“IntellectualProperty,Rights,andAudiovisualArchives:ReframingBoundariesandPossibilities”

Audiovisual archives increasingly have to navigate legal and ethical environmentssurrounded by issues regarding intellectual property. Archivists find themselves inbetween conflicting directions of what can be done and what should be done. Archivalfunctions fromacquisition toaccessaregreatly influencedbyvaryingcontractsand lawswhile also adhering to long established principles and rights. From donorswith variousclaimstouserswithurgentinsatiableneeds,audiovisualarchivestodayareshapedbysuchboundarieswhilesearchingfornewpossibilities.Suchdiscussions,whileprimarilygroundedonlawandethics,impactarchivalpracticeanddelve into issues concerningoperations,management, and advocacy.They also influencehow audiovisual archives are theoretically conceived today and in the future. Asintellectualpropertyisnotonlyaquestionofeconomicclaimsforitintersectswithissuesofprivacy,freedomofinformation,politics,culturalpatrimony,indigenousrights,andthevastnessofhumanrightswithallitsintricacies.Indigenousculturalandintellectualproperty(ICIP) isapervasive issueintheregionandbeyond. It isagrowingconcernamongaudiovisualarchivistsasculturalexpressionsandtraditionalknowledgeareincreasinglyrecorded,preserved,accessed,andusedinvariousmoving imageand soundmaterials.Mattersof control, ownership, and representationattimes are in conflict between self-determined practices, communal laws, customaryobligations, and legal instrumentsof the state.Thuspresentingchallenges toaudiovisualarchivistswhomustbalancesuchethicalconcernswhileaddingalayerofanthropologicalandlegalissuestothemyriadoftechnicalchallengestheyfacetoday.

Whatisthecurrentlandscapeofintellectualpropertylawintheregion?Whatarecurrenttrendsoutsideof the region thatmay influencehow IntellectualPropertyRights (IPR) isconceivedinSoutheastAsiaandthePacific?Howwouldtheseimpactaudiovisualarchives?What are some ethical issues arising from these developments?How do these legal andethicalboundariesinfluencehowweacquire,manage,andprovideaccesstocollections?How do audiovisual archives balance privacy and access? What are conflicting issuesbetweengeneralculturalheritageandspecific indigenousrights?What is theaudiovisualarchivesroleinpromotinghumanrights?Andgivenalltheseandmore,whatisthefutureofarchivesandarchivalthought?The20thSEAPAVAAConferenceseekstoaddresstheseissuesbygatheringdifferentvoicesduring its two-day Symposium. It aims to reframe the boundaries and possibilities ofaudiovisualarchivesfromlegal,ethical,practical,andtheoreticalperspectivesinnational,regional,andinternationalcontexts.SEAPAVAA invites archivists, lawyers, anthropologists, cultural workers, academics,scholars, and others actively engaged with the conference theme to submit proposals.Topicsofinterestincludebutarenotlimitedtothefollowing:• CulturalRepatriation• RightsManagementSystems• UtilisationofCulturalHeritage• ConflictingPatrimonialClaims• OrphanWorks• IndigenousCulturalIntellectualProperty(ICIP)• FairUse/FairDealings

2. Theproposalsshouldinclude:• Titleofpresentation• Abstract,maximumof250words• NameandInstitution(whereapplicable)ofproposer

3. TheOrganiserswillreviewallsubmittedproposalsandwillsendnotificationofacceptanceby15April2016.

4. Speakersneedtoconfirmtheirattendanceby30April2016.

5. Presenterswillhaveupto30minutestodelivertheirpresentationsduringtheConference.

6. Allacceptedproposalsmustbesubmittedasafinalpaperorpresentationpriorto

theConferenceforpossiblepublicationbySEAPAVAA.

7. Thetravelexpenses,accommodationandsubsistenceofattendingthe20thSEAPAVAAConferencearethefullresponsibilityofspeakers.

8. Speakersarerequiredtoregisterandpaytheconferencefees.
