Can you provide sources that demonstrate how Jewish law perceives the concept of

“Intellectual Property” – i.e. protection for ideas, brand, name, image, activities etc.,

whether copyrighted or not?

Note: The subject matter is very complex and involves various details and reasoning. Different cases can have

varying issues. The following merely attempts to provide an overview of the general approaches. For practical

guidance one is encouraged to consult with a competent Rabbinic authority.

In Jewish law, there are various forms of protection that might come into play with

regards to an individual’s creative ideas.

In more recent times, discussion ensued as to whether a person retains legal-halachic

ownership over one’s intellectual inventions – either in the form of Torah insights, or

creative methods or machinery for performing certain tasks. If the inventor owns his

idea, than he retains protection over it as he does for any other possession he has.

Few authorities touch directly this issue of ownership (although some modern-day

authorities have attempted to extrapolate from various other responsum what they

would hold on this issue). Many point to a responsum of R. Yoseph Shaul Nathanson

(1810-1875) [1]1 where he writes that one retains exclusive rights to his Torah

compositions as he does with any creative invention. In more recent times, this opinion

was echoed by R. Yosef Shalom Elyashiv (1910-2012) [2]. [See also R. Shmuel HaLevi
