1. Bids will only be submitted online on the e-Procurement portal of the Government of
Punjab i.e. https://eproc.punjab.gov.in. Bidders who wish to participate in online tenders
will have to register themselves on https://eproc.punjab.gov.in for which valid Digital
Signature (Class II or III) are required, using which they can sign their electronic bids.
Bidders can procure the same from any of the license certifying Authority of India. The
online registration of the bidders on this portal is free of cost.
2. For any portal related technical queries, prospective bidders can call at 24x7 central
helpdesk numbers i.e. 0120-4200462, 4001002, 4001005 and 6277787 or at local helpdesk
numbers 0172-2970263, 2970284 from 9:00 AM to 5:00 PM on all government working
days or reach through e-mail at eproc@punjab.gov.in, support-eproc@nic.in.
3. No physical submission of Technical and price / commercial bid will be entertained as it
should be furnished online only. No fax, e-mail, SMS, letters or any other form of
communication will be entertained for the same.
4. Bids which are not submitted in the prescribed form and/or without deposit of requisite
tender fee and/ or earnest money or any other deviation from the terms and conditions of
the tender notice shall be rejected out-rightly.
5. Conditional offers/ tenders shall be out rightly rejected.
6. The Technical bids shall be opened on 28-02-2020 at 10:00 A.M. in the Committee Room
of Pungrain, Anaaj Bhawan, SECTOR 39-C, CHANDIGARH. The date and time for the
financial bids will be notified online only to the Technically Eligible Bidders.
7. The tenderer is mandatorily required to submit the documents mentioned in the Terms &
Conditions, along with the technical bid. The financial bid of only those bidders shall be
opened, who qualify the technical bid.
8. The tenderer(s) shall be at liberty to be present, in person or through their authorized
representative(s) at the time of opening of the tender as specified in the Tender. In case,
authorized representatives are to be present, they must furnish the authority letter from the
tenderer, on whose behalf they are representing otherwise they will not be allowed to
participate in the opening of tender.
9. Any attempt direct or indirect, to cast influence, negotiation on the part of the tenderer with
the officials/authority to whom he shall submit the tender or the tender accepting
officials/authority before the finalization of tenders shall render the tender liable for
rejection.
10. Any further communication or corrigendum/ addendum will be published on e-Tendering
website only.

Gentlemen/Sirs,
On behalf of all the State Procurement Agencies in the State of Punjab, MD
PUNGRAIN (Punjab State Grains Procurement Corporation) Anaaj Bhawan, Sector-39 C,
Chandigarh-160036 invites e-tenders for the purchase of 13,85,000 wooden crates. However,
this number can increase or decrease at the time of issuing supply orders to the successful
bidders as per the requirement of State procuring agencies
1- THE TERMS AND CONDITIONS:
The terms and conditions governing the purchase are given at Annexure "I" and the technical
specifications of wooden crates are as Annexure "II"
2- TENDER FEE (NON REFUNDABLE):
A tender fee (Non-refundable) of Rs 5000/- should be paid through the online payment gateway
of the e-portal during the submission of the tender.
3- SIGNING OF TENDER:
Person signing the tender should state in what capacity he/she is signing the tender i.e. as Sole
Proprietor of a firm, or as Secretary, Managing Director, etc. of a limited company. In case of
partnership firm, the tender must be signed by all the partners. However, in cases where one of
the partners signs the tender, he/ she must upload the authority letter duly signed by all other
partners authorizing him/her to sign and submit the tender documents on behalf of all other
partners.
4- SUBMISSION OF TENDERS:
The parties will submit e-tender under two bid system i.e. Technical Bid and Financial Bid
through e-tendering website http://eproc.punjab.gov.in. The technical bid (Annexure III) must
be uploaded along with all the documents/ Annexures as mentioned in the Check list (Annexure
IV) and duly signed on all pages and complete in all respects till the date and time specified in
the tender notice. No Tender and/or documents submitted after scheduled date of closure of
submission of the tenders will be accepted in any case. Financial bid(s) of only those tenderers
will be opened who qualify in the technical bid.
5- ACCEPTANCE OF TENDER:
The Managing Director, PUNGRAIN reserves the right to accept or reject tender(s) without
assigning any reasons.

TERMS AND CONDITIONS
FOR THE PURCHASE OF WOODEN CRATES DURING RMS 2020-21
1) Eligibility: Every tenderer shall have to fulfill the following conditions to be
eligible/ technically qualified for submitting this tender:
i. He/ She should be a citizen of India and not less than 18 yrs. of age,
if the tender is submitted as an individual/proprietor.
ii. If the tender is submitted by any society, company or a partnership
firm, it should be registered under the appropriate legislation or the
rules framed there under.
iii. The entity must possess a valid PAN number and GST registration
number.
iv. A Company, firm or individual is/are not entitled to participate in the
tender, if the same has been blacklisted or proceedings for
blacklisting are under consideration by any Central
Ministry/Department, State Govt./ Co-operative/ PSU Board or
Corporation or Local body.
v. Parties/firms should be manufacturer/s of wooden crates and having
valid license of saw mill (Arra). The license of the saw mill (Arra)
should be in the name of the bidder (in case of individual/ firm/
company) or proprietor of bidding firm applying for the tender.
Note: As per "The Punjab Regulations of Wood Based Industries
Rules, 2019" published vide notification no. G.S.R
46/C.A.16/1927/Ss. 32, 33, 35-A, 72,76,77 and 78/2019 dated
3.12.2019 (Annexure VIII), all such wood based industries or
processing units which are exempted from requirement of license as
mentioned in rule 7(4) shall also be eligible, provided they possess &
upload the requisite registration certificate as prescribed under rule
10 of the said Rules.
vi. As per notification No. COS/Start-ups/2019/11288 dated 16-08-2019
of Department of Industries and Commerce, Punjab (Please refer
Annexure VI), an entity registered as a Start-up in Punjab as per
chapter 16.1 of Detailed scheme & operational guidelines, 2018 of
Industrial and Business Development policy 2017, shall be eligible
for relaxations permissible under the said notification, subject to the
condition that the startup meets the other quality and technical
specifications as part of the qualifying requirements of the
procurement of wooden crates.
Purchase preference shall be given to local suppliers as per the
provisions of Public Procurement (Preference to Make in Punjab)
Order 2019 notified by Department Of Industries And Commerce

