Lori Goodfield, the applicant appeared on her own behalf and gave a brief history in relation to the submission with respect to landscaping and trees. Ms. Goodfield submitted a copy of the aerial view of the neighbourhood, photographs and minutes for similar applications in the area. No one appeared before the Committee in support of or in opposition to the request. During discussions with the Committee it was suggested and agreed to adjourn the application to allow Urban Design to conduct a site visit and allow Development Planning to provide revised comments. Official Plan:
The subject lands are designated “Low-Rise Residential” by the new City of Vaughan Official Plan 2010 (VOP 2010), which was approved, in part, by the Ontario Municipal Board on February 3, 2014.
Comments:
Planning Staff conducted a site visit with photo documentation on April 1, 2014. The property abutting to the rear is developed with mature deciduous trees up to the rear lot line. The Owner is requesting permission to construct an in-ground swimming pool with a reduced rear yard setback. A Landscape Architect in the Planning Department has advised that a further site visit is required to determine if the proposed setback is adequate to ensure the root system (of the mature trees to the north) located on the subject property will not be negatively impacted by the development. Accordingly, the Planning Department recommends Minor Variance Application A072/14 be adjourned until such time that a Landscape Architect with the Planning Department can conduct a site visit to determine if the proposed setback is appropriate.
Recommendation:
The Planning Department recommends adjournment of Minor Variance Application A072/14, until such time that Urban Design Staff can conduct a site visit.

Proposal
1. To permit a minimum interior side yard setback of 0.4 metres to pool equipment.
2. To permit a minimum interior side yard setback of 0.4 metres to central air conditioning unit (A/C).
3. To permit a minimum rear yard setback of 1.52 metres to swimming pool. By-Law Requirements:
1. A minimum 1.2 metres interior side yard setback to pool
equipment is permitted. 2. A minimum 1.2 metres interior side yard setback to an A/C unit is
permitted. 3. A minimum 5.0 metres rear yard setback to a swimming pool is
permitted. Comments: Note a pool enclosure/building permit has not been issued and is
required. Variances No. 3 is sufficient enough to allow for positive drainage without any adverse impact on the subject lands. Variance No. 2 is acceptable, however it should be noted that an A/C unit with less than 0.6 metres setback from an interior side yard swale should be elevated and mounted to the dwelling wall to ensure positive drainage is maintained. With respect to the proposed setback as noted in Variance No. 1, the current grading pattern for the side yard consists of a split drainage pattern. Therefore the existing swale must be maintained and with the proposed 0.4 metres setback positive drainage should not be an issue. Also of note is Lot 182 (subject lands) of the approved Grading Plan (Registered Plan 65M-2721 & 65M-2722) was constructed with a rear lot catchbasin. Note the rear lot catchbasin shall remain unobstructed to allow for positive drainage. Accordingly, the Development Transportation/Engineering Department has no further comments or objection to Minor Variance Application A072/14.

PowerStream has received and reviewed the proposed Variance Application. This review, however, does not imply any approval of the
project or plan.
All proposed billboards, signs, and other structures associated with the project or plan must maintain minimum clearances to the existing
overhead or underground electrical distribution system as specified by the applicable standards, codes and acts referenced.
In the event that construction commences, and the clearance between any component of the work/structure and the adjacent existing
overhead and underground electrical distribution system violates the Occupational Health and Safety Act, the customer will be responsible
for 100% of the costs associated with PowerStream making the work area safe. All construction work will be required to stop until the
safe limits of approach can be established.
In the event construction is completed, and the clearance between the constructed structure and the adjacent existing overhead and
underground electrical distribution system violates the any of applicable standards, acts or codes referenced, the customer will be
responsible for 100% of PowerStream’s cost for any relocation work.
