INTRODUCTION In accordance with the Professional Standards Division Standard Operating Procedures 212.0, this report has been generated for the administration and personnel assigned to the Professional Standards Division of the Bryan Police Department. The figures were generated from the Professional Standards Database. The information found in this database and stated in this report is statistical in nature. The purpose of the database is to find trends in officer activity that can be analyzed by the administration. All of the information contained in this report should be looked at objectively by those with the experience and knowledge necessary to make an educated analysis. The material in this report was compiled from Bryan Police Department records from January 1, 2007 through December 31, 2007. All police officers employed during this time period are included in this report regardless of their employment status at the time of printing.

METHODS OF CALCULATION The Professional Standards Database is capable of generating many reports for each of the types of data collected. In most of the reports and tables, the calculations should be obvious based on the information collected. In others, the data may appear to be “inaccurate” because the numbers will not add up to the totals. This is especially apparent in the Use of Force tables. The reason for this is the differences in the methods of calculation. For example, Use of Force statistics can be calculated in three ways. A “tally” of the uses of force can be calculated”
1. By record number. The number of different incidents, or record numbers, for for an officer can be counted.

USE OF FORCE ANALYSIS 2007
The Professional Standards Division reviewed the Use of Force Reports for the year of 2007 in comparison to 2006. There were 147 Use of Force reports filed in the year of 2007. 284 individuals were involved in these reports with 295 different types of force applied. The Use of Force reports were studied in reference to the geographic beat where they occurred, the race and sex of the offender, the types of force employed, the reason for contact and the shift assignment of involved officers. Geographic Beat: From 2006 to 2007 there was a 17% decrease in the total incidents of force applied to offenders. The only increase of use of force incidents was found in beat 4Z, with an increase of 75%, from 12 incidents in 2006 to 21 in 2007. The most significant decrease was found in beat 4A, a decrease of 45%, from 22 incidents in 2006 to 12 in 2007. When comparing 2006 and 2007, the following statistics were generated: Beat 5A showed a decrease of 14%, from 50 incidents to 43; Beat 5Z showed a decrease of 22.2%, from 36 incidents to 28; Beat 6A showed a decrease of 26.6%, from 30 incidents to 22; Beat 6Z showed a decrease of 17.5%, from 40 incidents to 33 incidents; Beat 7A showed a decrease of 22.7%, from 22 incidents to 17; and Beat 7Z showed a decrease of 22.2%, from 18 incidents to 14. Reason for Contact: Total Use of Force reports related to dispatched calls for service decreased again from 144 in 2006 to 122 in 2007, a decrease of 15.3%. This continues a trend of decrease from 2005 with 220 incidents. Total Use of Force reports related to On-View Offenses increased from 33 incidents in 2006 to 41 incidents in 2007, an increase of 24.2%. Use of Force incidents related to traffic stops decreased from 37 in 2006 to 30 in 2007, a decrease of 18.9%. Race and Sex of the Offender: The overall number of offenders that force was applied to decreased 17.2% from 2006 to 2007. When comparing the race and sex of offenders between 2006 and 2007, only the number of Black Female offenders increased by 8%, while Black Males decreased from 163 offenders in 2006 to 139 offenders in 2007, a decrease of 14.7%. Both White Females and White Males showed minor decreases of 10% and 3.5% respectively. The most significant decreases where seen with Hispanic offenders. Hispanic Female offenders decreased from 12 in 2006 to 6 in 2007, a decrease of 50%, while Hispanic Male offenders decreased from 74 in 2006 to 43 in 2007, a decrease of 41.9%. Over all three races, males remain the most frequent offenders to which force is applied, but the number of male offenders did decrease from 296 in 2006 to 240 in 2007, a decrease of 18.9%. Overall female numbers also decreased 10.6%, from 47 offenders in 2006 to 42 in 2007. Type of Force Employed: There was a decrease of the overall number of force employed on offenders between 2006 and 2007 of 379 uses in 2006 and 295 uses in 2007, a decrease of 22.2%. The most significant increase in the type of force employed was in the use of the Taser X26, increasing from 1 use in 2006 to 26 uses in 2007 (a percentage increase of 2500%) with only one use of the Taser X26 found to not be policy compliant. Also increasing in usage was ‘Handcuffed Subject w/o Arrest’, from 76 uses in 2006 to 94 uses in 2007, an increase of 23.7% and OC Spray increasing from 4 uses in 2006 to 18 in 2007, an increase of 350%. With these increases, the number of uses of ‘Firearm Pointed at Subject’ and ‘Firearm Drawn’ both decreased. The uses of ‘Firearm Drawn’ decreased from 4 uses in 2006 to 1 in 2007, a decrease of 75%. The uses of ‘Firearm Pointed at subject’ had a very significant decrease from 202 uses in 2006 to 95 uses in 2007, a decrease of 53%. The use of TRT Diversionary Devices also decreased 36%, from 25 uses in 2006 to 16 uses in 2007.