(Controller of Stores), Govt. Of Punjab vide order dated 03.09.2019.
(Please refer Annexure VII), for which a local supplier/ start up must
have minimum 40% of local content as per Clause 4 of the order and
abides by Clause 8 of the said order for verification of local content.
The prescribed margin of purchase preference shall be 15%. The
procedure for determining such preference shall be followed as per
Clause 2(b) of the said Order.
vii. Tenderer has to deposit online tender fee of Rs 5000/- (non-
refundable)
viii. EMD: Each tenderer will deposit Earnest Money @ Rs.50/- per crate
for the total number of wooden crates offered which shall be paid
through payment gateway of e-tender portal.
On the portal, Rs. 25,00,000 is shown as EMD for full quantity of
50,000 crates. However, Bidder submitting bid for lesser quantity
need to deposit EMD @ Rs.50/- per crate for the number of offered
crates only and the excess amount shown in portal may be filled in as
exempted amount. In case of acceptance of tender, the EMD will be
converted into security. In case of default / non-fulfillment of any of
the tender terms & conditions to supply the allotted quantity (ies)
after placement of order, PUNGRAIN can forfeit the security in part
or full and further PUNGRAIN will purchase the crates at the risk
and cost of the defaulting party. NO TENDER WILL BE ACCEPTED
WITHOUT EARNEST MONEY / LESS EARNEST MONEY. Tender(s)
without earnest money / less earnest money will be rejected straight
way.
The technical bid (Annexure III) must be uploaded along with all the
documents/ Annexures as mentioned in the Check list (Annexure IV)
and duly signed on all pages and complete in all respects till the date
and time specified in the tender notice.
Financial bid(s) of only those tenderers will be opened who qualify in
the technical bid.
2) Price Bid/Rate: Every tenderer will quote tender rate for a minimum quantity of
10,000 and a maximum quantity of 50,000 Wooden Crates. The rate
quoted for a quantity less than 10,000 will not be entertained.
However, MD, Pungrain reserves the right to increase or decrease the
total number of crates ordered to be supplied by a supplier depending
upon the requirement of the State Procuring Agencies and
performance of the supplier.
The Rate quoted should be inclusive of GST and all other taxes and
also including F.O.R. for delivery to destination, which can be any
location in the State of Punjab.
6 3) Inspection: The inspection of the crates will be carried out both at the premises/
manufacturing unit of the supplier as well as at the time of receipt of
crates at the destinations. The wooden crates shall be first inspected
by the representative(s) of PUNGRAIN/concerned agency at the
premises/ manufacturing unit of the suppliers within five days after
the receipt of Inspection offer. Only the crates found to be as per
prescribed specifications & passed by the Inspecting team during
inspection at the premises of the supplier shall be supplied at the
designated storage centre. Further, only such wooden crates which are
approved at the time of inspection at the manufacturing unit and are
also found to be as per specifications on inspection at the destination
will be accepted. The wooden crates rejected by the consignee at the
time of taking delivery will have to be replaced by the supplier within
7 days from the date of issue of the letter from the consignee, failing
which PUNGRAIN/ State agency will be entitled to purchase crates
at the risk of the supplier without any further reference to supplier.
Pungrain/ State agency reserves the right to get the Wooden Crates
tested from any specialized Govt. Agency or any Govt. Authorized
Laboratory/firms for quality. In such case, the testing and other
incidental charges as applicable shall be borne by the concerned
supplier.
4) Delivery: Entire supply will be completed by the supplier as per following time
schedule:-
50% of the total crates ordered = upto 20-03-2020
Balance 50% Crates (without L.D. charges)= upto 03-04-2020
With 2% L.D. charges = upto 13-04-2020
5) Late Delivery (LD)(i) The delivery of wooden crates as per above time schedule is the
essence of the supply order. All the suppliers shall have to adhere to
the time schedule prescribed in the tender. No delivery will be
accepted after 13-04-2020
However, Managing Director, PUNGRAIN/ State agency reserves the
right to extend the validity of supply order(s) in case of natural
calamities like heavy rains, floods, etc. OR if he/she is satisfied that
the reasons for delay were beyond the control of supplier with LD
charges upto 2% or even without LD charges.
(ii) Risk purchase at the cost of supplier will be made by the
PUNGRAIN/ State agency in case the supply is not made as per the
time schedule or laid down specifications and terms and conditions.
The difference of such cost thus incurred will be recovered from the
supplier, if need be, by taking legal recourse.
6) Penalty: If it is found that any party has supplied crates not as per
specifications, a quality cut of Rs. 15/- per kg. for the less weight will

