MOTION OF LOUISVILLE GAS AND ELECTRIC C MPANY TO DEVIATE FROM REQUIREMENT GOVERNING FILING OF COPIES
Louisville Gas and Electric Coinpany (“LG&E”) by counsel, petitions the Kentucky
Public Service Commission (“Coniiriission”) to grant LG&E approval, pursuant to 807 KAR
5:001, Section 14 to deviate from the requireineiit that parties file arid original and fifteen (15)
complete copies of all data responses and attachments. L,G&E requests that it be excused fiom
filing any paper copies of certain of its responses and attachleiits due to the fact that such
responses and attachments are unduly voluininous. In support of its Motion, LG&E states as
follows:
1. Pursuant to Commission’s June 28, 201 1 Order, LG&E must provide an original
and fifteen (15) copies of all data respoiises and attachments to the Cornmission, along with a
service copy to all parties of record. Cei-tain of the responses and attachments to the responses
are voluminous. Due to the voluminous nature of cei-tain of the responses and attachments,
LG&E is requesting perinission to file only electronic copies on cornpact disc of the responses
and attachments.
2. In response to the Attorney General’s Initial Data Request Nos. 2 and 6, LG&E
provided on July 25, 201 1, documents on coinpact disc that totaled over 6,000 pages (cornhined
public and confidential), and is providing today documents on compact disc totaling over 12,000

pages. In providing just the Commission’s fifteen copies, LG&E would have to provide over
270,000 pages. This number will increase greatly when the service copies are likewise
considered.
3. Due to the voluminous nature of these documents, LG&E requests permission
pursuant to 807 KAR S:OOl, Section 14 to deviate from the Commission’s June 28, 201 1 Order
and provide the Commission’s fifteen copies electronically, both for LG&E’s July 25, 201 1
initial responses and the supplemental responses being filed today. L,G&E also seeks permission
to provide service copies to the other parties to the proceeding electronically, as well.
WHEFUZFORF,, LG&E requests a deviation from the requirement that parties provide an
original and fifteen (15) paper copies of data responses. LG&E requests that it be allowed to
instead submit the responses and attachments identified above on compact disc in compliance
with this requirement.

PETITION OF LOUISVILLE GAS AND ELECTRIC COMPANY FOR CONFIDENTIAL PROTECTION FOR SUPPLEMENTAL RESPONSES TO CERTAIN
DATA REQUESTS OF THE ATTORNEY GENERAL
Louisville Gas and Electric Company (“LG&E”) hereby petitions the Kentucky Public
Service Cornniission (“Commission”) pursuant to 807 KAR 5:001, Section 7, and KRS
61.878(1)(c) and (a) to grant Confidential protection for the items described herein, which LG&E
seeks to provide as part of its supplemental response to the Attorney General’s (“AG”) Initial
Data Requests Nos. 2 and 6. I11 support of this Petition, LG&E states as follows:
Confidential or Proprietary Commercial Information (KRS 61.878(1)(c))
1. The Kentucky Open Records Act exempts from disclosure certain commercial
information. ICRS 61.878( l)(c). To qualify for the exemption and, therefore, maintain the
Confidentiality of the information, a party must establish that the material is of a kind generally
recognized to be confidential or proprietary, and the disclosure of which would permit an unfair
coniniercial advantage to coinpetitors of the party seeking confidentiality.
2. AG Request No. 2 asks L,G&E to provide “all correspondence, ineinorarida and e-
inails regarding any and all alternatives to the proposed environmental coinpliance plan set forth
in the company’s petition in the instant matter.’’ Similarly, AG Request No. 6 seeks “any and all
documents, emails, correspondence, memoranda, reports, letters, studies, analyses, conclusions,
or opinions that relate to the preparation of the application . . . .” Certain of the documents
contained in the voluminous supplemental production contain commercially sensitive and
proprietary information, including, but not limited to, budgeting information, power production
cost and unit outage information, contract compensation terms and request-for-proposals-related
information, and links to secure websites.
(a) As to the budgeting information, disclosure of the information would
reveal LG&E’s budget strategies and processes, the public disclosure of which would reveal to
competitors how LG&E prepares its budgetary information, which could significantly benefit
LG&E’s competitors by permitting third parties to iiianipulate the information for their
advantage.
(b) As to the power production cost and unit outage information, such
infoiination merits confidential protection because revealing it would likely harm LG&E’ s
ability to compete in wholesale power markets by revealing their input costs and dispatch
inethodology, which can affect wliolesale sales strategy and performance. This would constitute
an unfair disadvantage to LG&E.
(c) Certain of LG&E’s contract teiins and request-for-proposals-related
information, including agreed-upon compensation rates, contain highly sensitive coinmercial
information. These provisions represent concessions, terms, and conditions that L,G&E has been
able to negotiate for L,G&E’s and its customers’ benefit. Revealing publicly the compensation
rates would significantly compromise LG&E’s ability to obtain contract labor at competitive
rates, which would in turn financially harm LG&E’s customers. Permitting other contractors to
obtain this information would inure a significant cotninercial advantage to the companies at
LG&E’s and its customers’ expense because third-party contractors will be less likely to contract