Policy Compliance: In 2007, one use of force out of 295 was found to be Non-Policy Complaint, 0.25% of all use of force incidents of 2007. This is a decrease from 2% in 2006 or 7 non-policy complaint uses of force out of 379 total uses of force. Shift of Officers Involved: In a slight change from past trends, the uses of force by Night Patrol decreased in both Night One, by 26.5% or 49 uses in 2006 to 36 in 2007, and Night Two, by 44.6% or 56 uses in 2006 to 31 in 2007. Power Shift’s uses of force decreased from 27 incidents in 2006 to 16 in 2007, 40.7%. Also a change from past trends, the uses of force by Day Patrol increased most significantly in Day One by 55% or 20 uses in 2006 to 31 in 2007. Day Two also increased from 23 uses in 2006 to 26 in 2007 or 13%. DDT officers reported an increase in uses of force from 9 in 2006 to 13 in 2007, an increase of 44.4%. Race and Sex of Officers Involved: Of the 72 individual officers who enacted use of force in 2007 (excluding the Tactical Response Team numbers), white males enacted use of force 76.4% of the time, with 55 officers out of those 72 (76.4%) being white male. This overwhelming number can be attributed to the greater number of white/male officers in the department than other races and females. Hispanic males showed the second most uses of force with 7 uses or 15.3% followed by white females with 6 uses of force or 8.3%. There were three occurrences of black males enacting force, representing 4.2% of the 2007 total, and one use of force by an Asian male, or 1.4% of the total. ANALYSIS: The overall decrease in Uses of Force in 2007 as compared to 2006 can likely be attributed to several factors. There were twelve Use of Force reports filed by the Tactical Response Team. One significant decrease is in the numbers for the Tactical Response Team’s use of ‘Firearm Pointed at Subject’, from 49 to 35, and Diversionary Devices, from 25 to 16. In order to obtain a more useful analysis of department-wide individual use of force the following chart removes all the TRT numbers from both the 2006 and 2007 Use of Force Reports. The chart on the next page shows 2006 and 2007 Use of Force by Type and Reason for Contact.

TOTAL 17 9 234 217 -17 -7.3% 217 205 -12 -5.5% As shown in above, filtering out the Tactical Response Team numbers highlights a significant decrease in use of force by individuals from 2006 to 2007.The Tactical Response Team accounted for 57 of the 295 total uses of force by the Bryan Police Department in the year 2007. This statistic is a decrease from the 82 uses of force by the Tactical Response Team in 2006. The overall decrease in the department’s use of force is a continuing trend of past years; from 467 incidents in 2005, 298 in 2006 and now 238 in 2007. The most significant increase shown is in the use of Tasers, from 1 use in 2006 to 26 in 2007. This continues an increase over the past years most likely attributable to the continuing increase in the number of patrol officers carrying Tasers. Prior to December 2006, 10 officers were certified and carrying Tasers on patrol. Currently there are 59 officers certified and carrying Tasers, an increase of 49 officers. This explains the large increase of Tasers used on subjects in 2007. There is also an argument for a correlation between the increased number of Tasers and the large decrease in the numbers for

‘firearm pointed at subject.’ Not only a correlation but causation as the availability of Tasers along with increased training in holding the firearm in the ready position rather than pointing the firearm at the subject causes officer to more readily deploy a Taser or not as quickly point their firearm at a subject. This correlation is important to note because it puts fewer officers in the position of potentially using lethal force with a firearm pointed at a subject. There is also no mechanism to account for the presence of a Taser and its affect on a subject’s willingness to avoid behavior necessitating an officer’s use of force. However, from 2005 to 2006 there was a sharp decrease in the use of OC Spray of 80% and attributed to the increasing availability of the Taser. 2007 saw a large increase in the use of OC Spray, a change from past trends. Along with the increase of both the Taser and OC Spray, there were significant decreases in use of Empty Hand Control, of 27.8%, and a decrease of 60.8% in the use of ‘Firearm Pointed at Subject,’ showing a decrease in the use of physical force by officers, therefore decreasing the risk of injury to officers, and a decrease in the threat of deadly force by pointing a firearm at a subject. Filtering out TRT numbers relating to the reasons for contact shows little change in the numbers of the other categories. The one tactical operation not attributed to TRT was from another officer’s involvement in a TRT operation. Uses of force related to dispatched calls decreased in 2007 while the number related to On-View offenses increased 24%, a large change from the drop of 52.9% from 2005 to 2006. Uses of force related to traffic stops decreased by 18.9% in 2007, a change from the 27.6% increase from 2005 to 2006. The following recommendations are based on this analysis of the 2006 and 2007 Use of Force Reports:
• Equipment: Software for capturing information from Tasers when connected to a computer via a USB cable is available and should be utilized to record information such as the number of times the Taser was deployed and the length of time the Taser was used.
• Training: Continue annual Taser training as it is having an effect on the type and amount of force applied to suspects. Also continue firearms training for the low ready position as opposed to the on target position which would appear to have an effect on the drop in use of force by ‘firearm pointed at subject.’
• Policy: Consider capturing data related to “Taser equipped” and “Taser Warned” to enable a more accurate analysis of the effectiveness of the presence of the Taser in reducing the need for use of force.

