Guam Public Utilities CommissionBoth the CCU and GPA have a Strong Working Relationship with the Guam PUCPUC members are appointed by the Governor and confirmed by the Legislature for six-year termsGPAs bond covenants require that the PUC must be able to act independentlyPUC members cannot be forced to resignThe PUC is required by the laws of the Territory of Guam to set rates which are fair, non-discriminatory and adequate to provide revenues sufficient to pay for all costs of owning, properly maintaining and operating the Authoritys electric utility systemThe PUC may require the Authoritys rates to be adjusted upwards or downwards at any time in order to meet these conditions; however, rates must always be set at a level to meet Indenture requirementsIn October 2001, the PUC approved a surcharge to enable GWA to pay $18MM in GPA past due billsIn May 2003, the PUC approved the request of the CCU to allow GWA to also pay for a $9MM Navy obligation The PUC approved the LEAC adjustment which took effect on October 1, 2003