be imposed by PUNGRAIN/ respective Agency up to a weight of 32
kg. However, if the crates supplied are found to be below 32 kg, the
same shall be rejected and have to be replaced by the tenderer/
supplier at his own risk and cost.
In all such instances, where the crates supplied by the supplier are
found to be below 32 kg in weight or are found deficient w.r.t.
prescribed specifications and the same are not replaced by the
supplier or the supplier fails to deliver the ordered number of wooden
crates in stipulated time despite giving an opportunity for
replacement/ delivery as the case may be, MD Pungrain reserves the
right to blacklist the tenderer/supplier for a period of two years during
which he shall not be eligible to participate in the tenders floated by
Pungrain/ State procurement Agencies.
7) Payment: After the F.O.R delivery of the ordered number of wooden crates as
per the specifications/ terms & conditions mentioned in the work/
supply order, the supplier will submit bills within 15 days to the
concerned District Manager of the PUNGRAIN/ State agency along
with the Inspection note and receipt of crates from the concerned
officials indicating clearly that the crates received are as per
specifications. 100% payment shall be made against physical delivery
of accepted wooden crates duly supported with satisfactory inspection
notes along with weight memo at destination and after receipt of
complete supply order. The indenting agency would have option to
release payments in RTGS/Electronics mode also.
8) GST Compliance: i. The tenderer/bidder shall ensure that the invoice to be raised with
Pungrain/ State agency is compliant with the provisions of the GST
law and contains the requisite details in an accurate manner for
claiming of tax credits, if applicable, by Pungrain/ State agency.
ii. This shall be ensured by the tenderer/bidder that the invoice raised
by him during a month is appropriately reported in the GST returns
of the said month.
iii. Pungrain/ State agency reserves the right to claim from the
tenderer/bidder any amount of tax, interest, penalty and litigation
cost, if any, that may be incurred in future due to GST
reporting/compliance mistake(s) on part of the tenderer/bidder.
iv. Pungrain/ State agency shall not be under any obligation to entertain
claims related to future obligation arising on buyer related to input
tax credit (ITC) mismatch in GST return or wrongful availment of
ITC by buyer, if the same not intimated within a period of 90 days
from the date of issue of invoice.
8 9) The material shall be packed very carefully as the PUNGRAIN/ State Agency shall not
be responsible for any damage/loss in transit. The supplier will be bound to ensure the
delivery of wooden crates at the destination in sound condition.
10) The rates quoted will remain valid for 45 days from the date of opening of tenders and
this period would be further extendable at the discretion of MD, Pungrain
11) Security without interest will be released after three months of the completion of the
supply order and after the supplier has discharged all obligations.
12) The listing/bank charges, if any, shall also be borne by the supplier.
13) Any change in the constitution of the firm (whether partnership or sole proprietors)
PUNGRAIN must be intimated immediately. In case of partnership, firm’s share of each
partner must be indicated and a certified copy of the deed of partnership be attached with
the Firm.
14) Whereas PUNGRAIN would deal only with a partner in whose name authority letter
bearing signature of all other partners is appended for the signing of the relevant papers
including tender form.
15) PUNGRAIN has the right to distribute the supply order of crates to more than one
supplier at L-1 rate. In such case, negotiations can be held with L-2 and so on for
supplying wooden crates at L-1 rate to cover the entire required quantity.
16) Managing Director PUNGRAIN reserves the right to black list a tenderer and forfeit his/
her deposited EMD if the tenderer
a. fails to comply with the stipulated terms and conditions for the supply of crates on the
acceptance of his/ her offer.
b. refuses or fails to supply crates as per the prescribed specifications or at the rate quoted
by him/ her after acceptance of his/her offer.
In such cases, an opportunity of hearing would be given to the tenderer before black
listing
17) The tenderer who has been blacklisted by any Government Agency, shall not be eligible
to participate in the tender process, during the con-currency of such blacklisting. If any
tenderer is found to be blacklisted at a later stage, his technical as well as financial bid, if
applicable, shall be rejected. The earnest money and security amount (if any) deposited
by him shall be forfeited. An affidavit regarding non-black listing/ non prosecution of
tenderer is to be submitted as per Annexure V.
18) Subletting of contract is not allowed under any circumstances. If any party / firm is
found to have sublet the contract awarded for supply of wooden crates, that party / firm
will be liable for blacklisting.
19) Managing Director, PUNGRAIN reserves the right to reject any or all the tenders
without assigning any reasons.

SPECIFICATIONS FOR WOODEN CRATES
1. Each dunnage piece of crate will be of 5’x3’ and will be made from Eucalyptus wood or
any other hard wood duly dried and seasoned.
2. The lower members, 4”x2” in section, will be 5 in number and each will be 3’ long
spaced 14-1/2” center to center. The top members will also be 5 in number and each will
be 5’ long and 2-1/2” x 2” in section, spaced 8-1/2” center to center. The higher
dimension of the section of each member will be vertical.
3. There shall be no joint in any of the members.
4. The dunnage shall be properly nailed with, sufficient number of nails to the frame
reasonably rigid with proper fit. There shall be at least two nails at each corner joint and
one at every other joint. No nail shall project down the wooden rafter or be exposed, so
as to avoid source of danger to the gunnies. The nail head shall beat the top and the nail
shall be bent over at the bottom of the crate for “1”.
5. No member shall have cracks, as it will endanger its structural strength.
6. The section of each member will be generally uniformed without being heavily beveled
at corners so as to reduce its strength.
7. The wood shall be free from loose knots which would reduce its structural strength.
8. Wood damaged by white ants/termites shall not be used.
9. The top of each dunnage piece will be at one level
10. The weight of each crate shall be 40 Kg with a tolerance limit of 5 %
11. (a) Size of the Crate 153cm x 92cm
(b) Size of upper batten 6.35cm x 5.08cm x 153cm
(c) Size of lower Batten 10.16cm x 5.08cm x 92 cm
12. The wood used for making crates should be termite treated.
13. Crates should be coloured Black with name of the supplier firm and year of supply
stenciled on them.

Subject: Relaxations of Norms in Public Procurement for Start-ups based in Punjab.
In order to build a strong Ecosystem for nurturing innovation and Start ups in the State, by providing
opportunity to Start ups to scale up and to allow them to compete with experienced entrepreneurs and companies
in public procurement by relaxing the norms for public procurement for them, the following relaxations will be
provided to eligible Start ups of the State, subject to the condition that the Start ups meet the other quality and
technical specifications as part of qualifying requirements of the procurements:
1. Eligibility of start ups for the relaxations
1. The entity should be registered as a Startup as per chapter 16.1 of Detailed Scheme & Operational
Guidelines, 2018 of Industrial and Business Development Policy 2017, issued by Department of
Industries & Commerce, Government of Punjab.
2. Registered start ups will submit the self attested copy of the registration to the procuring agency
in order to avail the relaxations.
3. Registered Start ups should directly participate in tender and not through any intermediaries (their
dealers/agents/distributors), and will not subcontract to any other firm and carry out the entire
manufacturing/work/services at their enterprise.

3. Purchase Startups will also be eligible for purchase preferences accruing to all Industries in
Preferences the State in the Public Procurement (Preference to Make in Punjab) Order, 2019.
This issues with the concurrence of Finance Department conveyed vide their I.D. No. 2/29/19-4FE5/
692 of dated: 24.05.2019.
The above instructions may be brought to the notice of all concerned and shall be applicable to all the
tenders floated/ invited after issue of these instructions.

No.COS/PPO-2019/ 11726.- Subject: Public Procurement (Preference to Make in Punjab)
Order 2019.
The Governor of Punjab is, hereby, pleased to accord Approval to Public Procurement (Preference to
Make in Punjab) Order 2019. This will give a fillip to the manufacturing sector in Punjab through incentivizing
local value addition, by providing them a purchase preference in public procurement done by the state Govt.
departments and its agencies.
Whereas, it is the policy of the Government of Punjab to promote manufacturing and production of
goods in Punjab with a view to enhance income and employment generation, and whereas, procurement by the
Government is substantial in amount and can contribute towards this policy objective.
Therefore, the following order is issued with regard to procurement of goods by procuring entities. It is
clarified that this order does not apply to procurement of services and works contracts:-
1. Definitions: For the purposes of this order:
Local content means the amount of value added in Punjab which shall be the total value of the item procured
minus the value addition to the item outside the state of Punjab (excluding taxes), as a proportion of the total
value, in percent.
Local supplier means a supplier whose product offered for procurement meets the minimum local
content as prescribed under this order or by competent Departments in pursuance of this order.
L-1 means the lowest tender or lowest bid or lowest quotation received in a tender, bidding process or
other procurement solicitation as adjudged in the evaluation process as per the tender or other procurement
solicitation.

