§ HowtoRunforElectedOffice–Nuts&BoltsDespitethestormyweather,about25residentsventuredouttoattendourLeague’sforumonHowtoRunforElectedOffice–Nuts&BoltsheldattheCortlandCommunityCenteronPresident’sDay,February18,2019.Theforum,toencouragecitizenstorunforpoliticaloffice,washeldearlierthananticipatedinlightoflegislationcombiningallprimariesrequiringthatlocalcandidatessubmitpetitionsearlierthanusual.LWVCCPresidentAlisonKinggaveanoverviewoftherecentvotingreformlegislationpassedbythestatelegislature.BeauHarbin(LD2)andKellyFairchildPreston(LD10)providedvaluableinsightsonwhatittakestorunforoffice.Theforumwasnotintendedasanofficialguidebutthingstoconsiderifpeoplewanttorunforpoliticaloffice.TofindlinkstoofficialNYSinformation,BoardofElectionsCalendar,andlocalelectedofficesontheballot,checkourwebsiteatlwvcortland.org.

§ BarrierstoElectionSuccessWhilenotaLWVCCevent,BoardMemberAustenJohnson,astudentattheCollege,moderatedaprogramoncampusMarch27,2019entitled“BarrierstoElectionSuccess”thatwassponsoredbytheSUNYCortlandInstituteforCivicEngagement.Boardmembersattendingfoundthepaneldiscussionveryinformative;onefoundelectionrestrictionsforjudicialcandidatesparticularlyinteresting.ThefourmemberpanelincludedarecenthighschoolgraduateelectedtotheJohnsonCityboardofTrustees,whowasratherimpressive.Itishearteningtoknowthatyoungpeopleareinterestedtoserveandcanbeinspiringrolemodels.

§ StudentsInsideAlbanyConferenceMay19-22,2019TheYouthServicesCommitteeleadbyLindaFrankselectedstudentsSantanaDeckardaMcGrawH.SseniorandAndrewCihocki,ajunioratCincinnatusH.Stoattendthisconference.SantanaandAndrewwillgathertogetherwithapproximately60highschoolstudentsfromacrossNYStatetolearnaboutstategovernmentandhowcitizenscanparticipateinthepolicy-makingarena.Studentswillbeencouragedtotalkaboutspecificissueswithintheirowncommunities.Theywilllearnabouttheroleofmediaincoveringandinfluencingpublicpolicydecisions.StudentswillalsotourtheCapitolandobserveboththeSenateandAssemblyinaction.Theywillspendtimeshadowingtheirownstatelegislators.

“AstheNewYorkStateLeagueproudlycelebratesits100thanniversarythisyear,itisatrulymonumentalachievementtofinallyseethepassageofearlyvoting,samedayvoterregistration,andprimaryconsolidationinNewYorkState!EachofthereformspassedbytheAssemblyandSenatearehugeadvancestoNewYork’selectionprocedures.Withthesenewpoliciesinplace,NewYorkshouldnolongerrankamongtheworststatesintheNationinvoterparticipation.

Sincethe1960’sthestateLeaguehasfoughtforcomprehensivevotingreforms.WeareproudtobeapartofthishistoriceventandweapplaudtheNewYorkStateAssemblyandSenateforfinallypassingthesereforms.WethankSenateMajorityLeaderAndreaStewart-CousinsandAssemblySpeakerCarlHeastiefortheirleadershipanddedicationtotheseissues.Wecommendthelegislatorswhohavelongsupportedthesevotingreforms,eveninthefaceofpreviousgridlock.FinallywewanttorecognizeourmemberswhohavefoughttirelesslytoseeNewYork’svotingsystemmademoreaccessibletoallNewYorkers.WelookforwardtoworkingwiththeLegislatureandGovernorontheroll-outofthesenewpolicies.”

“TheLeagueofWomenVotersofNewYorkStateispleasedthatthe2019-2020statebudgetincludes$10millionforearlyvotingimplementationfundingforcountiesand$14.7millionforelectronicpoll-books.ThesefundswillbecriticaltohelpearlyvotinggetofftoagoodstartinNewYorkState.Inadditiontothebenefitsofthisfunding,votingwillbemoreaccessibleforNewYorkerswithexpandedprimaryvotinghoursinupstatefrom6a.m.to9p.m.,moretimeoffforworkersonelectionday,andenhancedabilitytoregistertovoteonlinethroughthestateBoardofElectionswebsite.Thesereformsarehallmarksofprogressinfinallyestablishinga21stcenturyvotingsystemforNewYorkState.