with LG&E at the least possible cost if their negotiated prices and other contract terms will be
available to the public. Moreover, contractors would not favor public disclosure of concessions
that they have made because those concessions would be used against them in future negotiations
with other customers. They would therefore be more likely to insist on standard contract
provisions and less willing to negotiate terins with LG&E in the ftiture, thus jeopardizing
LG&E’s ability to obtain the best possible contracts, placing it at an additional competitive
disadvantage.
Confidential Personal Information (KRS 61.878(1)(a))
3. In its supplemental respoiise to AG Request No. 2 and 6, LG&E is providing
documents that include lirks to secure websites and likewise includes the requisite log-in
information, such as user naines and passwords for these sites. This information constitutes
confidential personal information because of the personal identifiers, such as user names. The
Kentucky Attorney General has previously held that personal identifying information, such as
phone nurnbers, is exempt from disclosure under the Kentucky Open Records Act.’ User names
and passwords are equally significant identifying information, the disclosure of which would
permit the public to gain access to the secure sites and the highly confidential information
available on those sites. LG&E believes that protecting such information is critical, not only
because of the identifying information, but also because the disclosure of the identifying
inforiiiation would permit competitors to access many foiins of the coinmercially sensitive
information discussed above.
4. If the Commission disagrees with any of these requests for confidential
protection, however, it inust hold an evidentiary hearing (a) to protect LG&E’s due process
rights and (b) to supply with the Commission with a complete record to enable it to reach a

decision with regard to this matter. Utility Regulatory Commission v. Kentucky Water Seivice
Company, Inc., 642 S.W.2d 591, 592-94 (Ky. App. 1982).
5. The infoilnation for which L,G&E is seelcing confidential treatment is riot lcnown
outside of L,G&E, is iiot disseminated witliin LG&E except to those employees with a legitimate
business need to lmow and act upon the inforination, and is generally recognized as confidential
and proprietary information in the energy industry.
6. LG&E will disclose the confidential information, pursuant to a confidentiality
agreement, to intervenors and otliers with a legitimate interest in this information and as required
by the Commissioii. In accordance with the provisions of 807 KAR. 5:001, Section 7 and tlie
Coinmission’s June 28, 201 1 Order in this proceeding, LG&E herewith files with the
Commission one copy of the above-discussed responses with tlie confidential iriforrnatiori
highlighted and fifteen (1 5 ) copies of its responses without the Confidential information.
WHEREFORE, Louisville Gas and Electric Company respectfully requests that the
Commission grant confidential protection for the information at issue, or in the alternative,
scliedule and evidentiary hearing on all factual issues while maintaining tlie confidentiality of the
information pending tlie outcome of the hearing.