Margin of purchase preference means the maximum extent to which the price quoted by a local
supplier may be above the L-1 for the purpose of purchase preference.
Procuring entity means a department or subordinate office, autonomous body, boards, corporations
owned or controlled by the Government of Punjab, and includes the urban local bodies and PRIs in the
state.
Works Contract means a contract as defined u/s 65 of Finance Act.
Divisible goods mean goods which can be broken up into smaller units for procurement.
2. Requirement of Purchase Preference: Subject to the provisions of this order, purchase preference shall
be given to local suppliers in all procurements undertaken by procuring entities controlled by the Government of
Punjab in the manner specified hereunder.
a) In procurement of goods where there is sufficient local capacity and local competition so that there are
at least six local manufacturers/suppliers eligible as per the tender conditions as identified by concerned
department and where the estimated value of procurement is Rs. 30 lakhs or less only local suppliers
shall be eligible.
b) In the procurements of goods which are not covered by paragraph (a) i.e. estimated value of procurement
is more than 30 lakhs or there is not sufficient local capacity present and in case of goods which are
divisible in nature, the following procedure shall be followed.
i. Among all qualified bids, the lowest bid will be termed as L1.If L1 is from a local supplier/
manufacturer, the contract for full quantity will be awarded to L1(subject to capacity).
ii. If L1 bid is not from a local supplier, 50% (subject to capacity) of the order quantity shall be awarded
to L1. Thereafter, the lowest bidder among the local suppliers will be invited to match the L1 price
for the remaining 50% quantity subject to the local suppliers quoted price falling within the prescribed
margin of purchase preference and contract for that quantity shall be awarded to such local supplier
subject to matching the L1 price. In case such lowest eligible local supplier fails to match the L1 price
or accepts less than the offered quantity the next higher local supplier/manufacturer within the
margin of purchase preference shall be invited to match the L1 price for remaining quantity and so
on. And contract shall be awarded accordingly. In case some quantity is still left uncovered on local
suppliers, then such balance quantity may also be ordered on the L1 bidder.
c) In procurements of goods not covered by sub-paragraph (a) and which are not divisible and where
the bid is evaluated on price alone the following procedure shall be followed:
i. Among all qualified bids, the lowest bid will be termed as L1. if L1 is from a local supplier, the
contract will be awarded to L1.
ii. If L1 is not from a local supplier, the lowest bidder among the local suppliers will be invited to match
the L1 price subject to local supplier's quoted price falling within the margin of purchase preference
and the contract shall be awarded to such local supplier subject to matching the L1 price.
iii. In case such lowest eligible local supplier fails to match the L1 price, the local supplier with the
next higher bid within the margin of purchase preference shall be invited to match the L1 price and
so on and contract shall be awarded accordingly, In case none of the local suppliers within the
margin of purchase preference matches the L1 price then the contract may be awarded to the L1
bidder.

3. Exemption of small purchases: Notwithstanding anything contained in paragraph 3, procurements where
the estimated value to be procured is less than Rs. 1 lakh shall be exempt from this Order. However, it shall be
ensured by procuring entities that procurement is not spilt for the purpose of avoiding the provisions of this
Order.
4. Minimum local content: The minimum local content shall ordinarily be 40%. The concerned department
may prescribe a higher or lower percentage in respect of any particular item and may also prescribe the manner
of calculation of local content.
5. Prescribed Margin of Purchase Preference: The prescribed margin of purchase preference shall
be 15%.
6. Requirement for specification in advance: The minimum local content, the prescribed margin of purchase
preference and the procedure for preference shall be specified in the notice inviting tenders or other form of
procurement solicitation and shall not be varied during a particular procurement transaction.
7. Exemption: Concerned Departments should enlist the items which are to be exempted from this order
within three months from date of issuance of this order and this list should be sent to Member Secretary,
Standing Committee.
8. Verification of local content:
a. The local manufacturer/supplier at the time of tender, bidding or solicitation shall be required to provide
self-certification that the item offered meets the minimum local content and shall give details of the
location(s) at which the local value addition is made.
b. In case of procurement for a value in excess of Rs. 2crores, the local manufacturer/supplier shall be
required to provide a certificate from the statutory auditor or cost auditor of the company (in the case of
companies) or from a practicing cost accountant or practicing chartered accountant (in respect of
suppliers other than companies) giving the percentage of local content.
c. Every local manufacturer/supplier shall be required to give a certificate detailing the local content in his
product. This list shall be put in public domain and 7 working days shall be provided for filing any claim/
objection regarding the genuineness of this certificate. If no claim/objection is received within the
prescribed period, the local content certificate shall be deemed to be correct.
d. Concerned Department may constitute committees with internal and external experts for independent
verification of self-declarations and auditor's/accountant's certificates on random basis and in the case
of complaints. For this purpose, the concerned department may seek help from Controller of Stores.
e. Any claim/objection regarding the genuineness of certificate of local content shall be filed by the
complainant on an affidavit of Rs.25.
f. False declarations under Para(8a) and (8b)will lead to debarment and blacklisting of such suppliers for
two years by the procuring entities.
g. A supplier who has been debarred by any procuring entity for violation of this Order shall not be eligible
for preference under this order for procurement by any other procuring entity for the duration of the
debarment. The list of such debarred suppliers under this Order by any procuring entity shall be sent to
O/o Controller of Stores, Punjab, and consolidated list of debarred and blacklisted suppliers shall be
circulated to all other Govt. Departments.

h. A Committee under Chairmanship of Controller of Stores, is constituted with following members :
I. Finance department nominee: -Member
II. Excise and Taxation Commissioner or his nominee: - Member
III. Controller, Printing & stationary : - Member
IV. Additional Controller, Controller of Stores: - Member Secretary
V. Director, Department of Governance Reforms or his nominee: -Member
This Committee will look into all the issues related to debarment:
(i) The fact and duration of debarment for violation of this Order by any procuring entity shall be
promptly brought to the notice of this Committee through the concerned Department or in some
other manner.
(ii) On a periodical basis such cases will be consolidated and a centralized list or decentralized list of
such suppliers with the period of debarment will be maintained with this Committee.
(iii) In respect of procuring entities other than the one which has carried out the debarment, the
debarment shall take effect prospectively, from the date of debarment order issued, in such a
manner that ongoing procurements are not disrupted.
(iv) All disputes related to debarment by procuring entities shall be considered by this committee.
9. Specifications in Tender and other procurement solicitations:
a. Procuring entities shall endeavour to see that eligibility conditions, including on matters like turnover,
production capability and financial strength do not result in unreasonable exclusion of local suppliers
who would otherwise be eligible, beyond what is essential for ensuring quality or creditworthiness of the
supplier.
b. Procuring entities shall within 3 months of the issue of this policy review all existing eligibility norms and
conditions with reference to paragraph 'a' above.
10. Assessment of supply base by Departments: The Concerned Department shall keep in view the
domestic manufacturing/supply base and assess the available capacity and the extent of local competition while
identifying items and prescribing minimum local content or the manner of its calculation, with a view to avoid
cost from the operation of the Order.
11. Standing Committee: A Standing Committee is hereby constituted with the following membership:
1) Administrative Secretary, Department of Industries and Commerce - Chairperson
2) Administrative Secretary, Department of Finance - Member
3) Administrative Secretary, Department of Health and Family Welfare - Member
4) Administrative Secretary, Department of Public Works - Member
5) Administrative Secretary, Department of School Education - Member
6) Administrative Secretary, Department of Water Supply and Sanitation - Member
7) Administrative Secretary, Department of Local Government - Member
8) Administrative Secretary, Department of Rural Development and Panchayat - Member
9) Director, Industries and Commerce - Member Secretary

The Secretary of the department concerned with a particular item shall be a Member in respect of issues
relating to such item. The Chairman of the Committee may co-opt technical experts as relevant to any issue or
class of issues under its consideration.
12. Functions of the Standing Committee: The Standing Committee shall meet as often as necessary as but
not less than once in six months. The Committee
a. shall oversee the implementation of this order and issues arising there from and make recommendations
to the procuring entities.
b. shall annually assess and periodically monitor compliance of this Order.
c. may require furnishing of details or returns regarding compliance of this Order and related matters.
d. may during annual review, or otherwise, assess issues if any, where it is felt that the manner of
implementation of the order results in any restrictive practices, cartelization or increase in public
expenditure and suggest remedial measures.
e. may consider any other issue relating to this Order which may arise.
f. shall take decisions on all complaints relating to implementation of this order.
g. May exempt any particular item or procuring or supplying entities or class or classes of items or procuring
or supplying entities from the operation of this policy or any part of the Order.
13. Removal of difficulties: Any difficulty arising in the implementation of this Order by any procuring entity
shall be referred by them to the Department of Industries and Commerce, Punjab, which shall issue such
clarification or instructions as may be necessary for removal of these difficulties.
14. Departments having existing policies: Wherever any Department has its own policy for preference to
local content, this Order shall prevail over the provisions of such existing policies.
15. Transitional provision: This Order shall not apply to any tender or procurement for which notice inviting
tender or other form of procurement solicitation has been issued before the issue of this Order.
This Order issues with the approval of the Council of Ministers, Government of Punjab conveyed vide
letter No.1/90/2019-1cabinet/ 2557 dated: 25.07.2019.

NOTIFICATION
The 3rd December, 2019

WHEREAS, the Government of Punjab had notified the Punjab Regulation of
Saw Mills, Veneer and Plywood Industries Rules, 2006 for regulating the
operation of Saw Mills, Veneer and Plywood Industries in the State of Punjab;
WHEREAS, in compliance with the directions contained in the order
dated 5.10.2015 passed by The Hon'ble Supreme Court of India in Writ Petition
(Civil) No. 202 of 1995 titled as T.N. GodavarmanThirumulpad Versus Union
of India and Others, the Government of India, Ministry of Environment, Forests
and Climate Change issued the Wood-Based Industries (Establishment and
Regulation) Guidelines, 2016;
WHEREAS, the aforesaid Guidelines require that the States shall conform
their rules according to these Guidelines;
Now, therefore, in exercise of the powers conferred by sections 32, 33,
35-A,72, 76, 77 and 78 of the Indian Forest Act, 1927 (16 of 1927), and all
other powers enabling in this respect, the Governor of Punjab is pleased to
make the following rules in conformity with the Wood Based Industries
(Establishment and Regulation) Guidelines, 2016 issued by the Ministry of
Environment, Forests and Climate Change, namely :-
1. Short title, extent and commencement.- (1) These rules may be called
The Punjab Regulation of Wood Based Industries Rules, 2019.
(2) They shall extend to the whole of the State of Punjab.
(3) They shall come into force on and with effect from the date of their
publication in the Official Gazette.
2. Definitions.-(1) In these rules, unless the context otherwise requires,
(a) 'Act' means the Indian Forest Act, 1927 (Central Act No. 16 of
1927);

(b) 'Charcoal' means a form of carbon derived from incomplete
combustion of wood derived from a tree;
(c) 'Divisional Forest Officer' means the incharge of any of the
Territorial Forest Divisions;
(d) 'Form' means the Form appended to these rules;
(e) 'Industrial Estate/Park' means an Industrial area or Estate or Park
set up by the Government or Private Agency for establishment or
promotion of Industries after seeking approval of its layout plan
from the competent authority;
(f) 'License' means the license issued to wood based units under these
rules;
(g) 'Principal Chief Conservator of Forests' means a Forest officer
of the rank of Principal Chief Conservator of Forests (Head of
Forest Force) in the State;
(h) 'Primary units' include units which use or store unprocessed wood
such as saw mills, peelers, chipping units (having drum chipper
which can process round logs) and shall also include the units which
are categorised as primary units by the State Level Committee from
time to time;
(i) 'Registration' means the registration of wood based units under
these rules;
(j) 'Round log' means a piece of wood in its natural form, having
mid girth of thirty centimetres or more over bark and it will include
such round log even after its bark has been removed or its surface
has been dressed;
(k) 'Saw Mill' means plants and machinery in a fixed structure or
enclosure and the premises in which or in any part thereof, for
conversion of round logs into sawn timber;
(l) 'Sawn Timber' means beams, scantlings, planks, battons and such
other products obtained from sawing of a round log but does not
include finished products;
(m) 'Secondary units' meansthose units which take wood from primary
units for further storage and processing such as mills that produce

