Thank you for contacting the New York City Department of Citywide Administrative Services (DCAS) with a request to amend that certain Mapping Agreement, dated June 23, 2008, between the City of New York and Rescue Church of Christ, Inc. (the “Agreement”) to allow the use of a portion of the development rights associated with the above-captioned properties to facilitate the development of a proposed affordable housing project.

As you know, DCAS began preliminary review of your request pursuant to recent amendments to the New York City Administrative Code Title 25 Chapter 8 and Title 3 Chapter 1. These amendments were enacted in 2016 by the New York City Council to set forth a new DCAS process for modification or removal of deed restrictions on certain properties sold by the City. However, after discussing this request with the New York City Corporation Counsel, it has been determined that the Agreement does not fall within the parameters set forth under Sec. 25-801 of the Administrative Code, and further, the New York City Department of Housing Preservation and Development (HPD) may amend such agreement to facilitate the development of the proposed affordable project, subject to the approval of the New York City Corporation Counsel.
