Legal Framework

Gonçalo Ascensão –2016-11-08

EU 1025/2012 on European standardization;

(Annual) Union Work Programme (AUWP) for European Standardization (art. 8 of EU No 1025/2012);

Standardization request (art. 10 of EU No 1025/2012) adopted as an Implementing Act;

European Standardization Organizations (CEN, CENELEC, ETSI) have one month to accept Standardization Request

Once accepted, commit the ESOs to publish the identified deliverables within agreed deadlines

Amendments to mandates are not foreseen in EU 1025/2012

Need to systematically inform the Committee on Standards (CoS) on new drafts and proposals (including drafts amendments);

Decision whether amendment or Standardization request lays on CoS

Situation of certain amendments and new Standardization requests is not always clear

ESOs can accept or reject the standardization requests

Approach to deal with dangerous substances

When no harmoniozed test method exist

Terminology (common use of terms in standards such as evaluation of conformity, requirements)

Use of classes and thresholds (including a pass/fail approach)

Inclusion of essential characteristics not included in the mandate

Stuctural Products (different methods – Guidance paper L)
