Scope LVD 2014/35/EU

• No substantial changes in scope description compared to 2006/95/EC

• Scope

• Electrical equipment designed for use with a voltage rating of between 50 and 1000 for AC and between 75 and 1500 V for DC

• Exclusions • Electrical equipment for use in an explosive atmosphere

• Electrical equipment for radiology and medical purposes

• Electrical parts for goods and passenger lifts

• Electricity meters

• Plugs and sockets for domestic use

• Electric fence controllers

• Specialised electrical equipment, for use on ships, aircraft or railways

• Custom built evaluation kits for professionals to be used at R&D facilities

Scope EMC 2014/30/EU • No substantial changes in scope description compared to 2004/108/EC

• Scope • Equipment

• Finished appliance

• Component/sub-assembly (intended for incorporation by end-user)

• Mobile installations • Fixed installations

• Several types of appliances/devices assembled and installed to be used permanently at a predefined location

• Exclusions • R&TTE equipment (Directive 1999/5/EC)

• EMC benign equipment

• Custom built evaluation kits for professionals to be used at R&D facilities

Essential requirements LVD 2014/35/EU

• No changes compared to 2006/95/EC

• Electrical equipment constructed in accordance with good engineering practice in safety matters

• Electrical equipment does not endanger the safety of persons, domestic animals or property when properly installed and maintained and used in applications for which it was made

• Principle elements of the safety objectives (Annex I) :

• General conditions

• Protection against hazards arising from the electrical equipment

• Protection against hazards which may be caused by external influences on the

electrical equipment

• LVD Notified Bodies will no longer exist

EMC 2014/30/EU

• No substantial changes compared to 2004/108/EC (for manufacturers)

• Conformity assessment procedure

• Two options : choice up to manufacturer

• Module A “Internal production control”

• Module B “EU-type examination” followed by

Module C “Conformity to type based on internal production control”

• EMC Notified Bodies : new obligations, renotification required

Economic operators & obligations

• Economic operators : manufacturer, authorised representative, importer, distributor

• Manufacturer : Any natural or legal person who manufactures apparatus or has apparatus designed or manufactured, and markets that apparatus under his name or trade mark

• Authorised representative : Any natural or legal person established within the Union who has received a written mandate from a manufacturer to act on his behalf in relation to specified tasks

• Importer : Any natural or legal person established within the Union who places apparatus from a third country on the Union market

• Distributor : Any natural or legal person in the supply chain, other than the manufacturer or the importer, who makes apparatus available on the market

• Manufacturer

• Fully responsible for compliance as in earlier EU Directives

• e.g. technical documentation, conformity assessment procedure, declaration of conformity, CE marking, …

• Traceability requirements

• Product (e.g. type, batch, serial number)

• Manufacturer : name & postal address on product

• Information requirements

• Information/instructions, DoC, language requirements as in national transpositions

• Corrective actions and collaboration with authorities

Economic operators & obligations

• Authorised representative

• Written mandate from the manufacturer

• Can not take responsibility for design and establishing technical

documentation

• Minimum tasks within mandate

• Keep DoC and technical documentation

• Work with national authorities to demonstrate compliance or help to ensure

compliance

• Importer

• Place only compliant products on the market

• Ensure manufacturer has carried out its duties (conformity assessment

procedure, technical documentation, CE marking, documents, traceability)

• Indicate their name, registered trade name or registered trade mark and

postal address on the product

• If not possible, then on packaging or in documentation

• Keep DoC for 10 years and ensure technical documentation can be made

available

• Corrective actions and collaboration with authorities

• Act with due care in relation to requirements

• New LVD 2014/35/EU will replace LVD 2006/95/EC as of 20 April 2016

• New EMC 2014/30/EU will replace EMC 2004/108/EC as of 20 April 2016
