INSTRUCTIONS TO BIDDERS
The City of Altus, Oklahoma, herein after called the “Owner,” is seeking bids for the replacement of the
reverse osmosis membranes and other related work at the municipal water treatment plant.
Sealed bids will be received until 3:00 PM, Wednesday, December 3, 2018, in the Altus City Clerk’s Office
on the 2nd Floor of City Municipal Complex at 509 South Main Street, Altus, Oklahoma, 73521-3135.

Bidders are encouraged to inspect the work prior to bidding. Potential bidders who wish to inspect the
site should contact Stephen Cesar to schedule the visit. The Municipal Water Treatment Plant is located
at 221 East Bradford Avenue, in Altus, Oklahoma.
Bidders are invited to be present at a public opening at the following time and date:
3:00 PM, Monday, December 3, 2018
Bids must be sealed and must include “Bid No. 20033” on the bottom left hand corner of the bid
envelope and mailed or delivered to the City of Altus at the above address. Bidders must include a
return address on the top left hand corner of the envelope.
Bids shall consist of returning the following completed forms, all of which are found in this solicitation
package:

Bids received more than ninety six (96) hours before the time set for opening of bids, or any bid received
after the time set for the opening of bids, shall not be considered and shall be returned unopened.
The Owner does not discriminate on the basis of race, color, national origin, sex, religion, age or
handicap status, in employment decisions, the procurement of services, the selection of suppliers or
awarding of bids and/or contracts.
Awards shall be based on a determination of the lowest qualified bid. "Qualified" is a determination by
the Owner regarding the capability of the bidder to perform the work in good faith, with integrity and
reliability, as well as the materiality of the bidder’s errors, omissions, conditions or exceptions (if any).
The City Council/AMA will award the contract subject to staff review and approval of the membrane
being proposed for installation. The written Notice Of Award will be issued after staff has reviewed the
manufacturer’s membrane performance projections and approved the membrane being proposed for
installation. The successful bidder shall submit the manufacturer’s performance projections within ten
(10) calendar days after the City Council/AMA awards the contract.
SCOPE OF WORK
The Contractor shall provide labor, equipment, materials and incidentals needed to complete the work
specified in this solicitation for bids. The work includes the replacement of the membranes for three (3)
existing reverse osmosis units (skids) and other related work as specified.
The Contractor shall: (1) rebuild/replace all end cap gaskets, quad seals and miscellaneous hardware for
the three (3) RO skids with 288 membranes per skid; (2) perform any program editing of the PLC logic
and alarm set points required for the feed pumps to provide the proper feed flow to the RO units; and
(3) implement and employ existing third-stage booster pumps.
The Owner will provide suitable on-site containers for storage and transport and off-site disposal of the
existing membranes, the packaging for the new membranes, and the other trash generated by the
membrane replacement work.
The Contractor shall furnish and install software for normalized performance data analysis. The
software shall be designed to allow the operating staff to evaluate membrane performance using
normalized data to more effectively track the condition of the membranes.
The Contractor will provide: (1) all on-site labor required to breakdown the RO skids and to unload and
remove the existing RO membranes from the vessels; (2) all on-site labor needed to physically unpack,
stage and install all new membranes; (3) all scaffolding and scissor lift rental needed to perform the
work; (4) all shop supplies, end cap seals, gaskets and parts required to perform the work; (5) all needed
PLC editing (P&ID) blocks for feed pumps and needed edits for the proper operation of the RO units as
specified; (6) a loading schedule of membrane serial numbers to placement for each skid in XL
Spreadsheet format; and (7) all labor, per diems, mileage and shipping for hardware supplies required to
complete the work as specified.
CONDITIONS
1. Bidders are responsible for inspecting the site of the work and for being familiar with the site
conditions.

2. The work shall be scheduled and organized in a manner that will permit at least one, and
preferably two, RO skids to remain in service while the work is being performed.
3. The water treatment plant operating staff will work with the Contractor to help coordinate and
facilitate the work.
BONDS
The following bonds will be required for this project. Bid forms are included in this solicitation.
1. Bid Bond – a bond shall be submitted with each bid in an amount of 5% percent of the total bid
amount. Bids that are received without a bid bond will be rejected. An irrevocable letter of credit
or a certified check may be used in lieu of a Bid Bond.
The Owner reserves the right to retain all Bid Bonds until the successful bidder enters into a contract
or until thirty (30) calendar days after the bid opening, whichever is sooner. If any bidder refuses to
enter into a contract, the Owner may retain the Bid Bond as liquidated damages.
After the project has been awarded, the successful bidder will be asked to sign the Agreement and to
provide a Certificate of Insurance and the following bonds. Failure to submit these bonds may result in
the withdrawal of the award and forfeiture of the Bid Bond. The cost of all insurance and bonds shall be
included in the Bid Price.
2. Performance Bond – a bond to protect the Owner against failure to complete the project. This
bond shall be for the total bid amount and shall be in force until the project is accepted by the
Owner.
3. Statutory Bond – a bond to protect the Owner against the Contractor’s failure to pay suppliers,
vendors, or subcontractors. This bond shall be for the total amount of the project.
4. Maintenance Bond – a bond to protect the Owner from faulty work. This bond shall be for the
total bid price and shall be in force until 24 months after the date of acceptance.
INSURANCE
The Contractor shall purchase and maintain such insurance as will protect himself and the Owner from
claims which may arise out of or result from the Contractor’s execution of the work, whether such
execution be by himself or by any Subcontractor or by anyone directly or indirectly employed by any of
them.
The required insurance shall cover the following claims which may arise thru execution of the Contract:
1. Claims under Workman's Compensation, disability benefit and other similar employee benefit
acts;
2. Claims for damages because of bodily injury, occupational sickness or disease, or death of the
employees;
3. Claims for damages because of bodily injury, sickness or disease, or death of any person other
than the employees;
4. Claims for damages because of injury to or destruction of tangible property, including loss of use
resulting therefrom.

