PLEASE TAKE NOTICE that, defendants the United States of America,
Eric H. Holder, Jr., the Attorney General of the United States, and Eric K.
Shinseki, Secretary of the Department of Veterans Affairs (Federal Defendants)
will move this Court on February 25, 2013, at 10 pm, or as soon thereafter as
counsel may be heard in the United States District Court for the Central District of
California, Courtroom 2, 312 N. Spring Street, Los Angeles, California, for an
order granting the Federal Defendants motion to dismiss for lack of subject matter
jurisdiction pursuant to Federal Rule of Civil Procedure 12(b)(1). This motion is
based on the attached Memorandum of Points and Authorities, and is made
following a conference between counsel for Plaintiffs and federal defendants as
required by Local Rule 7-3, which took place on November 6, 2012. Federal
defendants also conferred with counsel for intervenor-defendant Bipartisan Legal
Advisory Group of the U.S. House of Representatives on December 13, 2012, who
indicates that BLAG reserves the opportunity to respond to this motion.
