i t a r y eyewitnesses t o the

A p r i l 10 A t t a c k , a t t h e time o f t h e a t t a c k a f i v e - v e h i c l e

American m i l i t a r y convoy was e x i t i n g FOB Marez. They observed

guards a t t h e I r a q i p o l i c e c h e c k p o i n t t o FOB Marez exchanging

g u n f i r e w i t h a l a r g e dump t r u c k . The t r u c k proceeded p a s t t h e

c h e c k p o i n t and drove towards t h e FOB Marez gate, p a s s i n g f o u r o f

the American m i l i t a r y v e h i c l e s a l o n g t h e way. When t h e t r u c k was

about 5 0 yards from t h e fence, i t d e t o n a t e d n e x t t o t h e f i f t h

v e h i c l e i n t h e American convoy. The c r a t e r l e f t by t h e bomb was

a p p r o x i m a t e l y 60 f e e t deep.

11. On o r about A p r i l 11, 2 009, t h e day a f t e r t h e

A p r i l 10 A t t a c k , t h e defendant had t h e f o l l o w i n g e l e c t r o n i c

c o n v e r s a t i o n w i t h an I r a q - b a s e d member o f t h e f a c i l i t a t i o n

network, i d e n t i f i e d h e r e i n as F a c i l i t a t o r 3:

12. On o r about A p r i l 12, 2009, i n an e l e c t r o n i c

communication w i t h F a c i l i t a t o r 4, and r e f e r e n c i n g a p r i o r

c o n v e r s a t i o n w i t h a s i x t h T u n i s i a n j i h a d i s t f i g h t e r i d e n t i f i e d

h e r e i n as F i g h t e r 6, t h e defendant s t a t e d : "Yesterday, [ F i g h t e r

6] c a l l e d me and s a i d t h e b i g bangs were by one o f the T u n i s i a n

b r o t h e r s . "

13. A c c o r d i n g t o t h e f a t h e r o f F i g h t e r 4, F i g h t e r 4

l e f t T u n i s i a on October 18, 2008 and never r e t u r n e d . F i g h t e r 4's

f a t h e r r e c e i v e d a t e x t message from an I r a q i phone number on o r

about A p r i l 3, 2009 t h a t s t a t e d , " I am [ F i g h t e r 4 ] . I am i n

I r a q . " On o r about A p r i l 10, 2009, F i g h t e r 4's f a t h e r s t a t e d

t h a t he r e c e i v e d a phone c a l l from an unknown number, and a man

speaking i n an I r a q i accent s a i d , "Your son [ F i g h t e r 4] i s dead."

14. On o r about A p r i l 15, 2009, t h e defendant and

F a c i l i t a t o r 4 had t h e f o l l o w i n g exchange about F i g h t e r 1's

"marriage." As d e s c r i b e d i n paragraphs 2 0 and 3 8b, t h e

i n v e s t i g a t i o n has r e v e a l e d t h a t members o f t h e f a c i l i t a t i o n

network use t h e terms "marriage" and "marriage t o 7 0 v i r g i n s " as

code f o r s u i c i d e a t t a c k s .

17. On o r about March 20, 2009, t h e defendant had t h e

f o l l o w i n g e l e c t r o n i c c o n v e r s a t i o n w i t h F i g h t e r 5 about F i g h t e r

5's p r e p a r a t i o n s t o t r a v e l t o I r a q o r — c o n t r a r y t o t h e

defendant's wishes — A f g h a n i s t a n :

[The d e f e n d a n t ] : You s a i d something about p r e p a r i n g y o u r s e l f , God w i l l i n g .

[ F i g h t e r 5 ] : Yes, God w i l l i n g . S e c u r i n g t h e way and exchanging t h e c u r r e n c y . And p a c k i n g t h e luggage. And s e c u r i n g t h e b r o t h e r s b e h i n d us.

[The d e f e n d a n t ] : Yes, b u t be c a r e f u l my b r o t h e r and make sure you p r a y about e v e r y t h i n g .

5 a t t e m p t e d t o cr o s s t h e b o r d e r from T u n i s i a i n t o L i b y a i n o r

around A p r i l 2009, b u t was d e t a i n e d and t u r n e d back.

