Brady Handgun Violence Prevention Act (Brady Bill)
• Passed in November 30, 1993 by President Clinton• initially required a five-day waiting period for customers purchasing
firearms or handguns, and mandated a national criminal background check on purchasers buying handguns from ATF-licensed dealers
• In the interval the so-called "instant-check" system, still used today, was developed by the FBI in 1998
• The "instant" check still requires a wait of three business days in instances where the system fails to positively approve or deny the applicant.
• Under the Brady Law, prior to the sale of a handgun, federally-licensed firearms dealers must verify the identity of a customer and receive authorization from the background checking system's database.
• Montana brought a case against the United States stating that the mandatory background checks were unconstitutional
• Supreme Court upheld previous unstated idea that checks were not unconstitutional and was approved 5-4
• States rights? Training courses, test, etc…• Permits with concealed weapons• Many states have different laws with gun
control issues (Vermont, Alaska, Arizona, Arkansas, Wyoming (Wyoming residents only)have no gun regulations with concealed weapons)