The Contractor shall purchase and maintain, during the contract time, General Public Liability and
Property Damage insurance including vehicle coverage. The insurance shall be in an amount of not less
than $200,000.00 for injuries, including accidental death, to any one person, and subject to the same
limit for each person in an amount of not less than $200,000.00 for injuries, including accidental death,
to any one person, and subject to the same limit for each person in an amount of not less than
$200,000.00 for injuries, including accidental death, to any one person, and subject to the same limit for
each person in an amount of not less than $1,000,000.00 on account of one accident and Property
Damage Insurance in an amount of not less than $200,000.00.
The Contractor shall furnish to the Owner Certificates of Insurance prior to execution of the Agreement.
These certificates shall contain a provision that coverage’s afforded under the policies will not be
cancelled unless at least fifteen (15) days prior written notice has been given to the Owner. Only
companies that have been approved by the Oklahoma Insurance Commission will be accepted.
HOLD HARMLESS
The Contractor shall save harmless the Owner from all suits, actions or claims brought on account of any
injuries or damages sustained by any person or property in consequence of any neglect or misconduct
by the Contractor including any and all employees, agents or subcontractors.
TECHNICAL SPECIFICATIONS
1. The replacement membranes shall be DOW Filmtec Fouling Resistant Low Energy BW30XFRLE-
400/34i or Toray Brackish Low Energy TMG20D-400 with 34 mil spacer. Performance
projections and operating parameters shall be based on a minimum permeate production rate
of 1,200 gpm per skid and a minimum recovery of 80% during the warmer months and 75%
during cooler months. Projections for membrane and anti-scalant performance shall be based
on current water analysis data. System run conditions may need to be adjusted if and when the
water quality changes. Design water quality data is available upon request. The successful
bidder shall submit the manufacturer’s membrane performance projections to the Owner within
ten (10) days after the City Council/AMA awards the contract.
2. Flange restrictor plates shall be stainless steel and designed to maintain the proper permeate
header backpressure to provide the permeate flux flow recommended by the membrane
manufacturer.
3. The manual lever-operated butterfly valves shall be Bray or approved equal and shall be same
the style as the existing RO skid butterfly valves. The valve pressure rating shall be suitable for
the intended application.
4. The third-stage booster pumps shall be implemented and employed to maintain a pressure on
the final stage to achieve the membrane manufacturer’s performance projection. For Toray, the
pressure is approximately 27 psi. The pressure on the final stage membranes will be set by
hand. There are no VFDs for the booster pumps or provisions for automatically adjusting the
pressure on the third-stage membranes. As part of the daily operating routine, the operating
staff will have to monitor and adjust the feed pressure by hand to maintain the final flux
balance.

After the project has been awarded but prior to commencement of work, the Contractor shall submit
the following to the Consulting Engineer for review and approval.
Submittal information for the membranes and related hardware being proposed for installation.
Submittal information for the normalized data analysis software.
Submittal information for orifice plates, butterfly valves and other components.
Membrane manufacturer’s Membrane Performance Projections for the membranes being
proposed for installation.

KNOW ALL MEN BY THESE PRESENTS:
That we, ______________________________________________, as Principal, and
________________________________________, as Surety, are held and firmly bound unto the City of
Altus, a Municipal Corporation, as Owner in full and just sum of ____________________ Dollars
($_______________) for the payment of which well and truly to be made, we, and each of us, bind
ourselves, our heirs, executors, administrators, devisees, trustees, successors or assigns, jointly and
severally, firmly by these presents.
The conditions of this obligation are such, that whereas, said Principal has by a certain contract,
between himself and the Owner dated the _________ day of _________________________, 20____,
agreed to construct the improvements described in said contract and to maintain the said
improvements in good condition for a period of one (1) year from the date of final acceptance of the job
by the Owner. Principal and Surety further guarantee the repair of any and all damage and or loss
resulting from faulty materials or workmanship provided or done by said Principal.
NOW, THEREFORE, if said Principal for the period of one (1) year from and after the completion and
acceptance of said improvements, shall maintain in good condition the said improvements, then this
obligation shall be void, otherwise to remain in full force and effect. It is further agreed that if the said
Principal and Surety, herein shall fail to maintain said improvements in good condition for the said
period of one (1) year, and at any time repairs shall be necessary the Owner will make the necessary
repairs and the cost of making said repairs shall be determined by the Owner or someone or persons
designated by them to ascertain the same, and, upon fifteen (15) days notice, the said amount
ascertained shall become due and payable to the Owner by the Principal or the Surety.
IN WITNESS WHEREOF, instrument is executed in _________counterparts, each one shall be deemed