24. On o r about A p r i l 14, 2009, t h e defendant had an

e l e c t r o n i c c o n v e r s a t i o n w i t h F a c i l i t a t o r 4 w h e r e i n F a c i l i t a t o r 4

asked, "What's t h e news from [ F i g h t e r 6] and [ F i g h t e r 5 ] ? " The

defendant r e p l i e d , " I haven't heard from them f o r a few days

now. "

25. L a t e r i n t h a t same c o n v e r s a t i o n , t h e defendant and

F a c i l i t a t o r 4 had t h e f o l l o w i n g c o n v e r s a t i o n about " f a r m i n g . " As

The Defendant's Plan t o Become a F i g h t e r f o r t h e Network

30. E l e c t r o n i c s u r v e i l l a n c e has r e v e a l e d s e v e r a l

i n s t a n c e s where t h e defendant i n d i c a t e d a d e s i r e t o t r a v e l t o

I r a q , b o t h t o p e r s o n a l l y engage i n martyrdom o p e r a t i o n s and t o

o b t a i n weapons and f a c i l i t i e s from t e r r o r i s t networks i n I r a q t o

use i n a t t a c k s i n N o r t h America.

31. For example, on m u l t i p l e occasions t h e defendant

asked F a c i l i t a t o r 3, who i s based i n I r a q , t o p r o c u r e f o r him a

t e l e s c o p i c r i f l e w i t h a s i l e n c e r , which, as d e s c r i b e d below, he

r e f e r r e d t o u s i n g t h e code term "mute b r i d e w i t h a crown." On o r

about December 22, 2009, i n an e l e c t r o n i c communication between

th e defendant and F a c i l i t a t o r 3, t h e defendant asked, " L i s t e n

c a n ' t you f i n d me a b r i d e ? " F a c i l i t a t o r 3 responded, "Yes. How

do you want her? To be a t a l k e r o r t o be mute? There i s no mute

ones." The defendant r e p l i e d , " I want her t o be mute, and t o

have a l o t o f c h i l d r e n , I want a l o t o f c h i l d r e n . " F a c i l i t a t o r 3

s a i d , "There are p l e n t y a v a i l a b l e over here."

32. On o r about January 25, 2010, i n a phone

c o n v e r s a t i o n between t h e defendant and h i s I r a q - b a s e d mother, t h e

defendant e x p l a i n e d as f o l l o w s about h i s d e s i r e f o r a "mute b r i d e

w i t h a crown":

[The d e f e n d a n t ] : Do you remember when I asked [ F a c i l i t a t o r 3] f o r t h e b r i d e w i t h the crown b u t d i d n ' t have money? . . . someone h i g h up i n t h e f a c i l i t a t i o n network so t h a t t h e defendant

c o u l d o f f e r t h a t person h i s h e l p i n a c h i e v i n g t h e network's aims.

34. A p p r o x i m a t e l y two days l a t e r , on o r about January

23, 2010, t h e defendant and F a c i l i t a t o r 3 had an e l e c t r o n i c

exchange i n which F a c i l i t a t o r 3 s t a t e d t h a t h i s "boss" had t o l d

him t h a t he would f i x an appointment t o speak t o t h e defendant by

te l e p h o n e .

35. A p p r o x i m a t e l y two days l a t e r , on o r about January

25, 2010, t h e defendant had a phone c o n v e r s a t i o n w i t h an

i n d i v i d u a l whom F a c i l i t a t o r 3 i n t r o d u c e d him t o , i d e n t i f i e d

h e r e i n as I n d i v i d u a l 2. I n t h a t c o n v e r s a t i o n , t h e defendant t o l d

I n d i v i d u a l 2 t h a t i t d i d n o t m a t t e r t o him what "company" he was

w i t h as l o n g as t h e company's f a i t h was c l e a r and t h e defendant

knew i t was a t r u e company. The defendant added t h a t he "wasn't

i n t h i s " t o make c o n n e c t i o n s o r t o g e t t o know people i n h i g h

ran k s , b u t o n l y t o do h i s j o b . He added, "t h e y g i v e me what I

need, t e l l me where t o go, and I don't need t o know people. I

have s t r o n g f a i t h and know e x a c t l y t h e company I'm w o r k i n g f o r . "

