FUEL BREAK AGREEMENT STATE S.OHOOL LANDS IN SECTION- 2 T14S~ R27E, MDM, FRESNO·COUNTY

The Unite9 States Forest Service (USFS) ,ha~ pJ::cposed a project in V?hich they wi 11 construct ~- ,J:µei 'break along the Pine Ridge - M.c::Keniie Ridg~ are~ ·of Fresno County,•· Fuel breaks are a unique lahcf use and their locatior.- 'is dep~ndant on topographic £~atµres often retjuiring the cooperation of several l~btj owners, all of whom enjoy benefits from_ the red99ed fi-re hazard. In ·order to provide a vehicle for· Commission authorizati'on of fuel brea1' construction al)d m.;iirlt;:enance, the staff has developed~ ,fuel Break-Agreement form whicb also meets the needs of the USFS so that federal £unds may be ~xp~nded on nori~fed~ral 1an~. The a~reernent does nqt convey any interest in reai prope-rty, but P'!'.'OVides for what amounts to a coqperati~e agreement whereby the State provides a portion of its land and the USFS pr:ovioes for constriJct,ion and maintenance of the fuel break. The benefits accr~i'e' to 'all land owners ~n the area' including the State, in the reduction of risk and ~everity of wild~ires.
In this case, a break in l)eayy brush 300 feet wide and 1,505 feet long totaling 10.3 acres is proposed to be con~tructed on_ State school land in S~ NW~, Sectibn 2, T14S, R:pE, MDM. The proposed agreement provides that after construction the l]SFS will m~\intain the break for w ,period of 10 years from August 23, 1979. The agreement 1ay be , termipated on 60 days notice by either party and the USFS sh9ll indemnify and ·hold the State harmless to the extent allowed by the Federal Tort Claims Act.

by tpe Commission's -s~af f; pursuan~ to CEQA and implementing regµlations.

FUELBREAK AGREEMENT
This agreement, entered into this ~~~~~~~~

State of California-st·ate Lands :Commission, hereinafter
cal led, "Commission", and the United States Department of
Agricul't;ur-E!, Forest Service, hereinafter cal led "Forest
Service";
WHEREAS., the Commission exerc·ises control and jurisdi'ct·1 oh.
o~~r approximately 607,000 acres of school land within
the State of California; and
WHER~AS, the Commission d~~ires to enter into a vegetation
and fuel management program on certain of said lands; and
'WHEREAS, it il~ the desire of the Conimission to encourage
the construction aj\d maintenance of a net~ork of fuelbreaks
and to provide for a program of prescription burns on certain
portions of said real property consistent with Commission
objectives; and
\rnEREAS, the primclry objec~i ve of the fuel management
~r9g~@m is to reduce the risk and severity of wi1dii~~s;

construction and maintenance of a fuelbreak by the Forest
Serv;ce upon the property subject to this agreement said
ins·tructi6n to :be in accordance With the following terms,

may teminate this agreement ~pon giving the other party
not less than sixty (60) days written notice prior to the
date of such termination.

the extent allowable by law pursuant to the Federal Tort
Claims Act C28 ;l).s.c .. 2671 e·t s·ecr), of appropriat-ed- .funds.;

this Agreement or to any benefLts th.at may arise therefrom,

DESCRIPTION OF THE FUELBREAK LOCATiON AND MAINtENANCE AREA
A maintenance area for fite fuelbr~ak purposes described
as foilows.: A strip of land in the so~th half of the northwest quarter (,S'~~wi> of Section two ( 2), Township fourteen ( 14) South, ~ahge twenty-seven (27} East, Mount Diablo Meridian, in the County of Fresno, State of California, containing an area of 10.3 acres. The centerline of said strip is described
as follows: Beginning ~t a .point in the north boundary of the property, said boundary being the north line· of the S~ of the ~W~ of Section 2, ·T.145., R.'27E., M.D.M., which poi.nt lies west 1040.0 feet from the northeast corner of the SE~ of the NW~ of Section 2, thence along~he center lin~ of the maint~Dance area described as follows:
