Scope:
Identify the main People consequences in case of turnaround, the related issues and the possible main solutions.
In particular, scout the range of benefits that’s possible to obtain from: a systematic use of the Job Rotation (JR) and the introduction of a Lifelong Competence Evolution management approach. Legal/ contractual constraints to JR and their foreseeable evolution are also considered.

A precise JR discipline has to be maintained, to the purpose to assure continuity for the workforce quality (role flexibility and professional differentiation: see slide 6).
JR is one of the key instrument to assure professional and carrier development, with benefit for the employer branding (PULL on entry labor market) and the workforce engagement level (see slide 6).

The equation says that two are the events influencing the overall quantitative work force level: - the difference between In and Out flows (In.Out); - the fluctuation due to the long term leaves (ΔLTATot)

MATURE WORK FORCE AND PERFORMANCE (1/2):A company case
In Company XYZ, those aged 55 and over are the 6% of the total HC.In the coming two years, fixed the overall HC, we can estimate they will increase (entering the cohort of those today aged 53/54 and maintaining fixed the HC) till the 11% (see table below for distribution and critical highlights – in red -).
We can expect this percentage will increase, in case of turnaround (till 14-15%): higher is the likelihood that younger people will accept incentive to leave.
The challenge we need to be prepared for is to maintain the capacity for work: the motivation and the productivity of these relatively more mature employees.

TURNAROUND MAIN PEOPLE CONSEQUENCES:Key Improvement Actions
In the previous slides, we addressed in some detail the main people consequences of the turnaround:• hiring freeze and internal organizational unbalances;• engagement and performance maintenance;• mature work force relative increase.
This analysis, highlighted that a systematic use of the Job Rotation and of the Lifelong Competence Evolution of the employees will effectively support to manage all the previous People impacts.
Basically generating a work force with greater level of Flexibility and Professional Diversification: both key characteristics for a competitive leverage of the work force in other business scenario too.
In coming slides, concrete suggestions will be provided to improve the use of internal Job Rotations (also considering law/ contract constraints) and to implement Lifelong Competence Evolution management.

Proactive application of the Collective Bargaining Agreement (CBA), in particular stimulating the existing stated conditions for Job Rotation possibility/ right :
- After 4 years in same position/ job, check for voluntary move up to 10% of the Operational FTE (OpFTE) of a first level Function/ Direction
- Any case implement Replaceable concept (Fungibilità in certain CBA) at least for 5% of the OpFTE of a first Level Function/ Direction
- Priority is given to voluntary moves and to “right to be moved” holders in particular
- Priority is given to the development of people belonging to Sheltered Positions (positions characterized by obsolete competences)
- Job Rotation is implemented under substitution availability, with exception in cases where local optimization is planned
- Finalizing an individual Job Rotation, the involved employee has to be supported to integrate the move in a Lifelong Competence Evolution view. To this purpose could be helpful:
- the preliminary definition of Career Paths inside/ between specified professional areas;- the integration between past and new competences in a meaningful curricula (till “to update together the professional CV”), able to increase the potential employability value of the involved employee (Orientation Support);- at least entry and senior positions/ jobs are identified as career’s “beginning facilitation” / “maturity valorization” points

- Lifelong Competence Management guidelines for employees published on the intranet (following the std steps: self assessment, preferred professional evolution, company opportunities, personal development planning, development resources access)
- Definition of Career Paths inside/ between specified most common or business key professional areas
- Identify at least entry and senior positions/ jobs as suggested initial/ max valorization career
points, and Sheltered Positions just to avoid excessive employability loss.
- In case of Job Rotation, supply an Orientation Service to the purpose to help the involved employee in integrating the move in the Lifelong Competence Evolution view. The Job Rotation rationale could be based on:
- the defined Career Paths;- on a specific individual counseling that help to integrate past and new competencies in a meaningful curricula, able to increase the employability value

Art 2013 CC: <<Il prestatore di lavoro deve essere adibito alle mansioni per le quali è stato assunto o a quelle corrispondenti alla categoria superiore che abbia successivamente acquisito ovvero a mansioni equivalenti alle ultime effettivamente svolte, senza alcuna diminuzione della retribuzione>>.
Il tema generale è quello dello Jus Variandi in caso di cambio Mansione, ovvero : in che misura due mansioni possano essere considerate “equivalenti”, “variate non in maniera tale da invalidare la professionalità acquisita”
Il tema può essere analizzato sotto diversi punti di vista:
• Giurisprudenziale• Culturale• Negoziale

Giurisprudenziale
La giurisprudenza si è posta il problema di come contemplare questo diritto con una crescente dinamica (se non fluidità) delle identità professionali, ma il massimo che sembra essere stato acquisito è una apertura ad una dinamica: - o “verticale” (perfezionamento e accrescimento del corredo professionale già posseduto) ;
- o “temporanea” (gestione eccezionale di contingenze o rotazione nella mansione di tutti I lavoratori con le medesime qualifiche).
(esempio: Corte appello di Roma 7160/06, Cassazione 24293/08, Cassazione 23601/09 - slide 20) .
Rimane, quindi, ancora di potenziale problematica applicazione il cambio mansione con carattere di permanenza e che implichi la transizione fra due profili professionali fra cui viene richiesta una significativa integrazione delle competenze se non un deciso salto di know how.