36. On o r about February 11, 2 010, t h e defendant and

F a c i l i t a t o r 3 had t h e f o l l o w i n g e l e c t r o n i c exchange r e f e r e n c i n g

"marriage" t o "the seventy." As i n d i c a t e d i n paragraph 38b, t h i s

r e f e r e n c e i s t o m a r r i a g e w i t h s e v enty v i r g i n s , which t h e

i n v e s t i g a t i o n has r e v e a l e d i s code f o r martyrdom.

37. E l e c t r o n i c s u r v e i l l a n c e has r e v e a l e d t h a t i n t h e

t i m e p e r i o d between A p r i l 2009 and t h e p r e s e n t , t h e defendant has

had numerous c o n v e r s a t i o n s w i t h members o f t h e f a c i l i t a t i o n

network about " f a r m i n g . " The i n v e s t i g a t i o n has r e v e a l e d t h a t

" f a r m i n g " i s code f o r c o n d u c t i n g t e r r o r i s t a t t a c k s . For example,

i n an e l e c t r o n i c c o n v e r s a t i o n w i t h an i n d i v i d u a l based i n I r a q

i d e n t i f i e d h e r e i n as I n d i v i d u a l 3, t h e defendant s t a t e d : "Try t o

a v o i d u s i n g names. . . . They m o n i t o r y o u r IP address, and know

when you e n t e r t h e b r o t h e r s ' w e b s i t e , and e s p e c i a l l y i n yo u r

c o u n t r y . For example when I want t o name t h e b r o t h e r s , I say t h e

farmers . . . because t h e y p l a n t m e t a l and h a r v e s t m e t a l and

f l e s h . "

38. E l e c t r o n i c s u r v e i l l a n c e has uncovered numerous

instances i n the time period between A p r i l 2009 and the present

where the defendant expressed rage at the American i n v a s i o n of

I r a q and a d e s i r e to take revenge on the United S t a t e s . For

example:

a. I n a phone conversation with h i s mother on

October 19, 2009, the defendant st a t e d , "Like i f an enemy comes

i n s i d e your country mother, there should not be anyone l e f t out, I

big or small, everyone has to stand up and f i g h t , woman, man,

boy, g i r l , anyone and everyone, do you understand?"

b. I n a phone conversation with h i s mother on

November 9, 2009, the defendant t a l k e d about the " i n f i d e l enemy"

entering a Muslim country and s t a t e d that i t i s everyone's

r e s p o n s i b i l i t y to f i g h t that enemy. He mentioned j i h a d and

asked, "Do you know mother that when a martyr die s , he would have

7 c h a r a c t e r i s t i c s . F i r s t , he r e c e i v e s forgiveness for a l l h i s

s i n s , then he gets to see h i s own seat i n Paradise. . . . Also he

gets to have 70 v i r g i n s . " The defendant added that h i s g r e a t e s t

wish was to die a martyr.

c. In| a phone conversation on January 9, 2010,

the defendant stated, "There i s no more p r e s s i n g duty a f t e r the

d e c l a r a t i o n of f a i t h than f i g h t i n g the enemy. Fi g h t i n g comes

before the other 4 p i l l a r s of f a i t h . " d. I n a phone conversation on J u l y 21, 2010, the

defendant s t a t e d , "Our motive s h o u l d always be d o i n g good f o r

o t h e r s . But i f we see harm coming from someone, we warn them,

and i f t h e y don't l i s t e n , we k i l l them. I s l a m came f o r t h e good

o f humanity. So i f someone doesn't l i k e good, we f i g h t them,

l i k e those dog Americans."

e. I n a phone c o n v e r s a t i o n on May 28, 2010 w i t h

h i s s i s t e r , who was l i v i n g i n I r a q , t h e defendant s a i d "Go l e a r n

about weapons and go a t t a c k t h e p o l i c e and Americans. L e t i t be

t h a t you d i e . "

WHEREFORE, your deponent r e s p e c t f u l l y r e q u e s t s t h a t an