Ontheotherhand,thisbudgetagreementdidnotbringneededcomprehensivecampaignfinancereform.Instead,itdelegatestoastill-to-be-formedPublicFinancingCommissionconsiderationofoneaspectofcampaignfinancereform--asmalldonorpublicmatchingsystem.Weagreethatitisimportanttogetthedetailsofanypublicmatchingsystemcorrect,butthisiswhatourrepresentativesareelectedandpaidtodo,ratherthandelegatetheirresponsibilitiestoanunaccountablecommission.Itiscriticalforthesuccessofanypublicfinancingsystemthatitincludelowerlimitsfornon-participatingcandidatesaswellasparticipatingcandidates,andindependentandeffectiveenforcement.NewYorkershavebeenfrustratedformanyyearsbythedeplorableconditionofourstate’scampaignfinancesystemandtheoversizedinfluenceofwealthydonors.Ourelectedlegislatorsjustreceiveda$10,000payraisetodayuponthetimelydeliveryofthenewbudget;theyshouldbegintoearntheirincreasedpaybyholdinghearingsoncomprehensivecampaignfinancereformwiththegoal

ofdeliveringlegislationduringthissession.LegislatorscanbuilduponthepublicfinancingbillthattheStateAssemblyhasrepeatedlypassedinrecentyears,lowerthestate’ssky-highcontributionlimitsandfinallyputinplacerealenforcementofcampaignfinancelaws.“

§ LWVNYSPraisesVotingReformLegislationAndFunding

PassedVotingReformLegislationandFundingIncludedin2019-2020Budget

“VotingisabouttogeteasierforNewYorkers.NewYorkhaslonglaggedbehindmostofthecountrywhenitcomestovoting.Ourarchaicelectionlawsmadeitdifficultforpeopletovoteandresultedinlowvoterturnout.However,thissessionboththeAssemblyandSenatepassed7electionlawsbills.ThefivereformswhichrequiretheGovernor’ssignaturehavebeensignedintolaw.However,notalloftheseareeffectivelyimmediately.Otherreforms,whichrequireconstitutionalamendments,cannotbecomeeffectiveuntilfurtheractionistakenbythelegislatureandtheyarepassedbyvoterreferendum.

Thepassed2019-2020statebudgetprovidedfor$10millioninfundingforearlyvotingimplementationincounties,and$14.7millioninfundingforelectronicpollbooks.Inaddition,itexpandedprimaryvotinghoursupstateto6a.m.to9p.m.,gavemoretimeoffforworkersonelectionday,andenabledonlinevoterregistrationthroughtheBoardofElectionswebsite.PreviouslyonlineregistrationwasonlyavailablethroughtheDepartmentofMotorVehicles.

1. EARLYVOTING.WilltakeplaceforthefirsttimeinNewYork.(Thirty-eightstatesandDistrictofColumbiahavealreadyinstitutedinpersonearlyvoting.)Voterswillbeabletovoteatdesignatedpollsitesfor9dayspriortoelectiondaybutnottheMondaybeforeelectionday.EachCountyBoardofElectionswillfollowthelawdesignatingthenumberofandplacementoftheearlyvotingpollsitesandnotifyvoterofthedays,hours,andlocationsoftheearlypollingsites.

Thisactwilltakeeffectimmediatelyandfirstapplytothe2019generalelection:i.e.,earlyvotingwillbeginOct.26,2019andgothroughNov.3,2019.AllpollswillbeopenElectionDayNov.5,2019.

2. PRIMARYCONSOLIDATION.AmendscertaindeadlinessoNYisincompliancewiththefederalMilitaryandOverseasVoterEmpowerment(MOVE)Act.Moreover,thisactcombinesfederalandstateprimariesintooneprimaryonthefourthTuesdayinJune.ThispreventsNYfromhavingtwoprimariesforfederalelectionsinnonpresidentialyearsandthreeprimariesinpresidentialyears,savingthestateabout$25,000,000.Inadditiontocostsavings,itshouldincreasevoterturnout.

Thisactwilltakeeffectimmediatelyalthoughin2019beinganoff-yearelection,therewillbenoneedtocombineprimariesasonlyoneprimaryday.PrimaryDayisJune25,2019thisyear.

3. SAMEDAYVOTERREGISTRATION.WouldallowvoterstoregisterandvoteonElectionDay.Inorderforthistobecomelaw,theNYSConstitution(whichrequiresregistrationtovotetobecompletedatleast10daysbeforeElectionDay)needstobeamended.ChangingtheConstitutionwouldrequirethesamebillthatpassedthisyeartobealsopassedinboththeAssemblyandSenateinthelegislativesessionfollowingthe2020generalelection,andthenbeingpassedbyvotersinareferendumin2021.Therefore,firsttimethiscouldgointoeffectwouldbein2022.