Vehicular Pursuit Analysis 2007
Bryan police officers initiated vehicular pursuits ten times in 2007, a decrease from fourteen pursuits initiated in 2006. Pursuits were studied in reference to geographic beat were the pursuit was initiated, day of week, traffic conditions, road conditions, length in minutes, reason for initiation of pursuit, capture of defendant, resulting injury, resulting property damage, policy compliance, and disciplinary action to officers. Additionally, pursuing officers were studied as to shift assignment and experience level. Corresponding graphs are included at the end of each section. Geographic Beat: In 2006, Beat 5Z had only one pursuit (7% of 2006 total) and in 2007 has the highest number of pursuits, 4 or 40%. Zone 5A had the second most pursuits reported at 3 (30%) but dropped from the 2006 total for 5A of 5 pursuits (36% of 2006 total). Beat 4Z had 2 pursuits (20%) and beat 7Z had 1 pursuit (10%). Beats 4A, 6A, 6Z, and 7A all had zero pursuits reported in 2007.

Day of the Week: While there was no distinguishable pattern between the day of the week and the number of pursuits initiated in 2006 (with 10 during the week and 5 during the weekend), in 2007 70% of the pursuits initiated by Bryan PD officers occurred on the weekend (Friday, Saturday, and Sunday) and 30% initiated on weekdays. Friday had the most occurrences with 3 (30%), followed by Monday, Saturday, and Sunday all with 2 (20%) pursuits initiated. Tuesday had one pursuit initiated (10%).

One of the 10 pursuits (9%) also reported traffic conditions of pedestrian along with the none to minor entry and one of the 10 pursuits (9%) reported traffic conditions of moderate.

Road Conditions: 9 of the 10, or 90% of the pursuits initiated in 2007 took place under dry road conditions with only one of the pursuits, 10%, happening with wet road conditions.

The longest pursuit was twenty-one (21) minutes in length with two pursuits fourteen (14) and fifteen (15) minutes in length. The overall average of pursuits for 2007 was approximately 6.5 minutes. The length of the longest three pursuits (07-VP005, VP006, and VP009) somewhat skews the overall average since 7 out of 10 pursuits lasted 4 minutes or less, with those 7 averaging 2.14 minutes. The average of those three longest pursuits was 16.7 minutes.

Pursuits Compared to Policy: Of the 10 pursuits enacted in the year 2007, two (2), or 20%, were found to be in violation of pursuit policy, with three offices involved in the two pursuits. 80%, or 8 out of the 10 pursuits were found to be policy compliant.

Pursuits by Officer’s Shift Assignments: Continuing past trends, Night Team 2 had the highest number of pursuits enacted by officers with 5 of 38.5%. 4 officers involved in pursuits in 2007 were from the Power Shift, accounting for 30.8% of pursuits. Day 2, Night 1, TSU, and DDT all accounted for 1 pursuit each, each accounting for 7.7% of the pursuit total for 2007. [Due to data calculation issues with the PSD database, Officer’s Lund and Poe were both involved in two pursuits, making Night 2’s count 5 instead of 4 and Power Shift’s count 4 instead of 3. Taking into account this data issue, the percentages change only slightly; Night 2-36.3%, Power-27.2%, and Day 2, Night 1, TSU, and DDT accounting for 9%.]

Reason for Initiation: The ten pursuits in 2007 were initiated for various reasons ranging from robbery and burglary suspects to three pursuits that involved the possibility of firearms, including one pursuit of suspects in a drive-by shooting. Three of the pursuits were initiated for DWI or possible DWI and one was initiated because “Driver exhibited impaired driving. Three of these four DWI related pursuits resulted in DWI charges being filed. Results: Of the ten pursuits, there were fifteen suspects involved of which 12 were apprehended, one by College Station PD. In all the pursuits were the offenders were apprehended charges were filed, including Evading charges on all offenders. Six of the pursuits resulted in property damage of which three resulted in damage to suspect vehicles (two tire deflations). Other damages were to one mailbox, two fences, one tree, one residence, one guardrail, and possible damage to an underground gas line and meter. In eight pursuits both emergency lights and sirens were used, with the other two pursuits only emergency lights were used. It is interesting to note that seven, (70%) of the pursuits in 2007 occurred in the first six months of the year and in consecutive months (March-June), while there were only three pursuits in the second half of the year.