Medium Density Fibreboard, Particle Board, Block Board, Paper
Pulp, Rayon, plywood pasting units without peeling, Katha Bhatties
using boilers conforming to Indian Boiler Regulations (IBR) etc.
and shall also include the units which are categorised as secondary
units by the State Level Committee from time to time;
(n) 'State Government' means, the Government of the State of Punjab
in the Department of Forests and Wildlife Preservation;
(o) 'State Level Committee (SLC)' means a Committee constituted
underrule 3 of these rules;
(p) 'Veneer Mill’ means plants and machinery and the premises in
which or in any part thereof, conversion into required size, slicing,
peeling, fashioning of round logs is undertaken;
(q) 'Wood Based Industry' also referred to as WBI means any industry,
which processes wood as its raw material (Sawmills/veneer units/
plywood units/ pulp units/katha units/charcoal making unit/transit
depots/timber depots/furniture or any other type of wood based
units converting round logs); and
(r) 'Year' means a financial year.
(2) The words and expressions used but not defined in these rules but defined
in the Act or the relevant local Forest Act as applicable in the State of
Punjab and the rules framed thereunder, shall have the meaning assigned
to them in such Act or rules.
3. State Level Committee.-(1)A State Level Committee (SLC) shall be
constituted by the State Government with Principal Chief Conservator of
Forests (HoFF) as its Chairman.
The State Level Committee shall constitute as following :
a) Principal Chief Conservator of Forests/Head of Chairperson
Forest Department
b) A representative of the Regional Office of the Ministry Member
of Environment, Forest and Climate Change
c) A representative of the State Forest Department not below Member
the rank of a Conservator of Forests dealing with
preparation of Working Plans/Working Schemes

d) Director/Additional Director of Department of Industries Member
e) Representative of the each Autonomous District Council Member
constituted in accordance with the provisions of the Sixth
Schedule to the Constitution, in case any such Council
exists in the State
f) Representative of the Forest Development Corporation, in Member
case any such Corporation exists in the state.
g) An officer not below the rank of Conservator of Forests Member
working in the Forest Head Quarters Secretary
(2) The State Level Committee may co-opt any number of other officers
working in the Department of Forests and Wildlife Preservation,
Department of Agriculture, Department of Revenue and Department of
Industries and Commerce.
(3) Till the constitution of the State Level Committee under these rules, the
earlier State Level Committee shall continue to function and decisions
taken by it shall be deemed to have been taken by the State Level
Committee constituted under these rules.
(4) The State Level Committee shall meet at least once in three months.
(5) The quorum of the State Level Committee meeting shall be at least fifty
percent of the permanent members.
(6) The State Level Committee shall invite one representative of the industry
nominated by the Wood Based Industries Association as a special invitee
to each and every meeting of the State Level Committee.
4. Powers and functions of the State Level Committee.- Following shall
be the powers and functions of the State Level Committee, namely:-
(i) To assess the availability of timber in the State by way of appropriate
study on demand and supply as and when it decides. State Level
Committee shall devise a suitable mechanism for sustainable use of timber
in a way that does not affect the forests in the State adversely.
(ii) To grant fresh license or registration certificate or enhancement of
the existing licensed capacity or transfer of units or change of
ownership or any other issue pertaining to license or registration, in
case the State Level Committee is satisfied that wood is available

from trees outside forests as well as in forests, for the said Wood
Based Industries.
(iii) To examine and make appropriate recommendations to the State
Government on issues relating to Wood Based Industries.
(iv) To define or list out the agro-forestry species in the State from time
to time.
(v) To determine one-time payment for grant of license or registration,
license fee, registration fee and any other fee as may be deemed fit
from time to time.
(vi) To modify any Form appended to these rules or prescribe new
Form, if and when needed for the purpose of monitoring and
regulation of licensed or registered units.
(vii) To work out measures to improve transparency, use of technology,
capturing and better handling of information and create a portal to
provide a platform on which information can be uploaded and
utilised.
(viii) To ensure that the amount recovered from Wood Based Industries
and lying with the Department of Forests and Wildlife Preservation
is utilized for the purpose of afforestation and other ancillary purposes
to realise the aims and objects of these rules.
(ix) To approve the Annual Plan of Operations for afforestation submitted
by Territorial Divisional Forest Officers for utilization of the amount
of one-time payment realized from the Wood Based Industries and
lying with the Department of Forests and Wildlife Preservation.
(x) Such other powers and functions as may be entrusted by the State
Government from time to time.
5. Estimated annual consumption of timber by Wood Based Industries.-
For the purpose of assessing the wood requirement of the Saw mills, the
annual requirement of round wood for Saw mills of different capacities
may be fixed by the State Level Committee based on the criteria approved
by the Central Empowered Committee (Constituted by the Hon’ble
Supreme Court of India in Writ Petition Nos. 202 of 1995 and 171 of
1996). For other Wood Based Industries, the consumption of timber
would be taken based on the Government of India Guidelines of 2016

or based on any scientific/technical study to the satisfaction of the State
Level Committee.
6. Restriction on Location of Wood Based Industries.-(1) No new
Wood Based Industry shall be granted licence within one kilometre aerial
distance from Government Forests notified as Reserve Forests, Protected
Areas, Protected Forests or unclassed forests but not the strips along
roads, canals, drains, bandhs, rails and escapes notified as Protected
Forests.
(2) Wood Based Industry can be set up within a Notified Industrial
Estate/Park or a municipal area irrespective of the aerial distance as
mentioned in sub-rule (1).
(3) The restriction imposed in sub rule (1) shall be applicable to only
those units which require license.
(4) Already existing units which are duly licensed shall not be required
to shift their location.
7. Grant, renewal and revocation of a license or Registration certificate
to a Wood Based Industry.-(1)No license to a Wood Based Industry
shall be granted or renewed without obtaining prior approval of State
Level Committee. However, State Level Committee may delegate the
power of renewal of license to a Wood Based Industry to the Divisional
Forest Officer of the concerned Division in which the Wood Based
Industry is located.
(2) All Wood Based Industries are required to be licensed or registered
under these rules.
(3) No person shall establish, expand the installed capacity, shift location
or operate Wood Based Industries, including the existing unit, unless
a license or registration certificate is previously obtained by him in
accordance with these rules.
(4) Following Industries or Processing units shall not require license
under these rules, namely :-
(i) Industries or processing units not operating with a band saw
or process already sawn wood;
(ii) Industries or processing units operating with a circular saw