Currently,NewYorkersneedtoberegistered25daysbeforeElectionDay.

4. NO-EXCUSEABSENTEEVOTING.Wouldremoveneedforacauseforabsenteeballotvoting.CurrentlyinNY,youcanrequestanabsenteeballotforsixreasons:absencefromcountyon

electionday;temporaryillnessorphysicaldisability;permanentillnessorphysicaldisability;dutiesrelatedtoprimarycareofindividual(s)whoareillordisabled;patientorinmateinVA;ordetentioninjail/prisonawaitingtrial,actionbygrandjuryorconvictedofcrimewhichisnotafelony.

Currently28statesandtheDistrictofColumbiaallowvoterstovoteabsenteewithoutacause.No-excuseabsenteevotingwouldrequireaconstitutionalamendmentandcouldnottakeplaceuntilalsopassedinboththeAssemblyandSenateinthelegislativesessionfollowingthe2020generalelection,andthenbeingpassedbyvotersinareferendumin2021.

5. PREREGISTRATIONFOR16AND17YEAROLDS.Currentlytheonlytime17yearoldscanregistertovoteisiftheyareturning18inthatcalendaryeareveniftheirbirthdayisafterElectionDay.Thisnewbillwouldallow16and17yearoldstopreregister.Thevoterregistrationformwouldbemodifiedtoincludespacewherethereisanexplanationofpreregistrationandallowforformtobepending.

ThisactwilltakeeffectinJanuary2020.

6. STATEWIDEVOTERREGISTRATIONTRANSFER.ProvidesthattheBoardofElectionswouldtransfertheregistrationandenrollmentofavoterappearingonastatewidevoterlisttowherevertheymoveinthestate.ThiswouldenablevoterswhomovetoadifferentcountyinNYtovoteonanaffidavitballoteveniftheirnewcountywasnotnotifiedofthechangeofaddressandhavetheirvotecounted.Currentlyitisuptothevotertoreregisterinnewcountytowheretheymove.

ThisacttookeffectMarch25,2019.

7. CLOSUREOFTHELLCLOOPHOLE.Willchangewaythatcandidatescanrunandfundtheircampaigns.Thiswilleliminatetheloopholewhichhasallowedcorporationstopouralmostunlimitedmoneyintoracesthroughlimitedliabilitycompanies.Accordingtothisbill,eachlimitedliabilitycompanythatmakesacontributionorexpenditureforpoliticalpurposeswillbeheldtothe$5,000limitoncorporationsandwillneedtofiletheidentityofownersinthelimitedliabilitycompanyandtheproportionoftheirinterestwiththeNYSBoardofElections.

Thisactwilltakeeffectonseventhdayafteritbecomeslaw.”

ThememobelowexplainswhytheLeagueofWomenVotersofNewYorkStatestronglyurgespeopletocalllegislatorsinsupportofthislegislationthatprovidesfortherestorationofvotingrightstopeopleonparole.

TO:NYSAssemblyandSenateDATE:March28,2019SUBJECT:ANACT toamendtheelectionlaw,thecriminalprocedurelawandthecorrectionlaw,inrelationtovotingbyconvictedfelons.

Sinceitsfounding100yearsago,theLeagueofWomenVotersofNewYorkStatehasfoughtto educatevoters andmakeNewYork’s voting systemmoreaccessible to allNewYorkers.This bill would continue that important process by restoring voting rights to people onparole. Voting is an important right of citizenship and belonging to a community. This billwouldprovidefor:

•TherighttovotewillbeautomaticallygrantedtoallNewYorkerswhoarecurrentlyonparole.

• TheDepartment of Corrections and Probation and Parolewill be responsible forassisting with voluntary voter registration prior to an individual’s release fromprison.

• The State Board of Elections will be required to develop and implement a newoutreachprogramtoeducateprofessionalssuchaslawyers,judges,electionofficials,correctionsofficialsandthepublicaboutthenewpolicy.

• Peoplewho are convicted of a crimewill be informed: (1) before conviction andsentencingtoprisonthattheywilllosetheirvotingrights;and(2)uponreleasefromprisonthattheyareagaineligibletoregisterandvote.

Executive Order No. 181 granted voting rights to people on parole by conditional pardon.However,basedontheexperienceofadvocatesandnewlyenfranchisedvoters,thisExecutiveOrder did not accomplish enough. We need education, automatic enfranchisement, and abetterprocessthatdoesnotleaveanyvoterbehind.Allthosewhoareenfranchisedmustbemadeawareoftheirrights.FewNewYorkersunderstandthedifferencebetweenprobationand parole, and some individuals on probation have functioned under themisinformationthattheydonothavetheirfundamentalrighttovote.