Culturale
Lo scoglio culturale da superare, sembra essere quello che vede nel cambio mansione uno svantaggio netto per il lavoratore in quanto: la discontinuità della linea professionale, ponendolo in una posizione di minore seniority, tanto più evidente quanto maggiore è la necessità di apprendere ex novo un ampio insieme di cognizioni (!), farebbe diminuire il valore di mercato del lavoratore [se temporaneamente e per quanto sarebbe poi tutto da approfondire per una gestione concordata del transitorio].

Negoziale
La problematica dello Jus Variandi in tema di mansioni sembra essere stata assunta nelle “Linee Programmatiche per la crescita della produttività e della competitività in Italia” (note anche come Accordo sulla Produttività, del 16 novembre 2012), in particolare nel paragrafo 7, dove si dichiara la avocazione alla contrattazione collettiva dei temi “dell’equivalenza delle mansioni e dell’integrazione delle competenze”.
Nel frattempo la contrattazione collettiva ha affrontato variamente il tema. Ad esempio, il contratto collettivo del settore bancario, utilizza alcuni interessanti concetti a supporto del cambio mansione (vedere anche slide 22), dove quelli chiave sono quelli di Fungibilità e di Sostituzione:
• Fungibilità• Mobilità come supporto allo sviluppo• Facoltà/ diritto alla mobilità• Sostituzione.
Fungibilità e Mobilità per lo Sviluppo possono essere utilizzate su iniziativa aziendale, all’interno di un perimetro definito rispetto alla categoria contrattuale di appartenenza (in linea di massima coincidente la categoria stessa).
Cosi come la Sostituibilità, anche se questa è accompagnata da un vincolo sulla durata, pena il passaggio di livello retributivo (passaggio al livello retributivo dell’assente, se superiore al proprio, dopo un certo nr di mesi, specificato in una serie di casi)
Facoltà/ diritto alla mobilità, promuove l’uso della mobilità da parte del lavoratore, dopo il permanere nella medesima mansione per un certo numero di anni.

• L’equivalenza in giurisprudenza tende ad essere vista come consolidamento ed ampliamento del bagaglio acquisito
• In contesti negoziali, l’ambito di equivalenza viene ampliato ad intere Aree Contrattuali (contenenti di solito più Categorie ovvero Livelli retributivi): concetto di Fungibilità.
• Unico ambito derogatorio al momento esistente, è quello della “gestione di contingenze”, come la Sostituzione, concetti che implicano una temporaneità della deroga.

Sono molteplici, una delle più sofisticate afferma che, nell’attuale contesto di liquidità delle professioni, abbia più senso misurare il Valore di una Mansione considerando I tre parametri:
- Complessità- Autonomia- Importanza
E quindi confrontare il Valore di due differenti Mansioni per stimarne le differenze.
L’obiezione a tale approccio è che I 3 parametri considerano più le dimensioni Manageriali che Tecnico-Professionali di una mansione
Scoglio Culturale
Rimarrebbe quindi inevasa l’obiezione principale al cambio mansione non coerente con art 2103 cc, secondo cui esso sarebbe uno svantaggio per il lavoratore in quanto:
- la discontinuità della linea professionale, - evidenzata dalla necessità di apprendere ex novo un ampio insieme di cognizioni,- Farebbe dimuire [se temporaneamente, e quanto, o permanentemente sarebbe da approfondire] il
valore di mercato del lavoratore
e pertanto potrebbe avere luogo solo previo il suo consenso.

Fungibilità: Sia per Aree Professionali (art 84) sia per Quadri (art 77), è definita come la facoltà per l’impresa di attribuire al lavoratore/ trice tutte le attività di pertinenza nell’ambito del perimetro di categoria contrattuale di appartenenza (vedere in NOTA le caratteristiche dei perimetri).La motivazione di tale Fungibilità è in entrambi I casi duplice:Le esigenze aziendali (organizzative);Il consentire ai lavoratori conoscenze quanto più complete del lavoro ed un maggior interscambio dei compiti
Mobilità come supporto allo sviluppo professionale della 3^ Area (art 90, comma 2)Per I lavoratori della 3^ Area, viene dedicata particolare importanza alla cura dello sviluppo professionale, sia tramite apposizta formazione (art 90, comma1) sia attraverso la promozione della mobilità: “esperienze pratiche di lavoro e mobilità su diverse posizioni di lavoro finalizzata ad accrescere nel lavoratore/trice le competenze”
Facoltà/ diritto del lavoratore alla mobilità (art 91)Dopo 3 anni nella medesima mansione, I lavoratori della 3^ area (o del 3^ livello 2^ Area) possono richiedere di essere utilizzati in altre mansioni di propria pertinenza (comma 1).Viceversa I lavoratori hanno diritto, dopo 8 anni di adibizione alla medesima mansione, di ottenere, su richiesta, di essere utilizzati in altre mansini di propria pertinenza (comma 3)

NOTAPer le aree professionali, il perimetro è quello dell’area professionale cui appartiene il lavoratore (qualunque sia il suo livello retributivo/ profilo professionale attuale).
Per i quadri, sono specificati due perimetri: 1/2/3 livello e 2/3/4 livello.