upto thirty centimeter diameter;
(iii) Industries having specialized requirement (as decided by the
State Level Committee) and using circular-saw upto sixty
centimeter diameter;
(iv) Industries or Processing units not using round logs of domestic
origin i.e. using imported wood or timber from outside the
country irrespective of size and type of saw. However, such
Industries or processing units shallbe required to provide the
requisite documentation regarding this as may be specified by
the State Level Committee; and
(v) Industries or processing units using round logs of the species
notified as agriculture or agroforestry produce and/or exempted
from the regime of felling and transit regulations,irrespective
of size and type of saw.
(5) All Industries or processing units mentioned in sub-rule (4) which have
been exempted from licensing shall, however, be required to get themselves
registered with the Department of Forests and Wildlife Preservation under
rule 10 of these rules and shall also have to establish the source of raw
material for their industry. Irrespective of the exemptions listed in sub-
rule (4), all existing units shall also be required to register themselves with
the Department of Forests and Wildlife Preservation within a period of
six months from the date of coming into force of these rules. If any unit
fails to get itself registered, such unit shall be deemed to be violating
these rules and shall, hence, be liable for action.
(6) Transfer of licence or registration certificate on sale/succession etc. shall
be done only with the prior approval of State Level Committee.
(7) The Wood Based Industry shall have to be set up within six months from
the date of grant of license or registration certificate, as the case may be,
failing which the license or registration certificate, as the case may be,
may be extended; or revoked by the Divisional Forest Officer after three
months' notice under intimation to the State Level Committee :
Provided that in case it is extended, not more than three months'
extension shall be granted by the Divisional Forests Officer.

(8) All Wood Based Industries shall follow all environmental and
other regulations laid down by the Punjab Pollution Control
Board, Central Pollution Control Board and Ministry of
Environment, Forest and Climate Change, as applicable to these
industries under the Environment (Protection) Act, 1986
(Central Act No. 29 of 1986) and other Central and State Acts.
8. Process of obtaining licence.-(1) Any person or Wood Based
Industry seeking a licence under these rules, shall make an
application in Form-I to the Deputy Commissioner of the
concerned District alongwith a copy to the General Manager,
District Industry Centre (DIC) for No Objection Certificate and
a copy to the concerned Divisional Forest Officer, specifying
that the applicant wants a license.
(2) A permanent District Level Committee (DLC) for Wood
Based Industries shall be constituted by the concerned
Deputy Commissioner under his chairmanship with
General Manager, District Industry Centre as Nodal
Officer-cum-Member Secretary and officers-in-charge of
the concerned department sat the District Level as
members. The concerned Board/departments shall be the
Punjab Pollution Control Board, Department of Industries
and Commerce, Department of Housing and Urban
Development, Department of Local Government,
Department of Agriculture, Department of Labour,
Department ofPWD (B&R),Department of Police or any
other authority with the prior approval of the concerned
Deputy Commissioner.
(3) It shall be the responsibility of the General Manager, District
Industry Centre to convene the meeting of the District
Level Committee and obtain the No Objection Certificate
of the concerned department other than that of the Forest
Department at the earliest possible. Based on these No
Objection Certificates, the Deputy Commissioner shall
issue a final No Objection Certificate for the establishment
of the Wood Based Industry and send it to the concerned

Divisional Forest Officer.
(4) The Divisional Forest Officer shall then send the final No Objection
Certificate to the State Level Committee alongwith the application
form and other specified documents for its approval.
(5) After considering the application from all aspects, the State Level
Committee shall decide the application for its approval.
(6) Final approval of license shall be subject to the deposit of one-time
payment to the Department of Forests and Wildlife Preservation on
various categories of Wood Based Industries as may be determined
by the State Level Committee from time to time and also the license
fee to the Government as may be determined by the State Level
Committee from time to time. Thereafter, the administrative/

licensed unit annually at such rates as may be determined by the
State Government from time to time.
(7) The Divisional Forest Officer concerned shall then grant license in
Form III for a period of five years after receiving such fee as
decided by the State Level Committee within a fortnight.
(8) In case any discrepancy is noticed or found in the application or
supporting documents at any point of time during application process
or even after grant or renewal of license, the license may be cancelled
by the concerned Divisional Forest Officer with the prior approval
of the State Level Committee.
(9) Availability of wood other than that obtained from the agroforestry
species in the State shall be considered and accounted for only
against the licenses granted to the Wood Based Industries.
9. Regulation of Khair wood, traditional Katha Bhatties and Katha Bhatties
using boilers conforming to the Indian Boiler Regulations(IBR).-
(1)Traditional Katha Bhatties shall be regulated by the Divisional Forest
Officer as per provisions of the Management Plan approved by the
Government of India, Ministry of Environment, Forests and Climate
Change for the private forests closed under the Punjab Land Preservation
Act, 1900 (Punjab Act No. II of 1900).
(2) Register regarding consumption of Khair-wood and katha prepared
by the traditional kathabhatties and kathabhatties using Indian Boiler

Regulations (IBR) boilers shall be maintained in the following form,

(3) The operation of the Katha Bhatties using IBR boilers shall be
regulated as per the following conditions, namely :-
(i) The existing kathabhatties using IBR boilers shall be allowed
to operate at their current level of consumption of khair wood,
which shall be declared by the Wood Based Industry at the
time of submitting application for License along with details
of all machinery installed or being installed like Band Saw,
Chipper, Boiler, Autoclave, Evaporator, Cooling Chamber, etc,
if any.
(ii) If any kathabhatti using IBR boiler is found to be in possession
of unaccounted khair wood or khair wood from a source,
other than legal source, its license shall be cancelled without
any prejudice.
(iii) The baby boiler units shall upgrade their existing boilers to
IBR boilers and shall be brought under the purview of the
Boilers Act, 1923 (Act No. 5 of 1923) and rules made
thereunder. All the boilers shall have to be got registered in
accordance with the said Act.
(4) All the kathabhatti owners shall have to obtain requisite approval/
permission, if any, as required under any Act or rules. The procedure
for licensing laid down for all wood based industries under rule 8 of
these rules shall be applicable to all the katha units also.

(5) All types of fees as applicable to other Wood Based Industries
shall be applicable to all the katha units also.
(6) New licence or expansion shall be allowed on the basis of principles
of Sustainability Forest Development to the satisfaction of State
Level Committee.
10. Process of Registration of Wood based Industries not requiring
license.-(1) Any person or Wood Based Industry, not requiring license
under these rules, is required to be registered under these rules. For
registration, an application is to be made in Form-II to the Deputy
Commissioner of the concerned district along with a copy to the General
Manager, District Industry Centre for No Objection Certificate and a
copy to the concerned Divisional Forest Officer.
(2) A permanent District Level Committee (DLC) for Wood Based
Industries shall be constituted by the concerned Deputy
Commissioner under his chairmanship with General Manager, District
Industry Centre as Nodal Officer cum Member Secretary and
officers-in-charge of the concerned departments at the District Level
as members. The concerned Board/departments shall be the
Pollution Control Board, Department of Industries and Commerce,
Department of Housing and Urban Development, Department of
Local Government, Department of Agriculture, Department of

other authority with the prior approval of the concerned Deputy
Commissioner.
(3) It shall be the responsibility of the General Manager, District Industry

11. Renewal of licence or registration.-(1) Any person who has been granted
license or registration under these rules shall apply for renewal of the same in
Form I or Form II, as the case may be, atleast six months before the expiry of
the period for which the licence or registration certificate was granted. Person
seeking renewal shall pay such renewal fee, as may be specified by the State
Level Committee from time to time.
(2) On receipt of an application under sub-rule (1), the Divisional Forest
Officer after satisfying himself that such application is in accordance
with the guidelines issued by the Government from time to time,
shall submit the renewal application along with his verification and
comments to the State Level Committee within a period of thirty
days from receipt of the application. The Divisional Forest Officer
shall renew the license or registration after obtaining the approval
of the State Level Committee for such period as may be determined
by State Level Committee. The State Level Committee may,

however, delegate the power of approval and renewal of license or
registration to the Divisional Forest Officer.
12. Maintenance of record.- (1) Every licensed and registered Wood Based
Industries shall maintain proper record of the receipt and disposal of
timber in Form-IV and V.
(2) The licensed and registered Wood Based Industry shall produce the
record for scrutiny and checking of the timber, whenever it is required
by the Divisional Forest Officer or any other officer authorised by
him.
(3) All licensed and registered firms shall be required to file the annual
return in Form VI regarding the consumption/usage of wood. Annual
return along with annual green fee shall be filed by 30thSeptember
of every year for the preceding financial year, failing which the
registration or license of the Wood Based Industry shall not be
extended and penalty shall be imposed as per rule 17 of these rules.
(4) In case a licensed firm does not use the installed capacity to the full
extent, theState Level Committee may take appropriate remedial
measure(s), including modification of license capacity and even
revoking of license in case the licensed firm is not using its optimal
capacity continuously for a period of eighteen months which is
extendable at the discretion of the State Level Committee after
examining the explanation given by the Wood Based Industry owner.
13. Green Fee.- (1) A green fee shall be levied annually, which shall be used
for promotion of agroforestry in the State in order to safeguard the interests
of the farmers and maintain the tree cover.
(2) The green fee referred in sub-rule (1) shall have to be deposited by
the licensed or registered units annually at the rate of ten rupees per
cubic meter of the installed capacity upto 31st March of each year,
which may be extendable upto 30th April, by the concerned
Divisional Forests Officer, failing which the Wood Based Industry
shall be liable to deposit simple interest of five percent per annum
on delay upto six months and ten percent per annum thereafter.

way of a notification. The Green fee shall be deposited in the
Consolidated Fund of the State.
14. Power to search the premises.-Any Forest Officer holding the charge
of Forest Block or his superior, alongwith the team, if required, may at
any time, enter the premises of any wood based industrial unit and check
the records and take samples, if necessary, with a view to ascertain the
genuineness of the licence or registration or to check the legitimacy of the
source of wood, type of wood used and machinery installed.
15. Revocation of licence or registration.-Notwithstanding anything
contained in these rules, theDivisional Forest Officer, where he has
reason(s) to believe that a licensed or registered firm is operating in
contravention to the provisions of these rules or conditions of the licence
or registration or is indulging in activities prejudicial to the interest of
forest conservation, may after giving such licensed or registered Wood
Based Industry an opportunity of being heard, recommend to the State
Level Committee to cancel, suspend or revoke the licence or registration
granted under these rules. The State Level Committee shall take a final
decision in this regard.
16. Appeal against the refusal to grant or renew of licence/registration
or revocation of licence or registration.-Any person, who has been
refused grant or renewal of licence or registration, or whose license or
registration has been revoked under these rules, on receipt of information
of such refusal or revocation, as the case may be, may appeal against the
decision of the State Level Committee to the Administrative Secretary of
the Department of Forests and Wildlife Preservation within a period of
thirty days of the refusal/revocation.
17. Penalty.- (1) Whoever contravenes any provision of these rules shall be
punishable with imprisonment for a term which may extend to two years
or with fine which may extendto five thousand rupees or both.
(2) In case, any direction of the State Level Committee is not complied
within the specified time, a penalty upto one rupee per day per
Cubic Meter of the installed capacity may be imposed.
18. Rules not to apply in certain cases.-Nothing contained in these rules
shall apply to the ordinary operations of domestic carpentry, furniture
units, wooden toy and handicraft making units and firewood depots,

19. Repeal and savings.-The Punjab Regulation of Saw Mills, Veneer and
Plywood Industries Rules, 2006, are hereby repealed :
Provided that any order issued or any action taken under the rules, so
repealed, shall be deemed to have been issued or taken under the corresponding
provisions of these rules.

2. The Licensee/Registration Certificate holdershall not alter the location of the industry
without obtaining prior permission in writing of the Divisional Forest Officer concerned.

(a) the site of the sawmill including the depot/yard for storage of round timber,

proper gates;
(b) all the round timber, sawn timber and wood waste is properly stacked according

industry within the 1 Km of block forests, notified wildlife sancturies, national

4. The Licensee/Registration Certificate holder shall not install/operate any machine
for which the Licencee is not issued. If the Licensee/Registration Certificate holder
is found to have installed/operate any machine for which license/registration
certificate is not issued, the license/registration certificate issued to the unit shall be
